3232 AN ACT
3333 RELATING TO PUBLIC WORKS; REQUIRING CONTRIBUTIONS TO APPRENTICE
3434 AND TRAINING PROGRAMS OR TO THE PUBLIC WORKS APPRENTICE AND
3535 TRAINING FUND FOR ALL PUBLIC WORKS CONSTRUCTION PROJECTS.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. Section 13-4D-4 NMSA 1978 (being Laws 1992,
3838 Chapter 74, Section 4, as amended) is amended to read:
3939 "13-4D-4. ADMINISTRATION.--
4040 A. The Public Works Apprentice and Training Act
4141 shall be administered by the workforce solutions department.
4242 The department shall collect employers' contributions in
4343 accordance with that act, review employers' compliance
4444 statements, review certified payroll reports to verify training
4545 contributions, investigate allegations of and impose penalties
4646 for employer noncompliance and disburse funds as provided in

7575 B. Public works construction projects [except for
7676 street, highway, bridge, road, utility or maintenance contracts
7777 with employers who elect not to participate in training ] shall
7878 not be constructed unless an employer agrees to make
7979 contributions to approved apprentice and training programs in
8080 New Mexico in which the employer is a participant or to the
8181 public works apprentice and training fund administered by the
8282 workforce solutions department. Contributions shall be made in
8383 the same manner and in the same amount as apprentice and
8484 training contributions required pursuant to wage rate
8585 determinations made by the department.
8686 C. The workforce solutions department shall adopt
8787 rules and regulations necessary to implement the provisions of
8888 the Public Works Apprentice and Training Act."
