3252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3353 SECTION 1. Section 24-25-3 NMSA 1978 (being Laws 2004,
3454 Chapter 48, Section 3, as amended) is amended to read:
3555 "24-25-3. DEFINITIONS.--As used in the New Mexico
3656 Telehealth Act:
37-A. "health care provider" means a person licensed
38-to provide health care to patients in New Mexico, including:
57+A. "health care provider" means a person licensed,
58+certified or registered to provide health care to patients in
59+New Mexico, including:
3960 (1) an optometrist;
4061 (2) a chiropractic physician;
4162 (3) a dentist;
42-(4) a physician;
43-(5) a podiatric physician;
44-(6) an osteopathic physician;
45-(7) a physician assistant;
46-(8) a certified nurse practitioner;
47-(9) a physical therapist;
48-(10) an occupational therapist;

93-patient may receive health care via telehealth. An
94-originating site may include:
95-(1) a licensed inpatient center;
96-(2) an ambulatory surgical or treatment
97-center;
98-(3) a skilled nursing center;
99-(4) a residential treatment center;
100-(5) a home health agency;
101-(6) a diagnostic laboratory or imaging

135158 (12) the patient's residence;
136159 (13) a federally qualified health center; or
137160 (14) a community health center; and
138161 C. "telehealth" means the use of electronic
139-information, imaging and communication technologies,
140-including interactive audio, video, data communications as
141-well as store-and-forward technologies, to provide and
142-support health care delivery, diagnosis, consultation,
143-treatment, transfer of medical data and education."
144-SECTION 2. Section 24-25-5 NMSA 1978 (being Laws 2004,
145-Chapter 48, Section 5, as amended) is amended to read:
146-"24-25-5. SCOPE OF ACT.--
147-A. The New Mexico Telehealth Act does not alter
148-the scope of practice of any health care provider or
149-authorize the delivery of health care services in a setting,
150-or in a manner, not otherwise authorized by law.
151-B. Because the use of telehealth improves access
152-to quality health care and will generally benefit the citizens
153-of New Mexico, health insurers, health maintenance SB 252

181-payors offering services to the citizens of New Mexico are
182-encouraged to use and provide coverage for telehealth within
183-the scope of their plans or policies. The state's medical
184-assistance program is also encouraged to include telehealth
185-within the scope of its plan or policy.
186-C. Nothing in the New Mexico Telehealth Act shall
187-be construed to alter supervision requirements set forth by a
188-health care provider's applicable licensing board. A health
189-care provider shall provide telehealth services under the same
190-level of supervision required for in-person practice."
