5050 RELATING TO BORDER SECURITY; CREATING THE OFFICE OF BORDER
5151 SECURITY; PROVIDING POWERS AND DUTIES; ALLOWING FOR THE
5252 EXERCISE OF EMINENT DOMAIN; CREATING THE BORDER SECURITY FUND;
5353 MAKING APPROPRIATIONS; DECLARING AN EMERGENCY.
5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5656 cited as the "Border Security Act".
5757 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
5858 Border Security Act:
5959 A. "border fence" means a physical barrier and
6060 related infrastructure closing the open border between New
6161 Mexico and the country of Mexico;
6262 B. "director" means the director of the office of
6363 border security;

9191 C. "fund" means the border security fund;
9292 D. "office" means the office of border security;
9393 and
9494 E. "security" means border security operations.
9595 SECTION 3. [NEW MATERIAL] OFFICE OF BORDER SECURITY
9696 CREATED--DIRECTOR--STAFF--POWERS AND DUTIES.--
9797 A. The "office of border security" is created as an
9898 adjunct agency pursuant to the Executive Reorganization Act.
9999 B. The governor shall appoint a director with the
100100 advice and consent of the senate.
101101 C. Subject to appropriations, the director may
102102 appoint a deputy director.
103103 D. Subject to appropriations, the director may
104104 employ professional and clerical staff as provided in the
105105 Personnel Act.
106106 E. The office may:
107107 (1) exercise the power of eminent domain as
108108 provided by law for the condemnation of private property for
109109 public use with just compensation; and
110110 (2) enter into joint powers agreements with
111111 the federal government.
112112 F. The office shall coordinate collaborative
113113 efforts between the federal government and local governments
114114 for the construction, security and maintenance of a border
115115 fence.

144144 SECTION 4. [NEW MATERIAL] BORDER SECURITY FUND CREATED.--
145145 A. The "border security fund" is created as a
146146 nonreverting fund in the state treasury. The fund consists of
147147 appropriations, gifts, grants and donations to the fund. Money
148148 in the fund is subject to appropriation by the legislature to
149149 carry out the provisions of the Border Security Act.
150150 B. Money in the fund shall be disbursed on warrants
151151 signed by the secretary of finance and administration pursuant
152152 to vouchers signed by the director or the director's authorized
153153 representative.
154154 SECTION 5. APPROPRIATIONS.--
155155 A. Four million dollars ($4,000,000) is
156156 appropriated from the general fund to the office of border
157157 security for expenditure in fiscal years 2026 through 2029 to
158158 coordinate collaborative efforts between the federal government
159159 and local governments for the construction of a fence at the
160160 border of New Mexico and the country of Mexico. Any unexpended
161161 or unencumbered balance remaining at the end of fiscal year
162162 2029 shall revert to the general fund.
163163 B. Two million dollars ($2,000,000) is appropriated
164164 from the general fund to the office of border security for
165165 expenditure in fiscal years 2026 through 2029 for operational
166166 expenses, including establishing the office of border security,
167167 personnel, office space, furniture, equipment and supplies.
168168 Any unexpended or unencumbered balance remaining at the end of

198198 SECTION 6. EMERGENCY.--It is necessary for the public
199199 peace, health and safety that this act take effect immediately.
