96 | 96 | | CREATED--DIRECTOR--STAFF--POWERS AND DUTIES.-- |

97 | 97 | | A. The "office of border security" is created as an |

98 | 98 | | adjunct agency pursuant to the Executive Reorganization Act. |
---|
99 | 99 | | B. The governor shall appoint a director with the |
---|
100 | 100 | | advice and consent of the senate. |
---|
101 | 101 | | C. Subject to appropriations, the director may |
---|
102 | 102 | | appoint a deputy director. |
---|
103 | 103 | | D. Subject to appropriations, the director may |
---|
104 | 104 | | employ professional and clerical staff as provided in the |
---|
105 | 105 | | Personnel Act. |
---|
106 | 106 | | E. The office may: |
---|
107 | 107 | | (1) exercise the power of eminent domain as |
---|
108 | 108 | | provided by law for the condemnation of private property for |
---|
109 | 109 | | public use with just compensation; and |

110 | 110 | | (2) enter into joint powers agreements with |
---|
111 | 111 | | the federal government. |

112 | 112 | | F. The office shall coordinate collaborative |

113 | 113 | | efforts between the federal government and local governments |
---|
114 | 114 | | for the construction, security and maintenance of a border |
---|

145 | 145 | | A. The "border security fund" is created as a |

146 | 146 | | nonreverting fund in the state treasury. The fund consists of |

147 | 147 | | appropriations, gifts, grants and donations to the fund. Money |
---|
148 | 148 | | in the fund is subject to appropriation by the legislature to |
---|
149 | 149 | | carry out the provisions of the Border Security Act. |
---|
150 | 150 | | B. Money in the fund shall be disbursed on warrants |
---|
151 | 151 | | signed by the secretary of finance and administration pursuant |
---|
152 | 152 | | to vouchers signed by the director or the director's authorized |
---|
153 | 153 | | representative. |
---|
154 | 154 | | SECTION 5. APPROPRIATIONS.-- |
---|
155 | 155 | | A. Four million dollars ($4,000,000) is |
---|
156 | 156 | | appropriated from the general fund to the office of border |
---|
157 | 157 | | security for expenditure in fiscal years 2026 through 2029 to |
---|
158 | 158 | | coordinate collaborative efforts between the federal government |
---|
159 | 159 | | and local governments for the construction of a fence at the |
---|
160 | 160 | | border of New Mexico and the country of Mexico. Any unexpended |
---|
161 | 161 | | or unencumbered balance remaining at the end of fiscal year |
---|
162 | 162 | | 2029 shall revert to the general fund. |

163 | 163 | | B. Two million dollars ($2,000,000) is appropriated |
---|
164 | 164 | | from the general fund to the office of border security for |
