254254 The result of the multiplication shall be rounded to the
255255 nearest one dollar ($1.00), except that if the result would be
256256 less than the amounts set out in Subsection B of this section,
257257 then no adjustment shall be made.
258258 D. Residents who participate in the supplemental
259259 nutrition assistance program are eligible to receive a twenty-
260260 five percent discount on all license fees after qualifying with
261261 the department of game and fish. "
262262 SECTION 2. Section 25-1-5 NMSA 1978 (being Laws 1977,
263263 Chapter 309, Section 5, as amended) is amended to read:
264264 "25-1-5. OPTIONAL POWERS.--
265265 A. The board may establish a system of grading food
266266 service establishments for the purpose of certifying compliance
267267 with the Food Service Sanitation Act and regulations requiring
268268 food service establishments to display in a designated manner a
269269 grade as notice of compliance to the public. Such regulations
270270 shall include provisions for the revocation and reinstatement
271271 of the permit that are consistent with due process of law.
272272 B. The board shall establish a schedule of fees for
273273 the issuance and renewal of permits issued by the division

302302 under the Food Service Sanitation Act. The board shall set the
303303 schedule of fees [so that no fee established by such schedule
304304 shall be less than one hundred dollars ($100) or more than two
305305 hundred dollars ($200) annually for a food service
306306 establishment with not more than a twenty-five-dollar ($25.00)
307307 incremental increase per fiscal year. The board shall
308308 establish a separate schedule of fees not to exceed twenty-five
309309 dollars ($25.00) per single event or celebration per temporary
310310 food service establishment. Fees shall be waived for all
311311 temporary non-potentially hazardous food service operations,
312312 for any temporary food service establishment operating no more
313313 than two calendar days in any calendar month and for any food
314314 service establishment that provides food to the general public
315315 at no charge] necessary to carry out the provisions of the Food
316316 Service Sanitation Act and for other operational expenses of
317317 the department of environment . Fees collected for the issuance
318318 and renewal of permits pursuant to the Food Service Sanitation
319319 Act shall be deposited in the environmental health fund."
320320 SECTION 3. Section 52-5-19 NMSA 1978 (being Laws 1987,
321321 Chapter 235, Section 52, as amended) is amended to read:
322322 "52-5-19. FEE FOR FUNDING ADMINISTRATION--WORKERS'
323323 COMPENSATION ADMINISTRATION FUND CREATED.--
324324 A. Beginning with the calendar quarter ending
325325 September 30, 2004 and for each calendar quarter thereafter,
326326 there is assessed against each employer who is required or

357357 amounts, multiplied by the number of employees covered by the
358358 Workers' Compensation Act that the employer has on the last
359359 working day of each quarter:
360360 (1) prior to July 1, 2025, two dollars thirty
361361 cents ($2.30);
362362 (2) beginning July 1, 2025 and prior to July
363363 1, 2028, two dollars fifty-five cents ($2.55);
364364 (3) beginning July 1, 2028 and prior to July
365365 1, 2033, two dollars sixty-eight cents ($2.68); and
366366 (4) beginning July 1, 2033, two dollars eighty
367367 cents ($2.80).
368368 B. At the same time the fee pursuant to Subsection
369369 A of this section is assessed , there is assessed against each
370370 employee covered by the Workers' Compensation Act on the last
371371 working day of each quarter a fee [of two dollars ($2.00) ] in
372372 the following amounts , which shall be deducted from the wages
373373 of the employee by the employer and remitted along with the fee
374374 assessed on the employer:
375375 (1) prior to July 1, 2025, two dollars
376376 ($2.00);
377377 (2) beginning July 1, 2025 and prior to July
378378 1, 2028, two dollars twenty-five cents ($2.25);
379379 (3) beginning July 1, 2028 and prior to July

416416 five percent of the gross fees collected to reimburse the
417417 department for costs of administration.
418418 [C.] E. The taxation and revenue department shall
419419 pay over the net fees collected to the state treasurer to be
420420 deposited by [him] the treasurer in a fund hereby created and
421421 to be known as the "workers' compensation administration fund".
422422 Expenditures shall be made from this fund on vouchers signed by
423423 the director for the necessary expenses of the workers'
424424 compensation administration; provided that an amount equal to
425425 thirty cents ($.30) per employee of the fee assessed against an
426426 employer shall be distributed from the workers' compensation
427427 administration fund to the uninsured employers' fund.
428428 [D.] F. The workers' compensation fee authorized in
429429 this section shall be administered and enforced by the taxation
430430 and revenue department under the provisions of the Tax
431431 Administration Act."

515515 A. An applicant for certification as a certified
516516 operator shall:
517517 (1) make application on forms furnished by the
518518 department;
519519 (2) submit evidence satisfactory to the
520520 department that the applicant has reached the age of majority;
521521 and
522522 (3) except as provided in Section 61-1-34 NMSA
523523 1978, pay in advance to the department fees set by rule [not to
524524 exceed:
525525 (a) for examination for certification in
526526 each classification $100;
527527 (b) for renewal of a certificate after a
528528 period set by rule $40.00; and
529529 (c) for issuance of a certificate by
530530 endorsement $100 ]
531531 to cover the reasonable costs of issuing the certificates .
532532 B. Fees collected pursuant to Subsection A of this
533533 section shall be deposited with the state treasurer in the
534534 "public water supply system operator and public wastewater
535535 facility operator fund", hereby created. The fund shall be
536536 used solely for the purpose of administering and enforcing the
537537 Utility Operators Certification Act. The fund shall be
538538 administered by the department. Money in the fund shall be

578578 D. Fees shall not be increased more than once per
579579 calendar year. [The first increase of the fees shall not
580580 result in any fee greater than thirty dollars ($30.00). Any
581581 subsequent increase of the fees shall not be more than five
582582 percent of the existing fee. ]"
583583 SECTION 6. Section 74-1-16 NMSA 1978 (being Laws 2003,
584584 Chapter 335, Section 1, as amended) is amended to read:
585585 "74-1-16. WATER RECREATION FACILITIES--FEE IMPOSITION.--
586586 The board may assess an annual fee [not to exceed one hundred
587587 fifty dollars ($150)] on the owner or operator of a public
588588 swimming pool, public spa or other public water recreation
589589 facility to [defray] cover the cost of administering and
590590 enforcing rules adopted in accordance with the Environmental
591591 Improvement Act pertaining to public water recreation

623623 SECTION 7. Section 74-6B-9 NMSA 1978 (being Laws 1990,
624624 Chapter 124, Section 9, as amended) is amended to read:
625625 "74-6B-9. STORAGE TANK FEE--DEPOSIT IN STORAGE TANK
626626 FUND.--
627627 A. On July 1 of each year, there is due from and
628628 shall be paid by either the owner or the operator a fee [of one
629629 hundred dollars ($100) ] for each storage tank owned or
630630 operated.
631631 B. By rule, the board shall provide a schedule of
632632 fees sufficient to defray the reasonable and necessary costs
633633 of:
634634 (1) reviewing and acting upon applications for
635635 the registration of storage tanks;
636636 (2) reviewing and acting upon applications for
637637 the certification of tank installers and certification of tank
638638 testers; and
639639 (3) implementing and enforcing provisions of
640640 the Hazardous Waste Act applicable to storage tanks, tank
641641 installers and tank testers, including standards for the
642642 installation, operation and maintenance of storage tanks and
643643 the certification of tank installers and tank testers.
644644 C. The fees shall be paid to the department and

679679 "74-9-8. BOARD ADOPTION OF INITIAL [REGULATIONS ] RULES.--
680680 [No later than December 31, 1991 ] The board shall adopt
681681 [regulations] rules under the authority of this section to:
682682 A. implement, administer and enforce a program for
683683 the cost-effective and environmentally safe siting,
684684 construction, operation, maintenance, closure and post-closure
685685 care of solid waste facilities, including financial
686686 responsibility requirements for solid waste facility owners and
687687 operators and also including requirements that assure that the
688688 relative interests of the applicant, other owners of property
689689 likely to be affected and the general public will be considered
690690 prior to the issuance of a permit for a solid waste facility;
691691 B. define the solid wastes that are considered
692692 special wastes;
693693 C. establish specific requirements for the
694694 detoxification and disposal of special wastes;
695695 D. establish classifications of solid waste
696696 facilities and define what types of solid waste may be
697697 processed or disposed of in each classification;

728728 assure protection of ground water quality from degradation by
729729 contaminants from solid waste facilities consistent with the
730730 provisions of the Water Quality Act and the [regulations ] rules

732732 control commission, provided such [regulations ] rules shall not
733733 allow permitting of any active solid waste facility larger than
734734 five hundred acres;
735735 F. establish performance standards for
736736 transformation facilities that will assure protection of the
737737 state's environment;
738738 G. establish requirements and procedures for the
739739 granting or denial of an application to modify a solid waste
740740 facility permit under Section 74-9-25 NMSA 1978;
741741 H. establish requirements and procedures for

782782 person to obtain a variance from the application of a

784784 a written application for a variance with the director and
785785 demonstrates to the director's satisfaction that:
786786 (1) application of the [regulation ] rule would
787787 result in an arbitrary and unreasonable taking of the
788788 applicant's property or would impose an undue economic burden
789789 upon any lawful business, occupation or activity; and
790790 (2) granting the variance will not result in
791791 any condition injurious to human health, safety or welfare or
792792 the environment;
793793 K. assure that no variance will be granted under
794794 the provisions of Subsection J of this section until the
795795 director has considered the relative interests of the
796796 applicant, other owners of property likely to be affected and
797797 the general public and that any variance or renewal of a
798798 variance shall be granted for time periods and under conditions
799799 consistent with reasons for the [various ] variance but within
800800 the following limitations:
801801 (1) if the variance is granted on the grounds
802802 that there are no practicable means known or available for the
803803 adequate prevention of degradation of the environment or the

834834 degradation or risk become known and available; or
835835 (2) if the variance is granted on the grounds
836836 that it is justified to relieve or prevent hardship of a kind
837837 other than that provided for in Paragraph (1) of this
838838 subsection, it shall not be granted for more than one year;
839839 L. establish a list of solid wastes that shall not
840840 be transferred, disposed of or transformed in a solid waste
841841 facility and prohibit the disposal or transformation of those
842842 solid wastes in solid waste facilities;
843843 M. establish recordkeeping procedures for solid
844844 waste transfer, landfill disposal and transformation facilities
845845 that shall include requirements for recording the type, amount
846846 and origin of solid waste transferred, disposed of or
847847 transformed at the facility and that require operators of
848848 landfill disposal, solid waste transfer and transformation
849849 facilities within the state to:
850850 (1) maintain records in a form required by the
851851 division and file them with the division indicating the type,
852852 amount, origin and location in a landfill disposal facility of
853853 solid waste accepted by the facility;
854854 (2) maintain copies of the records required
855855 under Paragraph (1) of this subsection after closure in a
856856 manner and for the length of time prescribed by the division;

893893 "74-13-8. RULES--AUTHORITY AND CONTENT.--The board shall
894894 adopt rules to implement the provisions of the Recycling and
895895 Illegal Dumping Act. The rules shall be adopted pursuant to
896896 the provisions of the Environmental Improvement Act and shall
897897 include:
898898 A. requirements and procedures for the issuance of
899899 permits and registrations to tire recycling facilities, civil
900900 engineering applications, scrap tire generators and scrap tire
901901 haulers;
902902 B. standards and requirements for tire recycling
903903 and scrap tire storage and processing;
904904 C. record-keeping requirements for tire recycling
905905 facilities, scrap tire haulers and scrap tire generators;
906906 D. financial assurance criteria for tire recycling

946946 H. requirements and procedures for a scrap tire
947947 manifest system; and
948948 I. a fee schedule applicable to:
949949 (1) scrap tire haulers and tire recycling
950950 facilities not exceeding the estimated cost of investigating
951951 and issuing permits and registrations and conducting regulatory
952952 oversight of permitted and registered activities; [and
953953 J. a fee schedule applicable to ] (2) scrap
954954 tire generators not exceeding the estimated cost of conducting
955955 regulatory oversight of scrap tire generators; and
956956 (3) scrap tire haulers, tire recycling
957957 facilities and scrap tire generators ."
958958 SECTION 10. Section 76-19A-10.1 NMSA 1978 (being Laws
959959 2020, Chapter 69, Section 5) is amended to read:

10041004 (2) pet food manufactured by a person who
10051005 demonstrates to the board, in a manner prescribed by the board,
10061006 that the person's tax-year annual gross revenue from the
10071007 distribution of pet food is no more than three million dollars
10081008 ($3,000,000).
10091009 C. The fee collected pursuant to Subsection A of
10101010 this section shall be distributed as follows:
10111011 (1) ninety-six percent of the fee shall be
10121012 deposited with the state treasurer and credited to the
10131013 statewide spay and neuter subaccount of the animal care and
10141014 facility fund; and
10151015 (2) four percent of the fee shall be

10501050 A. The department of environment shall issue
10511051 permits pursuant to rules issued under Subsection C of this
10521052 section to extract, process or engage in other manufacturing
10531053 activities regarding hemp, including manufacturing intermediate
10541054 hemp-derived products and hemp finished products.
10551055 B. A person shall not extract, process or engage in
10561056 other manufacturing activities regarding hemp, including
10571057 manufacturing intermediate hemp-derived products and hemp
10581058 finished products without a permit issued by the department of
10591059 environment or a license issued pursuant to Subsection C of
10601060 Section 76-24-10 NMSA 1978.
10611061 C. The department of environment shall adopt rules
10621062 that include:
10631063 (1) procedures for the issuance, denial,
10641064 renewal, suspension and revocation of a permit issued by the
10651065 department of environment to manufacture hemp products,
10661066 including permit terms and procedures for appeal of a denial,
10671067 suspension or revocation that include notice and opportunity
10681068 for a hearing;

11051105 thousand dollars ($1,000) or the cost ] to cover the reasonable
11061106 costs necessary to carry out the of administration of a permit
11071107 issued pursuant to this section.
11081108 D. A hemp manufacturer that produces intermediate
11091109 hemp-derived products or hemp finished products intended for
11101110 human consumption by eating or drinking are subject to the
11111111 provisions of the Food Service Sanitation Act and the New
11121112 Mexico Food Act.
11131113 E. Hemp finished products produced by a hemp
11141114 manufacturer holding a permit issued pursuant to this section
11151115 shall not be deemed adulterated as that term is used in the
11161116 Food Service Sanitation Act and the New Mexico Food Act.
11171117 F. Fees collected pursuant to this section shall be
11181118 deposited in the environmental health fund.
11191119 G. A permit issued pursuant to this section does
11201120 not relieve the holder of the permit of the responsibility to
11211121 obtain other licenses or permits as required by law."
