9191 "[NEW MATERIAL] SHORT TITLE.--This act may be cited as the
9292 "Gas-Operated Semiautomatic Firearms Exclusion Act"."
9393 SECTION 2. A new section of Chapter 30, Article 7 NMSA
9494 1978 is enacted to read:
9595 "[NEW MATERIAL] DEFINITIONS.--As used in the Gas-Operated
9696 Semiautomatic Firearms Exclusion Act:
9797 A. "ammunition" means ammunition or cartridge
9898 cases, primers, bullets or propellent powder designed for use
9999 in a firearm;
100100 B. "cycle the action" means to extract the fired
101101 cartridge case, chamber the next cartridge and prepare the
102102 firing mechanism to fire again;
103103 C. "fixed magazine" means an ammunition feeding
104104 device contained in, or permanently attached to, a firearm in
105105 such a manner that the device cannot be removed without
106106 disassembly of the firearm action;
107107 D. "gas-operated" means a firearm that harnesses or
108108 traps a portion of the high-pressure gas from a fired cartridge
109109 to cycle the action using:
110110 (1) a long stroke piston, in which gas is
111111 vented from the barrel to a piston that is mechanically fixed
112112 to the bolt group and moves to cycle the action;
113113 (2) a short stroke piston, in which gas is
114114 vented from the barrel to a piston that moves separately from

144144 piston to cycle the action;
145145 (3) a system that traps and vents gas from
146146 either the barrel or the chamber to directly strike or impinge
147147 the bolt, bolt carrier or slide assembly to unlock and cycle
148148 the action;
149149 (4) a hybrid system that combines elements of
150150 a system described in Paragraph (3) of this subsection with a
151151 system described in Paragraph (1) or (2) of this subsection to
152152 capture gas vented from the barrel to cycle the action; or
153153 (5) a blowback-operated system that directly
154154 uses the expanding gases of the ignited propellant powder
155155 acting on the cartridge case to drive the breechblock or breech
156156 bolt rearward;
157157 E. "immediate family member" means a spouse, a
158158 parent, a child, a sibling, a grandparent, a grandchild, a
159159 great-grandchild, a niece, a nephew, a first cousin, an aunt or
160160 an uncle;
161161 F. "large-capacity ammunition feeding device":
162162 (1) means a magazine, belt, drum, feed strip,
163163 helical feeding device or similar device, including a device
164164 joined or coupled with another in any manner, that has an
165165 overall capacity of, or that can be readily restored, altered
166166 or converted to accept, more than ten rounds of ammunition; and
167167 (2) does not include a device designed to

198198 G. "machine gun" has the same meaning as set forth
199199 in Section 5845(b) of the National Firearms Act and includes a
200200 semiautomatic firearm that has been modified in a way that
201201 approximates the action or rate of fire of a machine gun;
202202 H. "rapid fire device" means a:
203203 (1) manual, power-driven or electronic device
204204 primarily designed or redesigned so that if the device is
205205 attached to a semiautomatic firearm, the device:
206206 (a) materially increases the rate of
207207 fire of the firearm; or
208208 (b) enables the semiautomatic firearm to
209209 approximate the action or rate of fire of a machine gun; or
210210 (2) device, part or combination of parts that
211211 is designed and functions to materially increase the rate of
212212 fire of a semiautomatic firearm by eliminating the need for the
213213 operator of the firearm to make a separate movement for each
214214 individual function of the trigger; and
215215 I. "semiautomatic firearm" means a firearm that:
216216 (1) upon initiating the firing sequence, fires
217217 the first chambered cartridge and uses a portion of the energy
218218 of the firing cartridge to:
219219 (a) extract the expended cartridge case;
220220 (b) chamber the next round; and

254254 SECTION 3. A new section of Chapter 30, Article 7 NMSA
255255 1978 is enacted to read:
256256 "[NEW MATERIAL] PROHIBITING THE IMPORTATION, SALE,
257257 MANUFACTURE, TRANSFER, RECEIPT OR POSSESSION OF GAS-OPERATED
258258 SEMIAUTOMATIC FIREARMS--PROVIDING EXCEPTIONS.--
259259 A. Beginning July 1, 2025, and except as provided
260260 in Subsection C or D of this section or Section 8 of the Gas-
261261 Operated Semiautomatic Firearms Exclusion Act, it is unlawful
262262 for a person to import, sell, manufacture, transfer or receive
263263 any of the following firearms, devices or combinations of
264264 parts:
265265 (1) a firearm that is included on the list of
266266 prohibited gas-operated semiautomatic firearms identified by
267267 the attorney general;
268268 (2) a modified non-prohibited firearm that, as
269269 modified, operates as a firearm included on the list of
270270 prohibited gas-operated semiautomatic firearms identified by
271271 the attorney general;
272272 (3) a combination of parts that is designed
273273 and functions to modify an otherwise non-prohibited firearm so

302302 that the firearm, as modified, operates as a gas-operated
303303 semiautomatic firearm included on the list of prohibited gas-
304304 operated semiautomatic firearms identified by the attorney
305305 general;
306306 (4) a combination of parts that is designed to
307307 be assembled into a firearm that operates as a firearm included
308308 on the list of prohibited gas-operated semiautomatic firearms
309309 identified by the attorney general; or
310310 (5) a combination of parts that functions to
311311 produce a gas-operated semiautomatic cycling action.
312312 B. Beginning January 1, 2026, and except as
313313 provided in Subsection C or D of this section, it is unlawful
314314 for a person to possess a firearm, device or combination of
315315 parts described in Paragraphs (1) through (5) of Subsection A
316316 of this section.
317317 C. Subsections A and B of this section do not
318318 apply:
319319 (1) to the importation or manufacture by or
320320 for, sale or transfer to or possession by or under the
321321 authority of the United States or any department or agency
322322 thereof or a state or an Indian nation, tribe or pueblo or a
323323 department, an agency or a political subdivision thereof;
324324 (2) to the importation or manufacture for,
325325 sale or transfer to or possession by, a licensee under Title 1
326326 of the federal Atomic Energy Act of 1954 for purposes of

356356 protection system and security organization required by federal
357357 law, or the transfer to, or possession by, a contractor of such
358358 a licensee on-site for such purposes or off-site for purposes
359359 of licensee-authorized training or transportation of nuclear
360360 materials;
361361 (3) to the possession of a gas-operated
362362 semiautomatic firearm that was lawfully:
363363 (a) manufactured prior to July 1, 2025;
364364 (b) transferred by the manufacturer to
365365 another party; and
366366 (c) certified by the owner, in
367367 accordance with Section 7 of the Gas-Operated Semiautomatic
368368 Firearms Exclusion Act, that the owner owned the firearm and
369369 certified it prior to January 1, 2026 or received the gas-
370370 operated semiautomatic firearm from an immediate family member
371371 who owned and certified the gas-operated semiautomatic firearm
372372 prior to January 1, 2026;
373373 (4) to the transfer and possession of a gas-
374374 operated semiautomatic firearm that is lawfully possessed
375375 before January 1, 2026 in accordance with Paragraph (3) of this
376376 subsection, in which:
377377 (a) the transferee is an immediate
378378 family member of the transferor; and
379379 (b) upon taking possession of the

408408 firearm, the person to whom the firearm was transferred
409409 certifies the firearm in accordance with Section 7 of the Gas-
410410 Operated Semiautomatic Firearms Exclusion Act; or
411411 (5) to the transfer of a gas-operated
412412 semiautomatic firearm certified in accordance with Section 7 of
413413 the Gas-Operated Semiautomatic Firearms Exclusion Act to a
414414 person residing in another state or maintaining it in another
415415 state or to a licensed firearms dealer.
416416 D. A gas-operated semiautomatic firearm that is
417417 lawfully certified in accordance with the process established
418418 by the attorney general pursuant to Section 7 of the Gas-
419419 Operated Semiautomatic Firearms Exclusion Act may only be
420420 possessed:
421421 (1) on private property owned or immediately
422422 controlled by the person;
423423 (2) on private property that is not open to
424424 the public with the express permission of the person who owns
425425 or immediately controls the property;
426426 (3) while on the premises of a licensed
427427 firearms dealer or gunsmith for the purpose of lawful transfer
428428 or repair of the gas-operated semiautomatic firearm;
429429 (4) while engaged in the legal use of the
430430 firearm at a properly licensed firing range or sport shooting
431431 competition venue; or
432432 (5) while traveling to or from the locations

462462 provided that the gas-operated semiautomatic firearm is
463463 unloaded and the gas-operated semiautomatic firearm is enclosed
464464 in a case, firearm carrying box, shipping box or other
465465 container.
466466 E. Licensed firearms dealers shall mark all gas-
467467 operated semiautomatic firearms imported or manufactured under
468468 Paragraphs (1) and (2) of Subsection C of this section after
469469 January 1, 2026 in the manner prescribed by the attorney
470470 general before a transfer under Paragraphs (1) and (2) of
471471 Subsection C of this section.
472472 F. For purposes of this section, "gas-operated
473473 semiautomatic firearm" does not include:
474474 (1) a firearm designed to accept, and capable
475475 of operating only with, .22 or less caliber rimfire ammunition;
476476 (2) a rifle that:
477477 (a) is a single-shot rifle;
478478 (b) is a breech loading rifle with a
479479 capacity not to exceed two rounds of ammunition;
480480 (c) is a muzzleloading rifle or
481481 smoothbore shoulder-fired firearm;
482482 (d) uses a bolt action, lever action or
483483 pump action to cycle the action of the rifle; or
484484 (e) has a fixed magazine with a capacity
485485 not to exceed ten rounds of ammunition;

525525 (4) a breech loading firearm capable of
526526 holding a single cartridge and a single shotgun shell
527527 simultaneously that must be reloaded after firing those rounds
528528 of ammunition; or
529529 (5) a handgun that:
530530 (a) is a single-shot handgun;
531531 (b) is a breech loading handgun with a
532532 capacity not to exceed two rounds of ammunition;
533533 (c) is a muzzleloading or smoothbore
534534 handgun;
535535 (d) uses a bolt action to cycle the
536536 action of the handgun;
537537 (e) is a single- or double-action

572572 SECTION 4. A new section of Chapter 30, Article 7 NMSA
573573 1978 is enacted to read:
574574 "[NEW MATERIAL] PROHIBITING LARGE-CAPACITY AMMUNITION
575575 FEEDING DEVICES.--
576576 A. Except as provided in Subsections B and C of
577577 this section and Section 8 of the Gas-Operated Semiautomatic
578578 Firearms Exclusion Act, on or after July 1, 2025, it is
579579 unlawful for a person to:
580580 (1) import, sell, manufacture, transfer or
581581 receive a large-capacity ammunition feeding device; or
582582 (2) possess a large-capacity ammunition
583583 feeding device manufactured after July 1, 2025.
584584 B. Subsection A of this section does not apply to
585585 the transfer of a large capacity ammunition feeding device to a
586586 person residing in another state or maintaining it in another
587587 state or to a licensed firearms dealer.
588588 C. Subsection A of this section does not apply to:
589589 (1) the importation or manufacture by or for,
590590 sale or transfer to or possession by or under the authority of
591591 the United States or any department or agency thereof or a

625625 and maintaining an on-site physical security protection system
626626 and security organization required by federal law or the
627627 transfer to or possession by a contractor of such a licensee
628628 on-site for such purposes or off-site for purposes of licensee-
629629 authorized training or transportation of nuclear materials.
630630 D. A person in possession of a large-capacity
631631 ammunition feeding device:
632632 (1) shall mark the large-capacity ammunition
633633 feeding device imported or manufactured under Subsection C of
634634 this section after January 1, 2026 in the manner prescribed by
635635 the attorney general before a transfer; and
636636 (2) shall not obliterate or otherwise alter
637637 the serial number on the large-capacity ammunition feeding
638638 device."
639639 SECTION 5. A new section of Chapter 30, Article 7 NMSA
640640 1978 is enacted to read:
641641 "[NEW MATERIAL] PROHIBITING MACHINE GUNS AND RAPID FIRE
642642 DEVICES.--
643643 A. Beginning July 1, 2025, and except as provided

675675 B. Subsection A of this section does not apply to:
676676 (1) the importation or manufacture by or for,
677677 sale or transfer to or possession by or under the authority of
678678 the United States or any department or agency thereof or a
679679 state or an Indian nation, tribe or pueblo or a department, an
680680 agency or a political subdivision thereof;
681681 (2) the importation or manufacture for, sale
682682 or transfer to or possession by a licensee under Title 1 of the
683683 federal Atomic Energy Act of 1954 for purposes of establishing
684684 and maintaining an on-site physical security protection system
685685 and security organization required by federal law, or the
686686 transfer to or possession by a contractor of such a licensee
687687 on-site for such purposes or off-site for purposes of licensee-
688688 authorized training or transportation of nuclear materials; and
689689 (3) machine guns and rapid fire devices
690690 lawfully registered with the United States bureau of alcohol,
691691 tobacco, firearms and explosives pursuant to the National
692692 Firearms Act.
693693 C. Whoever violates this section is guilty of a
694694 fourth degree felony."
695695 SECTION 6. A new section of Chapter 30, Article 7 NMSA
696696 1978 is enacted to read:
697697 "[NEW MATERIAL] LIST OF REGULATED WEAPONS.--

726726 A. No later than July 1, 2025, the attorney
727727 general, in consultation with the department of public safety,
728728 shall identify the list of gas-operated semiautomatic firearms
729729 subject to the Gas-Operated Semiautomatic Firearms Exclusion
730730 Act that shall be published and made available on the attorney
731731 general's website. The attorney general shall update the list
732732 as necessary.
733733 B. The department of public safety shall:
734734 (1) require that each licensed firearms dealer
735735 record purchaser acknowledgment of the list published under
736736 Subsection A of this section before any sale of a firearm that
737737 is not prohibited under that list;
738738 (2) before removing a gas-operated
739739 semiautomatic firearm from the list required under Subsection A
740740 of this section, submit to the attorney general clear and
741741 convincing evidence that the firearm should be removed from the
742742 list; and
743743 (3) advise the attorney general on carrying
744744 out the authority described in Subsection A of this section.
745745 C. The attorney general may request any additional
746746 information from the manufacturer necessary to make the
747747 determination under Subsection A of this section.
748748 D. No later than December 1, 2025, the attorney
749749 general, in consultation with the department of public safety,
750750 shall publish on the attorney general's website the manner in

781781 Operated Semiautomatic Firearms Exclusion Act and the manner in
782782 which gas-operated semiautomatic firearms shall be marked
783783 pursuant to Subsection E of Section 3 of that act."
784784 SECTION 7. A new section of Chapter 30, Article 7 NMSA
785785 1978 is enacted to read:
786786 "[NEW MATERIAL] CERTIFICATION OF SEMIAUTOMATIC FIREARMS.--
787787 A. No later than October 1, 2025, the attorney
788788 general, in consultation with the department of public safety,
789789 shall develop and make available a system for certifying gas-
790790 operated semiautomatic firearms. The system shall require
791791 owners of gas-operated semiautomatic firearms to:
792792 (1) complete a certification form; and
793793 (2) if prior to January 1, 2026, submit that
794794 form to a licensed firearm dealer located in the state of New
795795 Mexico or to the attorney general; or

799799 department of public safety, shall promulgate rules that govern
800800 the certification form and the submission process to both
801801 licensed firearm dealers and to the attorney general. The
802802 rules for submission of the certification form to a licensed

833833 form: one to be maintained in the normal course of business by
834834 the licensed firearm dealer in the same manner as acquisition
835835 and disposition records under 27 CFR Section 478.125; the other
836836 to be maintained by the owner of the gas-operated semiautomatic
837837 firearm;
838838 (2) the copies of the certification form shall
839839 be completed in part by a licensed firearm dealer who has
840840 personally observed the serial number on the gas-operated
841841 semiautomatic firearm and photo identification of the owner of
842842 the gas-operated semiautomatic firearm;
843843 (3) the owner of the gas-operated
844844 semiautomatic firearm shall have the owner's copy of the form
845845 notarized within two business days of the licensed firearm
846846 dealer completing its portion of the form and before January 1,
847847 2026;
848848 (4) the owner of the gas-operated
849849 semiautomatic firearm shall carry the owner's copy of the
850850 certification form on the owner's person at all times while
851851 possessing a gas-operated semiautomatic firearm outside private
852852 property owned or immediately controlled by the person. The
853853 owner of the gas-operated firearm shall show the form to any
854854 law enforcement officer upon an officer's request; and
855855 (5) licensed firearm dealers shall make
856856 certification forms available to law enforcement for inspection

886886 ceases to operate shall send all certification forms in the
887887 licensed firearm dealer's possession to the attorney general.
888888 C. The certification shall include:
889889 (1) an affirmation that the person possessed
890890 the semiautomatic firearm pursuant to Sections 3 and 8 of the
891891 Gas-Operated Semiautomatic Firearms Exclusion Act prior to
892892 January 1, 2026, received a timely certified firearm from an
893893 immediate family member or moved into the state in possession
894894 of the firearm within sixty days prior;
895895 (2) as applicable, the make, model, caliber
896896 and serial number of the firearm;
897897 (3) the person's name, address, telephone
898898 number and date of birth; and
899899 (4) as applicable, the name, address, phone
900900 number and unique identifying number of the licensed firearm
901901 dealer that prepared and is maintaining a copy of the
902902 certification form.
903903 D. Information contained in the certification shall
904904 be confidential, is exempt from disclosure pursuant to the
905905 Inspection of Public Records Act and shall not be disclosed,
906906 except to law enforcement agencies acting in the performance of
907907 the law enforcement agencies' duties.
908908 E. The certification form shall include the
909909 following statement printed in bold type: "Warning: Entering

944944 possess and transport the gas-operated semiautomatic firearm."
945945 SECTION 8. A new section of Chapter 30, Article 7 NMSA
946946 1978 is enacted to read:
947947 "[NEW MATERIAL] NONRESIDENTS.--
948948 A. A nonresident may transport, within twenty-four
949949 hours, a firearm, device or combination of parts described in
950950 Paragraphs (1) through (5) of Subsection A of Section 3 of the
951951 Gas-Operated Semiautomatic Firearms Exclusion Act or a large-
952952 capacity ammunition feeding device manufactured after July 1,
953953 2025 for a lawful purpose from a place where the nonresident
954954 may lawfully possess the gas-operated semiautomatic firearm,
955955 device or combination of parts to another place where the
956956 nonresident may lawfully possess the gas-operated semiautomatic
957957 firearm, device or combination of parts if, during the
958958 transportation, the gas-operated semiautomatic firearm, device
959959 or combination of parts is unloaded and is not readily
960960 accessible or directly accessible from the passenger
961961 compartment of the transporting vehicle. In the case of a
962962 vehicle without a compartment separate from the driver's

994994 B. A nonresident who moves into the state in
995995 possession of a firearm, device or combination of parts
996996 described in Paragraphs (1) through (5) of Subsection A of
997997 Section 3 of the Gas-Operated Semiautomatic Firearms Exclusion
998998 Act shall, within sixty days, complete and submit a
999999 certification in accordance with the process established by the
10001000 attorney general pursuant to Section 7 of that act. Once a
10011001 gas-operated semiautomatic firearm is certified under this
10021002 section, the lawful owner may use and transfer such firearms as
10031003 allowed under Subsections C and D of Section 3 of that act."
10041004 SECTION 9. A new section of Chapter 30, Article 7 NMSA

10061006 "[NEW MATERIAL] PENALTIES.--
10071007 A. Unless specified otherwise in the Gas-Operated
10081008 Semiautomatic Firearms Exclusion Act, whoever violates a
10091009 provision of that act is guilty of a misdemeanor.
10101010 B. Whoever commits or attempts to commit a felony
10111011 offense while in possession of a gas-operated semiautomatic
10121012 firearm or large-capacity ammunition feeding device in
10131013 violation of the Gas-Operated Semiautomatic Firearms Exclusion
10141014 Act is guilty of a fourth degree felony."
