91	91	"[NEW MATERIAL] SHORT TITLE.--This act may be cited as the
92	92	"Gas-Operated Semiautomatic Firearms Exclusion Act"."
93	93	SECTION 2. A new section of Chapter 30, Article 7 NMSA
94	94	1978 is enacted to read:
95	95	"[NEW MATERIAL] DEFINITIONS.--As used in the Gas-Operated
96	96	Semiautomatic Firearms Exclusion Act:
97	97	A. "ammunition" means ammunition or cartridge
98	98	cases, primers, bullets or propellent powder designed for use
99	99	in a firearm;
100	100	B. "cycle the action" means to extract the fired
101	101	cartridge case, chamber the next cartridge and prepare the
102	102	firing mechanism to fire again;
103	103	C. "fixed magazine" means an ammunition feeding
104	104	device contained in, or permanently attached to, a firearm in
105	105	such a manner that the device cannot be removed without
106	106	disassembly of the firearm action;
107	107	D. "gas-operated" means a firearm that harnesses or
108	108	traps a portion of the high-pressure gas from a fired cartridge
109	109	to cycle the action using:
110	110	(1) a long stroke piston, in which gas is
111	111	vented from the barrel to a piston that is mechanically fixed
112	112	to the bolt group and moves to cycle the action;
113	113	(2) a short stroke piston, in which gas is
114	114	vented from the barrel to a piston that moves separately from

145	145	(3) a system that traps and vents gas from
146	146	either the barrel or the chamber to directly strike or impinge
147	147	the bolt, bolt carrier or slide assembly to unlock and cycle
148	148	the action;
149	149	(4) a hybrid system that combines elements of
150	150	a system described in Paragraph (3) of this subsection with a
151	151	system described in Paragraph (1) or (2) of this subsection to
152	152	capture gas vented from the barrel to cycle the action; or
153	153	(5) a blowback-operated system that directly
154	154	uses the expanding gases of the ignited propellant powder
155	155	acting on the cartridge case to drive the breechblock or breech
156	156	bolt rearward;
157	157	E. "immediate family member" means a spouse, a
158	158	parent, a child, a sibling, a grandparent, a grandchild, a
159	159	great-grandchild, a niece, a nephew, a first cousin, an aunt or
160	160	an uncle;
161	161	F. "large-capacity ammunition feeding device":
162	162	(1) means a magazine, belt, drum, feed strip,
163	163	helical feeding device or similar device, including a device
164	164	joined or coupled with another in any manner, that has an
165	165	overall capacity of, or that can be readily restored, altered
166	166	or converted to accept, more than ten rounds of ammunition; and
167	167	(2) does not include a device designed to

199	199	in Section 5845(b) of the National Firearms Act and includes a
200	200	semiautomatic firearm that has been modified in a way that
201	201	approximates the action or rate of fire of a machine gun;
202	202	H. "rapid fire device" means a:
203	203	(1) manual, power-driven or electronic device
204	204	primarily designed or redesigned so that if the device is
205	205	attached to a semiautomatic firearm, the device:
206	206	(a) materially increases the rate of
207	207	fire of the firearm; or
208	208	(b) enables the semiautomatic firearm to
209	209	approximate the action or rate of fire of a machine gun; or
210	210	(2) device, part or combination of parts that
211	211	is designed and functions to materially increase the rate of
212	212	fire of a semiautomatic firearm by eliminating the need for the
213	213	operator of the firearm to make a separate movement for each
214	214	individual function of the trigger; and
215	215	I. "semiautomatic firearm" means a firearm that:
216	216	(1) upon initiating the firing sequence, fires
217	217	the first chambered cartridge and uses a portion of the energy
218	218	of the firing cartridge to:
219	219	(a) extract the expended cartridge case;
220	220	(b) chamber the next round; and

256	256	"[NEW MATERIAL] PROHIBITING THE IMPORTATION, SALE,
257	257	MANUFACTURE, TRANSFER, RECEIPT OR POSSESSION OF GAS-OPERATED
258	258	SEMIAUTOMATIC FIREARMS--PROVIDING EXCEPTIONS.--
259	259	A. Beginning July 1, 2025, and except as provided
260	260	in Subsection C or D of this section or Section 8 of the Gas-
261	261	Operated Semiautomatic Firearms Exclusion Act, it is unlawful
262	262	for a person to import, sell, manufacture, transfer or receive
263	263	any of the following firearms, devices or combinations of
264	264	parts:
265	265	(1) a firearm that is included on the list of
266	266	prohibited gas-operated semiautomatic firearms identified by
267	267	the attorney general;
268	268	(2) a modified non-prohibited firearm that, as
269	269	modified, operates as a firearm included on the list of
270	270	prohibited gas-operated semiautomatic firearms identified by
271	271	the attorney general;
272	272	(3) a combination of parts that is designed
273	273	and functions to modify an otherwise non-prohibited firearm so

303	303	semiautomatic firearm included on the list of prohibited gas-
304	304	operated semiautomatic firearms identified by the attorney
305	305	general;
306	306	(4) a combination of parts that is designed to
307	307	be assembled into a firearm that operates as a firearm included
308	308	on the list of prohibited gas-operated semiautomatic firearms
309	309	identified by the attorney general; or
310	310	(5) a combination of parts that functions to
311	311	produce a gas-operated semiautomatic cycling action.
312	312	B. Beginning January 1, 2026, and except as
313	313	provided in Subsection C or D of this section, it is unlawful
314	314	for a person to possess a firearm, device or combination of
315	315	parts described in Paragraphs (1) through (5) of Subsection A
316	316	of this section.
317	317	C. Subsections A and B of this section do not
318	318	apply:
319	319	(1) to the importation or manufacture by or
320	320	for, sale or transfer to or possession by or under the
321	321	authority of the United States or any department or agency
322	322	thereof or a state or an Indian nation, tribe or pueblo or a
323	323	department, an agency or a political subdivision thereof;
324	324	(2) to the importation or manufacture for,
325	325	sale or transfer to or possession by, a licensee under Title 1
326	326	of the federal Atomic Energy Act of 1954 for purposes of

362	362	semiautomatic firearm that was lawfully:
363	363	(a) manufactured prior to July 1, 2025;
364	364	(b) transferred by the manufacturer to
365	365	another party; and
366	366	(c) certified by the owner, in
367	367	accordance with Section 7 of the Gas-Operated Semiautomatic
368	368	Firearms Exclusion Act, that the owner owned the firearm and
369	369	certified it prior to January 1, 2026 or received the gas-
370	370	operated semiautomatic firearm from an immediate family member
371	371	who owned and certified the gas-operated semiautomatic firearm
372	372	prior to January 1, 2026;
373	373	(4) to the transfer and possession of a gas-
374	374	operated semiautomatic firearm that is lawfully possessed
375	375	before January 1, 2026 in accordance with Paragraph (3) of this
376	376	subsection, in which:
377	377	(a) the transferee is an immediate
378	378	family member of the transferor; and
379	379	(b) upon taking possession of the

410	410	Operated Semiautomatic Firearms Exclusion Act; or
411	411	(5) to the transfer of a gas-operated
412	412	semiautomatic firearm certified in accordance with Section 7 of
413	413	the Gas-Operated Semiautomatic Firearms Exclusion Act to a
414	414	person residing in another state or maintaining it in another
415	415	state or to a licensed firearms dealer.
416	416	D. A gas-operated semiautomatic firearm that is
417	417	lawfully certified in accordance with the process established
418	418	by the attorney general pursuant to Section 7 of the Gas-
419	419	Operated Semiautomatic Firearms Exclusion Act may only be
420	420	possessed:
421	421	(1) on private property owned or immediately
422	422	controlled by the person;
423	423	(2) on private property that is not open to
424	424	the public with the express permission of the person who owns
425	425	or immediately controls the property;
426	426	(3) while on the premises of a licensed
427	427	firearms dealer or gunsmith for the purpose of lawful transfer
428	428	or repair of the gas-operated semiautomatic firearm;
429	429	(4) while engaged in the legal use of the
430	430	firearm at a properly licensed firing range or sport shooting
431	431	competition venue; or
432	432	(5) while traveling to or from the locations

466	466	E. Licensed firearms dealers shall mark all gas-
467	467	operated semiautomatic firearms imported or manufactured under
468	468	Paragraphs (1) and (2) of Subsection C of this section after
469	469	January 1, 2026 in the manner prescribed by the attorney
470	470	general before a transfer under Paragraphs (1) and (2) of
471	471	Subsection C of this section.
472	472	F. For purposes of this section, "gas-operated
473	473	semiautomatic firearm" does not include:
474	474	(1) a firearm designed to accept, and capable
475	475	of operating only with, .22 or less caliber rimfire ammunition;
476	476	(2) a rifle that:
477	477	(a) is a single-shot rifle;
478	478	(b) is a breech loading rifle with a
479	479	capacity not to exceed two rounds of ammunition;
480	480	(c) is a muzzleloading rifle or
481	481	smoothbore shoulder-fired firearm;
482	482	(d) uses a bolt action, lever action or
483	483	pump action to cycle the action of the rifle; or
484	484	(e) has a fixed magazine with a capacity
485	485	not to exceed ten rounds of ammunition;

532	532	capacity not to exceed two rounds of ammunition;
533	533	(c) is a muzzleloading or smoothbore
534	534	handgun;
535	535	(d) uses a bolt action to cycle the
536	536	action of the handgun;
537	537	(e) is a single- or double-action

574	574	"[NEW MATERIAL] PROHIBITING LARGE-CAPACITY AMMUNITION
575	575	FEEDING DEVICES.--
576	576	A. Except as provided in Subsections B and C of
577	577	this section and Section 8 of the Gas-Operated Semiautomatic
578	578	Firearms Exclusion Act, on or after July 1, 2025, it is
579	579	unlawful for a person to:
580	580	(1) import, sell, manufacture, transfer or
581	581	receive a large-capacity ammunition feeding device; or
582	582	(2) possess a large-capacity ammunition
583	583	feeding device manufactured after July 1, 2025.
584	584	B. Subsection A of this section does not apply to
585	585	the transfer of a large capacity ammunition feeding device to a
586	586	person residing in another state or maintaining it in another
587	587	state or to a licensed firearms dealer.
588	588	C. Subsection A of this section does not apply to:
589	589	(1) the importation or manufacture by or for,
590	590	sale or transfer to or possession by or under the authority of
591	591	the United States or any department or agency thereof or a

629	629	authorized training or transportation of nuclear materials.
630	630	D. A person in possession of a large-capacity
631	631	ammunition feeding device:
632	632	(1) shall mark the large-capacity ammunition
633	633	feeding device imported or manufactured under Subsection C of
634	634	this section after January 1, 2026 in the manner prescribed by
635	635	the attorney general before a transfer; and
636	636	(2) shall not obliterate or otherwise alter
637	637	the serial number on the large-capacity ammunition feeding
638	638	device."
639	639	SECTION 5. A new section of Chapter 30, Article 7 NMSA
640	640	1978 is enacted to read:
641	641	"[NEW MATERIAL] PROHIBITING MACHINE GUNS AND RAPID FIRE
642	642	DEVICES.--
643	643	A. Beginning July 1, 2025, and except as provided
644	644	in Subsection B of this section, it is unlawful for a person to

690	690	lawfully registered with the United States bureau of alcohol,
691	691	tobacco, firearms and explosives pursuant to the National
692	692	Firearms Act.
693	693	C. Whoever violates this section is guilty of a
694	694	fourth degree felony."
695	695	SECTION 6. A new section of Chapter 30, Article 7 NMSA
696	696	1978 is enacted to read:
697	697	"[NEW MATERIAL] LIST OF REGULATED WEAPONS.--

733	733	B. The department of public safety shall:
734	734	(1) require that each licensed firearms dealer
735	735	record purchaser acknowledgment of the list published under
736	736	Subsection A of this section before any sale of a firearm that
737	737	is not prohibited under that list;
738	738	(2) before removing a gas-operated
739	739	semiautomatic firearm from the list required under Subsection A
740	740	of this section, submit to the attorney general clear and

745	745	C. The attorney general may request any additional
746	746	information from the manufacturer necessary to make the
747	747	determination under Subsection A of this section.
748	748	D. No later than December 1, 2025, the attorney
749	749	general, in consultation with the department of public safety,
750	750	shall publish on the attorney general's website the manner in

784	784	SECTION 7. A new section of Chapter 30, Article 7 NMSA
785	785	1978 is enacted to read:
786	786	"[NEW MATERIAL] CERTIFICATION OF SEMIAUTOMATIC FIREARMS.--
787	787	A. No later than October 1, 2025, the attorney
788	788	general, in consultation with the department of public safety,
789	789	shall develop and make available a system for certifying gas-
790	790	operated semiautomatic firearms. The system shall require
791	791	owners of gas-operated semiautomatic firearms to:
792	792	(1) complete a certification form; and
793	793	(2) if prior to January 1, 2026, submit that
794	794	form to a licensed firearm dealer located in the state of New
795	795	Mexico or to the attorney general; or
796	796	(3) if after January 1, 2026, submit that form
797	797	to the attorney general.
798	798	B. The attorney general, in consultation with the
799	799	department of public safety, shall promulgate rules that govern
800	800	the certification form and the submission process to both
801	801	licensed firearm dealers and to the attorney general. The
802	802	rules for submission of the certification form to a licensed
803	803	firearm dealer shall include that:

838	838	(2) the copies of the certification form shall
839	839	be completed in part by a licensed firearm dealer who has
840	840	personally observed the serial number on the gas-operated
841	841	semiautomatic firearm and photo identification of the owner of
842	842	the gas-operated semiautomatic firearm;
843	843	(3) the owner of the gas-operated
844	844	semiautomatic firearm shall have the owner's copy of the form
845	845	notarized within two business days of the licensed firearm
846	846	dealer completing its portion of the form and before January 1,
847	847	2026;
848	848	(4) the owner of the gas-operated
849	849	semiautomatic firearm shall carry the owner's copy of the
850	850	certification form on the owner's person at all times while
851	851	possessing a gas-operated semiautomatic firearm outside private
852	852	property owned or immediately controlled by the person. The
853	853	owner of the gas-operated firearm shall show the form to any
854	854	law enforcement officer upon an officer's request; and
855	855	(5) licensed firearm dealers shall make
856	856	certification forms available to law enforcement for inspection

886	886	ceases to operate shall send all certification forms in the
887	887	licensed firearm dealer's possession to the attorney general.
888	888	C. The certification shall include:
889	889	(1) an affirmation that the person possessed
890	890	the semiautomatic firearm pursuant to Sections 3 and 8 of the
891	891	Gas-Operated Semiautomatic Firearms Exclusion Act prior to
892	892	January 1, 2026, received a timely certified firearm from an
893	893	immediate family member or moved into the state in possession
894	894	of the firearm within sixty days prior;
895	895	(2) as applicable, the make, model, caliber
896	896	and serial number of the firearm;
897	897	(3) the person's name, address, telephone
898	898	number and date of birth; and
899	899	(4) as applicable, the name, address, phone
900	900	number and unique identifying number of the licensed firearm
901	901	dealer that prepared and is maintaining a copy of the
902	902	certification form.
903	903	D. Information contained in the certification shall
904	904	be confidential, is exempt from disclosure pursuant to the
905	905	Inspection of Public Records Act and shall not be disclosed,
906	906	except to law enforcement agencies acting in the performance of
907	907	the law enforcement agencies' duties.
908	908	E. The certification form shall include the
909	909	following statement printed in bold type: "Warning: Entering

945	945	SECTION 8. A new section of Chapter 30, Article 7 NMSA
946	946	1978 is enacted to read:
947	947	"[NEW MATERIAL] NONRESIDENTS.--
948	948	A. A nonresident may transport, within twenty-four
949	949	hours, a firearm, device or combination of parts described in
950	950	Paragraphs (1) through (5) of Subsection A of Section 3 of the
951	951	Gas-Operated Semiautomatic Firearms Exclusion Act or a large-
952	952	capacity ammunition feeding device manufactured after July 1,
953	953	2025 for a lawful purpose from a place where the nonresident
954	954	may lawfully possess the gas-operated semiautomatic firearm,
955	955	device or combination of parts to another place where the
956	956	nonresident may lawfully possess the gas-operated semiautomatic
957	957	firearm, device or combination of parts if, during the
958	958	transportation, the gas-operated semiautomatic firearm, device
959	959	or combination of parts is unloaded and is not readily
960	960	accessible or directly accessible from the passenger
961	961	compartment of the transporting vehicle. In the case of a

993	993	other than the glove compartment or console.
994	994	B. A nonresident who moves into the state in
995	995	possession of a firearm, device or combination of parts
996	996	described in Paragraphs (1) through (5) of Subsection A of
997	997	Section 3 of the Gas-Operated Semiautomatic Firearms Exclusion
998	998	Act shall, within sixty days, complete and submit a
999	999	certification in accordance with the process established by the
1000	1000	attorney general pursuant to Section 7 of that act. Once a
1001	1001	gas-operated semiautomatic firearm is certified under this
1002	1002	section, the lawful owner may use and transfer such firearms as
1003	1003	allowed under Subsections C and D of Section 3 of that act."
1004	1004	SECTION 9. A new section of Chapter 30, Article 7 NMSA
1005	1005	1978 is enacted to read:
1006	1006	"[NEW MATERIAL] PENALTIES.--
1007	1007	A. Unless specified otherwise in the Gas-Operated
1008	1008	Semiautomatic Firearms Exclusion Act, whoever violates a
1009	1009	provision of that act is guilty of a misdemeanor.
1010	1010	B. Whoever commits or attempts to commit a felony
1011	1011	offense while in possession of a gas-operated semiautomatic
1012	1012	firearm or large-capacity ammunition feeding device in
1013	1013	violation of the Gas-Operated Semiautomatic Firearms Exclusion
1014	1014	Act is guilty of a fourth degree felony."
