35	35	PROVIDING THAT PRETRIAL CONDITIONS OF RELEASE ARE PUBLIC
36	36	RECORDS WITH EXCEPTIONS; PROVIDING ACCESS TO GLOBAL POSITIONING
37	37	SYSTEM DATA ON DEFENDANTS ON PRETRIAL RELEASE TO LAW
38	38	ENFORCEMENT OFFICERS UPON REQUEST.
39	39	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
40	40	SECTION 1. A new section of Chapter 31 NMSA 1978 is
41	41	enacted to read:
42	42	"[NEW MATERIAL] VIOLATION OF PRETRIAL CONDITIONS OF
43	43	RELEASE--PUBLIC RECORDS--EXCEPTIONS.--Pretrial release and
44	44	supervision records that show or support a violation of
45	45	conditions of release are public records; provided that the
46	46	records do not contain precise geographical coordinates,

75	75	information or that the information be redacted."
76	76	SECTION 2. Section 31-3-12 NMSA 1978 (being Laws 2022,
77	77	Chapter 56, Section 28) is amended to read:
78	78	"31-3-12. AVAILABILITY OF GLOBAL POSITIONING SYSTEM DATA
79	79	ON DEFENDANTS ON PRETRIAL RELEASE.--Any public entity that
80	80	possesses or controls global positioning system data with
81	81	respect to a defendant on pretrial release shall make that data
82	82	available without a warrant to a law enforcement officer
83	83	pursuant to an ongoing and pending criminal investigation [for
84	84	which there is reasonable suspicion to believe the data will be
85	85	probative] upon request. Any data provided to the law
86	86	enforcement officer shall be limited to data that relates to
87	87	the criminal investigation [and is not more than one year old.
88	88	The data shall not be made a part of any public record unless
89	89	admitted as evidence during a criminal trial ]. The law
90	90	enforcement officer may request immediate access to the data if
91	91	it involves an investigation of:
92	92	A. any of the following serious violent felony
93	93	offenses:
94	94	(1) murder in the first degree;
95	95	(2) first or second degree felony human
96	96	trafficking of a child;
97	97	(3) first degree felony abuse of a child;
98	98	(4) sexual exploitation of a child

128	128	(5) a serious violent felony offense as
129	129	provided in Subparagraphs (a) through (n) of Paragraph (4) of
130	130	Subsection L of Section 33-2-34 NMSA 1978;
131	131	B. a felony offense during which a firearm was
132	132	brandished pursuant to Section 31-18-16 NMSA 1978 or during
133	133	which a firearm was discharged; or
134	134	C. a felony offense during which great bodily
135	135	harm was inflicted as defined in Section 30-1-12 NMSA 1978 or
136	136	that caused the death of a person."
137	137	SECTION 3. A new section of the Victims of Crime Act is
138	138	enacted to read:
139	139	"[NEW MATERIAL] NOTIFICATION FOR VIOLATION OF PRETRIAL
140	140	CONDITIONS OF RELEASE.--If a person on pretrial release for a
141	141	criminal offense violates a condition of release established by
142	142	the court, the pretrial services officer or other individual in
143	143	charge of supervising the conditions of release shall
144	144	immediately notify the court, the prosecuting authority, the
145	145	defendant's counsel and the victim."
