37	37	FOR WATER PROJECTS; MAKING APPROPRIATIONS TO THE BOARD OF
38	38	REGENTS OF THE NEW MEXICO INSTITUTE OF MINING AND TECHNOLOGY
39	39	AND THE BOARD OF REGENTS OF NEW MEXICO STATE UNIVERSITY FOR THE
40	40	DEVELOPMENT OF TECHNOLOGY FOR PROJECTS RELATED TO BRACKISH
41	41	WATER USE.
42	42	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
43	43	SECTION 1. TEMPORARY PROVISION--PROJECT RULES.--The
44	44	department of environment shall by December 31, 2026 promulgate
45	45	rules for the use of naturally occurring brackish water for the
46	46	water projects specified in Section 2 of this act. As used in

74	74	this section, "brackish water" means water that is sourced from
75	75	an aquifer, the top of which is at a depth of two thousand five
76	76	hundred feet or more below the surface of the ground, contains
77	77	not less than one thousand parts per million of dissolved
78	78	solids and is not produced water.
79	79	SECTION 2. APPROPRIATION.--Fifty million dollars
80	80	($50,000,000) is appropriated from the general fund to the
81	81	office of the state engineer for expenditure in fiscal years
82	82	2026 through 2030 for planning, design, administration and
83	83	matching federal, private and public water utility funds for
84	84	brackish water use exploration, treatment and aquifer
85	85	characterization water projects to benefit the lower Rio
86	86	Grande, middle Rio Grande, Permian basin and northwest quadrant
87	87	of the state. Any unexpended or unencumbered balance remaining
88	88	at the end of fiscal year 2030 shall revert to the general
89	89	fund.
90	90	SECTION 3. APPROPRIATION.--Sixteen million dollars
91	91	($16,000,000) is appropriated from the general fund to the
92	92	board of regents of the New Mexico institute of mining and
93	93	technology for expenditure in fiscal years 2026 through 2030
94	94	for innovation, research, monitoring, support and development
95	95	of technology associated with water projects pursuant to
96	96	Section 2 of this act and for aquifer monitoring and improved
97	97	ground water characterization. Any unexpended or unencumbered
98	98	balance remaining at the end of fiscal year 2030 shall revert

128	128	SECTION 4. APPROPRIATION.--Four million dollars
129	129	($4,000,000) is appropriated from the general fund to the board
130	130	of regents of New Mexico state university for expenditure in
131	131	fiscal years 2026 through 2030 for the innovation, research,
132	132	monitoring, support and development of technology associated
133	133	with water projects pursuant to Section 2 of this act. Any
134	134	unexpended or unencumbered balance remaining at the end of
135	135	fiscal year 2030 shall revert to the general fund.
