4242 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4343 SECTION 1. TEMPORARY PROVISION--PROJECT RULES.--The
4444 department of environment shall by December 31, 2026 promulgate
4545 rules for the use of naturally occurring brackish water for the
4646 water projects specified in Section 2 of this act. As used in

7474 this section, "brackish water" means water that is sourced from
7575 an aquifer, the top of which is at a depth of two thousand five
7676 hundred feet or more below the surface of the ground, contains
7777 not less than one thousand parts per million of dissolved
7878 solids and is not produced water.
7979 SECTION 2. APPROPRIATION.--Fifty million dollars
8080 ($50,000,000) is appropriated from the general fund to the
8181 office of the state engineer for expenditure in fiscal years
8282 2026 through 2030 for planning, design, administration and
8383 matching federal, private and public water utility funds for
8484 brackish water use exploration, treatment and aquifer
8585 characterization water projects to benefit the lower Rio
8686 Grande, middle Rio Grande, Permian basin and northwest quadrant
8787 of the state. Any unexpended or unencumbered balance remaining
8888 at the end of fiscal year 2030 shall revert to the general
8989 fund.
9090 SECTION 3. APPROPRIATION.--Sixteen million dollars
9191 ($16,000,000) is appropriated from the general fund to the
9292 board of regents of the New Mexico institute of mining and
9393 technology for expenditure in fiscal years 2026 through 2030
9494 for innovation, research, monitoring, support and development
9595 of technology associated with water projects pursuant to
9696 Section 2 of this act and for aquifer monitoring and improved
9797 ground water characterization. Any unexpended or unencumbered
9898 balance remaining at the end of fiscal year 2030 shall revert

128128 SECTION 4. APPROPRIATION.--Four million dollars
129129 ($4,000,000) is appropriated from the general fund to the board
130130 of regents of New Mexico state university for expenditure in
131131 fiscal years 2026 through 2030 for the innovation, research,
132132 monitoring, support and development of technology associated
133133 with water projects pursuant to Section 2 of this act. Any
134134 unexpended or unencumbered balance remaining at the end of
135135 fiscal year 2030 shall revert to the general fund.
