4949 RELATING TO CHILDREN; REQUIRING THE CHILDREN, YOUTH AND
5050 FAMILIES DEPARTMENT TO ISSUE A REQUEST FOR PROPOSALS AND
5151 CONTRACT WITH AN INDEPENDENT EXPERT TO ASSESS THE DEPARTMENT'S
5252 PROGRAMMATIC PERFORMANCE.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. [NEW MATERIAL] PROGRAM PERFORMANCE AUDIT--
5555 REQUIREMENTS.--
5656 A. The children, youth and families department
5757 shall issue a request for competitive sealed proposals for an
5858 independent, multiyear performance audit of the department's
5959 programs. The request for proposals shall specify the:
6060 (1) qualifications of the performance auditor;
6161 (2) goals and objectives of the procurement;
6262 (3) scope of work, which shall:

9090 (a) consider the department's capacity
9191 and ability to function effectively, efficiently, economically,
9292 ethically and equitably;
9393 (b) include performance audit
9494 objectives;
9595 (c) require an evaluation of the
9696 efficacy of the department's mission and the established goals
9797 and objectives to carry out that mission and how well
9898 department policies and practices relate to department mission
9999 goals and objectives;
100100 (d) require a review of the
101101 applicability and sufficiency of the department's policies and
102102 practices as they relate to the department's mission;
103103 (e) evaluate the commitment of
104104 department management and staff to follow policies and
105105 procedures;
106106 (f) evaluate the strengths and
107107 weaknesses of department processes, procedures and policies;
108108 (g) evaluate the department's management
109109 of human resources, including a review of the accuracy of job
110110 descriptions and the qualifications of job holders to perform
111111 the described jobs;
112112 (h) evaluate the department's collection
113113 and analysis of data and the use of data to inform the
114114 development of policies and practices;

143143 (i) include the required provision of
144144 three annual performance audits with three annual six-month
145145 reviews of earlier identified problem areas, a review of the
146146 department's implementation of recommendations made by the
147147 auditor and other requirements specified by the department; and
148148 (j) include the requirement for annual
149149 and semiannual reports to the department;
150150 (4) evaluation factors the department will use
151151 to score proposals; and
152152 (5) other provisions required by the
153153 Procurement Code for professional services and competitive
154154 sealed proposals.
155155 B. Records of proposals submitted pursuant to
156156 Subsection A of this section shall remain confidential until
157157 the contract is awarded.
158158 C. If the performance audit at any stage indicates
159159 the need for a special financial audit, the performance auditor
160160 shall notify the secretary of children, youth and families, and
161161 the secretary shall cooperate with the state auditor in the
162162 conduct of the special financial audit.
163163 D. The children, youth and families department
164164 shall transmit annual performance audit and interim review
165165 reports to the governor, the legislative finance committee and
166166 the legislative health and human services committee within
167167 fifteen days of the performance auditor's submission to the
