4949 RELATING TO HEALTH CARE; REQUIRING THE MEDICAID REIMBURSEMENT
5050 RATE FOR OBSTETRICS OR GYNECOLOGY HEALTH CARE SERVICES TO
5151 INCREASE BY TWO HUNDRED FIFTY PERCENT; MAKING AN APPROPRIATION.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Public Assistance Act is
5454 enacted to read:
5555 "[NEW MATERIAL] REIMBURSEMENT FOR OBSTETRICS OR GYNECOLOGY
5656 SERVICES.--
5757 A. The medicaid reimbursement rate for all
5858 obstetrics or gynecology health care services that are covered
5959 by the New Mexico medicaid program shall be at least two
6060 hundred fifty percent of the medicare reimbursement rate for
6161 the equivalent service.
6262 B. Using the medicaid reimbursement rate for each

9090 obstetrics or gynecology health care service as of July 1, 2024
9191 as a baseline for comparison:
9292 (1) obstetrics or gynecology health care
9393 services covered by medicaid, but not covered by medicare,
9494 shall receive an increase in the medicaid reimbursement rate
9595 proportional to the average percentage increase in
9696 reimbursement that obstetrics or gynecology health care
9797 services receive pursuant to Subsection A of this section; and
9898 (2) all health care entities that receive
9999 increases in medicaid reimbursement pursuant to this section
100100 shall ensure that at least seventy-five percent of the increase
101101 in reimbursement revenue is used to:
102102 (a) provide increased compensation to
103103 health care workers and other employees who interact directly
104104 with patients; or
105105 (b) hire additional health care workers
106106 and other employees who interact directly with patients.
107107 C. For the purposes of this section:
108108 (1) "medicaid" means the federal-state program
109109 administered by the authority pursuant to Title 19 or Title 21
110110 of the federal Social Security Act; and
111111 (2) "medicare" means coverage provided
112112 pursuant to part A or part B of Title 18 of the federal Social
113113 Security Act, as amended."
114114 SECTION 2. APPROPRIATION.--Twelve million dollars

143143 ($12,000,000) is appropriated from the general fund to the
144144 health care authority for expenditure in fiscal year 2026 to
145145 provide increased medicaid reimbursement for obstetrics or
146146 gynecology health care services. Any unexpended or
147147 unencumbered balance remaining at the end of fiscal year 2026
148148 shall revert to the general fund.
