49	49	RELATING TO HEALTH CARE; REQUIRING THE MEDICAID REIMBURSEMENT
50	50	RATE FOR OBSTETRICS OR GYNECOLOGY HEALTH CARE SERVICES TO
51	51	INCREASE BY TWO HUNDRED FIFTY PERCENT; MAKING AN APPROPRIATION.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Public Assistance Act is
54	54	enacted to read:
55	55	"[NEW MATERIAL] REIMBURSEMENT FOR OBSTETRICS OR GYNECOLOGY
56	56	SERVICES.--
57	57	A. The medicaid reimbursement rate for all
58	58	obstetrics or gynecology health care services that are covered
59	59	by the New Mexico medicaid program shall be at least two
60	60	hundred fifty percent of the medicare reimbursement rate for
61	61	the equivalent service.
62	62	B. Using the medicaid reimbursement rate for each

90	90	obstetrics or gynecology health care service as of July 1, 2024
91	91	as a baseline for comparison:
92	92	(1) obstetrics or gynecology health care
93	93	services covered by medicaid, but not covered by medicare,
94	94	shall receive an increase in the medicaid reimbursement rate
95	95	proportional to the average percentage increase in
96	96	reimbursement that obstetrics or gynecology health care
97	97	services receive pursuant to Subsection A of this section; and
98	98	(2) all health care entities that receive
99	99	increases in medicaid reimbursement pursuant to this section
100	100	shall ensure that at least seventy-five percent of the increase
101	101	in reimbursement revenue is used to:
102	102	(a) provide increased compensation to
103	103	health care workers and other employees who interact directly
104	104	with patients; or
105	105	(b) hire additional health care workers
106	106	and other employees who interact directly with patients.
107	107	C. For the purposes of this section:
108	108	(1) "medicaid" means the federal-state program
109	109	administered by the authority pursuant to Title 19 or Title 21
110	110	of the federal Social Security Act; and
111	111	(2) "medicare" means coverage provided
112	112	pursuant to part A or part B of Title 18 of the federal Social
113	113	Security Act, as amended."
114	114	SECTION 2. APPROPRIATION.--Twelve million dollars

143	143	($12,000,000) is appropriated from the general fund to the
144	144	health care authority for expenditure in fiscal year 2026 to
145	145	provide increased medicaid reimbursement for obstetrics or
146	146	gynecology health care services. Any unexpended or
147	147	unencumbered balance remaining at the end of fiscal year 2026
148	148	shall revert to the general fund.
