4848 AN ACT
4949 RELATING TO HEALTH CARE; INCREASING THE SAFETY REQUIREMENTS FOR
5050 REPRODUCTIVE HEALTH CARE.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. A new section of the Public Health Act is
5353 enacted to read:
5454 "[NEW MATERIAL] REPRODUCTIVE HEALTH CARE SAFETY
5555 REQUIREMENTS.--
5656 A. Except for a medication abortion, an abortion
5757 shall only be provided by a licensed physician in a health
5858 facility licensed by the health care authority.
5959 B. A drug used to induce a medication abortion
6060 shall only be prescribed by a licensed physician and dispensed
6161 by a pharmacy licensed pursuant to the Pharmacy Act.

9090 violated the provisions of this section shall be subject to a
9191 civil penalty not to exceed five thousand dollars ($5,000).
9292 D. For the purposes of this section, "medication
9393 abortion" means the use or prescription of any drug for the
9494 purpose of inducing an abortion."
9595 SECTION 2. Section 24-34-3 NMSA 1978 (being Laws 2023,
9696 Chapter 11, Section 3) is amended to read:
9797 "24-34-3. PUBLIC BODY PROHIBITED ACTION.--
9898 A. A public body or an entity or individual acting
9999 on behalf of or within the scope of the authority of a public
100100 body shall not discriminate against a person based on that
101101 person's use of or refusal to use reproductive health care or
102102 gender-affirming health care services.
103103 B. A public body or an entity or individual acting
104104 on behalf of or within the scope of the authority of a public
105105 body shall not deny, restrict or interfere with a person's
106106 ability to access or provide reproductive health care or
107107 gender-affirming health care within the medical standard of
108108 care. For the purposes of this subsection, an abortion is only
109109 within the medical standard of care if the abortion is provided
110110 by a licensed physician in a health facility licensed by the
111111 health care authority.
112112 C. A public body or an entity or individual acting
113113 on behalf of or within the scope of the authority of a public
114114 body shall not deprive, through prosecution, punishment or

143143 other means, a person's ability to act or refrain from acting
144144 during the person's pregnancy based on the potential, actual or
145145 perceived effect on the pregnancy.
146146 D. A public body or an entity or individual acting
147147 on behalf of or within the scope of the authority of a public
148148 body shall not impose or continue in effect any law, ordinance,
149149 policy or regulation that violates or conflicts with the
150150 provisions of the Reproductive and Gender-Affirming Health Care
151151 Freedom Act.
152152 E. Nothing in the Reproductive and Gender-Affirming
153153 Health Care Freedom Act shall be construed to require a health
154154 care provider or entity to provide care:
155155 (1) that the health care provider or entity
156156 does not otherwise provide or have a duty to provide under
157157 state or federal law;
158158 (2) when the provision of service is against
159159 the medical judgment of the treating health care provider while
160160 acting within the standard of care; or
161161 (3) when an individual does not provide
162162 payment or a source of payment for the service when it is
163163 required in the ordinary course of business, unless the health
164164 care provider has a duty to provide services under state or
165165 federal law, regardless of the ability to pay.
166166 F. Nothing in the Reproductive and Gender-Affirming
167167 Health Care Freedom Act shall be construed to require a managed
