204204 SECTION 5. A new section of the Public School Code is
205205 enacted to read:
206206 "[NEW MATERIAL] DUTIES OF THE OFFICE.--The office shall:
207207 A. oversee and enforce state and school district
208208 compliance with federal and state law regarding special
209209 education and the rights of students with disabilities,
210210 including the federal Individuals with Disabilities Education
211211 Improvement Act of 2004, by:
212212 (1) soliciting input from special education
213213 students, parents, educational decision makers, regional
214214 education cooperatives, advocates, licensed school employees
215215 and other special education providers;
216216 (2) reviewing publicly available information
217217 and resources regarding special education services and
218218 programs;
219219 (3) monitoring academic and nonacademic
220220 progress of students with disabilities;

305305 (b) ensure that gifted students with

310310 high mobility; and
311311 (d) develop and implement culturally and
312312 linguistically responsive and appropriate services, curricula
313313 and pedagogy to support students with disabilities;
314314 (2) state agencies and public post-secondary
315315 educational institutions to prioritize and expand appropriate
316316 special education services to children and students with
317317 disabilities from birth through transition to college or
318318 career;
319319 (3) state agencies and state primary and
320320 secondary educational institutions to ensure that students with
321321 disabilities in state custody or in residential treatment
322322 facilities and psychiatric hospitals receive free appropriate

324324 (4) public post-secondary educational
325325 institutions to support the education and training of licensed

360360 (a) are evidence- or research-based;
361361 (b) are designed in collaboration with
362362 parents and educational decision makers; and
363363 (c) include student-centered goals;
364364 (3) professional development materials and
365365 programming for licensed school employees; and
366366 (4) annual training to all local school
367367 boards, charter school governing bodies, school district
368368 administrators and school personnel that addresses:
369369 (a) state and federal law regarding the
370370 education of students with disabilities, including the federal
371371 Individuals with Disabilities Education Improvement Act of
372372 2004;
373373 (b) policies, practices and
374374 interventions specific to students with disabilities, including
375375 de-escalation practices and techniques and positive behavioral
376376 supports;
377377 (c) structured literacy;
378378 (d) the formulation and implementation
379379 of individualized education plans and transitional

411411 G. provide technical assistance to school districts
412412 and other special education providers that implement programs
413413 for students with disabilities;
414414 H. identify systems and policies that:
415415 (1) maximize the provision of special
416416 education services;
417417 (2) expedite the evaluation of students with
418418 disabilities, including students younger than age five; and
419419 (3) facilitate effective and meaningful
420420 inclusion and integration of students with disabilities in all
421421 educational settings;
422422 I. monitor:
423423 (1) the expenditures of federal and state
424424 funding for special education programs and services, including
425425 medicaid funding and the state equalization guarantee, and take
426426 action to ensure such expenditures are made in accordance with
427427 the law; and
428428 (2) school district policies and practices for
429429 screening and evaluating students suspected of having
430430 disabilities;
431431 J. work with the office of the state special
432432 education ombud, review recommendations from the state ombud,

464464 formulation of individualized education plans, which shall be
465465 used for all students to whom the federal Individuals with
466466 Disabilities Education Improvement Act of 2004 applies; and
467467 L. determine which special education data is needed
468468 to evaluate the state's compliance with federal and state laws
469469 related to special education, coordinate with other divisions
470470 of the department to ensure that school districts collect that
471471 data in a consistent and uniform manner and submit an annual
472472 report to the governor, secretary and legislative education
473473 study committee that includes the following data:
474474 (1) student demographics;
475475 (2) student achievement, outcomes and
476476 transitions;
477477 (3) state and federal funding and
478478 corresponding expenditures;
479479 (4) the types of programming and services
480480 provided in each school district and statewide and the office's
481481 evaluation of that programming and those services;
482482 (5) the use of restraint and seclusion of
483483 students with disabilities statewide; and
484484 (6) national compensation trends for special
485485 education teachers and recommendations for recruiting and

515515 SECTION 6. A new section of the Public School Code is
516516 enacted to read:
517517 "[NEW MATERIAL] SPECIAL EDUCATION SALARY DIFFERENTIAL
518518 LEVELS.--No later than July 1, 2026, the department and office
519519 shall, in consultation with school districts and licensed
520520 school employees, identify strategies for recruitment and
521521 retention of licensed school employees who provide
522522 instructional support to students with disabilities."
523523 SECTION 7. A new section of the Public School Code is
524524 enacted to read:
525525 "[NEW MATERIAL] TRANSFER OF PRESCHOOL SPECIAL EDUCATION.--
526526 A. No later than July 1, 2025, the department shall
527527 initiate the transfer of federal grant funding and
528528 corresponding powers and duties pursuant to Section 619 of Part
529529 B of the federal Individuals with Disabilities Education Act to
530530 the early childhood education and care department.
531531 B. The early childhood education and care
532532 department, through a coordinator appointed pursuant to Section
533533 619 of Part B of the federal Individuals with Disabilities
534534 Education Act, shall collaborate with the department in:
535535 (1) providing special education and related
536536 services to students with disabilities who are three through
537537 four years of age and who are five years of age but not
538538 eligible for kindergarten;

578578 C. The department shall retain all oversight
579579 responsibilities required pursuant to Section 619 of Part B of
580580 the federal Individuals with Disabilities Education Act,
581581 including oversight of administrative and fiscal compliance."
582582 SECTION 8. Section 22-8-6 NMSA 1978 (being Laws 1967,
583583 Chapter 16, Section 60, as amended) is amended to read:
584584 "22-8-6. OPERATING BUDGETS--EDUCATIONAL PLANS--
585585 SUBMISSION--CERTAIN REPORTS--FAILURE TO SUBMIT.--
586586 A. Prior to April 15 of each year, each local
587587 school board shall submit to the department an operating budget
588588 for the school district and any locally chartered charter
589589 school in the school district for the ensuing fiscal year.
590590 B. The date for the submission of the operating
591591 budget for each school district and each charter school as

624624 (1) estimates of the cost of insurance
625625 policies for periods up to five years if a lower rate may be
626626 obtained by purchasing insurance for the longer term; or
627627 (2) estimates of the cost of contracts for the
628628 transportation of students for terms extending up to four
629629 years.
630630 D. The operating budget required by this section
631631 shall include a budget for each charter school of the
632632 membership projected for each charter school, the total program
633633 units generated at that charter school and approximate
634634 anticipated disbursements and expenditures at each charter
635635 school.
636636 E. For fiscal year 2021 and subsequent fiscal
637637 years, each school district's and each locally chartered or
638638 state-chartered charter school's educational plan shall
639639 include:
640640 (1) information on the instructional time
641641 offered by the school district or charter school, including the
642642 number of instructional days by school site and the number of
643643 hours in each instructional day and the frequency of early-
644644 release days;

687687 school to ensure that the Bilingual Multicultural Education
688688 Act, the Indian Education Act and the Hispanic Education Act
689689 are being implemented by the school district or charter school;
690690 (6) a narrative describing the amount of
691691 program cost generated for services provided to students with
692692 disabilities and gifted students and the spending of these
693693 revenues on services provided to those students [with
694694 disabilities], which shall include the following:
695695 (a) program cost generated for students
696696 enrolled in approved special education programs;
697697 (b) budgeted expenditures of program

735735 (e) a description of the steps taken to
736736 ensure that students with disabilities have access to a free
737737 and appropriate public education; and
738738 (f) an explanation of how program costs
739739 are expended, disaggregated by grade; and
740740 (7) a common set of performance targets and
741741 performance measures, as determined by the department in
742742 consultation with the department of finance and administration,
743743 the legislative finance committee and the legislative education
744744 study committee.
745745 F. In addition to the requirements of Subsection E
746746 of this section, a school district or charter school that
747747 receives federal or local revenue shall include in its
748748 educational plan a narrative explaining how the school district
749749 or charter school will use the federal or local revenue to
750750 improve outcomes for students or to improve the condition of a

779779 school building. No later than October 1 of each year, a
780780 school district or charter school that received federal or
781781 local revenue in the prior fiscal year shall report to the
782782 department on the actual uses of that revenue, including a
783783 comprehensive evaluation of how the programs and services
784784 provided with that revenue improved outcomes for students or
785785 how capital projects undertaken improved the condition of a
786786 school building. A school district or charter school that is
787787 required under federal law to consult with tribal entities as a
788788 condition of receiving impact aid funds shall include in its
789789 educational plan a detailed narrative of its consultations with
790790 tribal entities and the results of those consultations. The
791791 school district or charter school shall transmit the October 1
792792 spending and outcomes report to the appropriate tribal
793793 authorities. No later than November 15 of each year, the
794794 department shall compile the federal and local revenue outcomes
795795 reports into a statewide report to the legislative education
796796 study committee and the legislative finance committee that
797797 includes an analysis and identification of effective programs
798798 and strategies that improve outcomes for students.
799799 G. A school district or charter school operating
800800 budget and educational plan shall prioritize federal and local
801801 revenue for purposes relating to the Indian Education Act; for
802802 capital expenditures authorized by the Public School Capital
803803 Outlay Act, the Public School Capital Improvements Act or the

835835 H. If a local school board or governing board of a
836836 charter school fails to submit an operating budget pursuant to
837837 this section, the department shall prepare the operating budget
838838 for the school district or charter school for the ensuing
839839 fiscal year. A local school board or governing board of a
840840 charter school shall be considered as failing to submit an
841841 operating budget pursuant to this section if the budget
842842 submitted exceeds the total projected resources of the school
843843 district or charter school or if the budget submitted does not
844844 comply with the law or with rules and procedures of the
845845 department.
846846 I. As used in this section:
847847 (1) "federal revenue" means seventy-five
848848 percent of the revenue derived from:
849849 (a) federal forest reserve funds
850850 distributed in accordance with Section 22-8-33 NMSA 1978; or
851851 (b) federal assistance to those areas
852852 affected by federal activity authorized in accordance with
853853 Title 20 of the United States Code, commonly known as "PL 874
854854 funds" or "impact aid funds"; and
855855 (2) "local revenue" means seventy-five percent
856856 of the revenue from a school district one-half mill school

892892 meet the needs of students [requiring special education and
893893 related services] with disabilities and gifted students . Rules
894894 and standards shall be developed and established by the
895895 department for the provision of special education in the
896896 schools and classes of the public school system in the state
897897 and in all institutions wholly or partly supported by the

16901690 B. A person shall not institute discriminatory,
16911691 disciplinary or retaliatory action against any student or
16921692 parent for filing a concern with, providing information to or
