4949 RELATING TO CRIME; DEFINING "LIVESTOCK" IN THE CRIMINAL CODE;
5050 AMENDING THE CRIME FOR LARCENY OF LIVESTOCK AND FIREARMS TO
5151 PERMIT MULTIPLE OFFENSES.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. Section 30-1-12 NMSA 1978 (being Laws 1963,
5454 Chapter 303, Section 1-13) is amended to read:
5555 "30-1-12. DEFINITIONS.--As used in the Criminal Code:
5656 A. "great bodily harm" means an injury to the
5757 person [which] that creates a high probability of death, [or
5858 which] causes serious disfigurement or [which ] results in
5959 permanent or protracted loss or impairment of the function of
6060 any member or organ of the body;
6161 B. "deadly weapon" means any firearm, whether
6262 loaded or unloaded; or any weapon [which ] that is capable of

9393 all such weapons with which dangerous cuts can be given or with
9494 which dangerous thrusts can be inflicted, including swordcanes,
9595 [and] any kind of sharp pointed canes, [also ] slingshots, slung
9696 shots and bludgeons; or any other weapons with which dangerous
9797 wounds can be inflicted;
9898 C. "peace officer" means any public official or
9999 public officer vested by law with a duty to maintain public
100100 order or to make arrests for crime, whether that duty extends
101101 to all crimes or is limited to specific crimes;
102102 D. "another" or "other" means any other human being
103103 or legal entity, whether incorporated or unincorporated,
104104 including the United States, the state [of New Mexico ] or any
105105 subdivision [thereof] of the state;
106106 E. "person" means any human being or legal entity,
107107 whether incorporated or unincorporated, including the United
108108 States, the state [of New Mexico ] or any subdivision [thereof ]
109109 of the state;
110110 F. "anything of value" means any conceivable thing
111111 of the slightest value, tangible or intangible, movable or
112112 immovable, corporeal or incorporeal, public or private. The
113113 term is not necessarily synonymous with the traditional legal
114114 term "property";

143143 G. "official proceeding" means a proceeding heard
144144 before any legislative, judicial, administrative or other
145145 governmental agency or official authorized to hear evidence
146146 under oath, including any referee, hearing examiner,
147147 commissioner, notary or other person taking testimony or
148148 depositions in any proceeding;
149149 H. "lawful custody or confinement" means the
150150 holding of any person pursuant to lawful authority, including
151151 without limitation actual or constructive custody of prisoners
152152 temporarily outside a penal institution, reformatory, jail,
153153 prison farm or ranch;
154154 I. "public officer" means any elected or appointed
155155 officer of the state or any of its political subdivisions,
156156 [and] whether or not [he] the officer receives remuneration for
157157 [his] services; [and]
158158 J. "public employee" means any person receiving
159159 remuneration for regular services rendered to the state or any
160160 of its political subdivisions;
161161 K. "livestock" means any domestic or domesticated
162162 animal or animals that are used or raised on a farm or ranch
163163 and exotic animals in captivity and includes horses, asses,
164164 mules, cattle, sheep, goats, swine, bison, poultry, ostriches,
165165 emus, rheas, camelids and farm cervidae, but does not include
166166 canine or feline animals. "Livestock" may be singular or
167167 plural; and

197197 SECTION 2. Section 30-16-1 NMSA 1978 (being Laws 1963,
198198 Chapter 303, Section 16-1, as amended) is amended to read:
199199 "30-16-1. LARCENY.--
200200 A. Larceny consists of the stealing of anything of
201201 value that belongs to another.
202202 B. Whoever commits larceny when the value of the
203203 property stolen is two hundred fifty dollars ($250) or less is
204204 guilty of a petty misdemeanor.
205205 C. Whoever commits larceny when the value of the
206206 property stolen is over two hundred fifty dollars ($250) but
207207 not more than five hundred dollars ($500) is guilty of a
208208 misdemeanor.
209209 D. Whoever commits larceny when the value of the
210210 property stolen is over five hundred dollars ($500) but not
211211 more than two thousand five hundred dollars ($2,500) is guilty
212212 of a fourth degree felony.
213213 E. Whoever commits larceny when the value of the
214214 property stolen is over two thousand five hundred dollars
215215 ($2,500) but not more than twenty thousand dollars ($20,000) is
216216 guilty of a third degree felony.
217217 F. Whoever commits larceny when the value of the
218218 property stolen is over twenty thousand dollars ($20,000) is
219219 guilty of a second degree felony.

264264 or less, is guilty of a fourth degree felony;
265265 (2) greater than two thousand five hundred
266266 dollars ($2,500) but not more than seven thousand dollars
267267 ($7,000), is guilty of a third degree felony;
268268 (3) greater than seven thousand dollars
269269 ($7,000) but not more than fifteen thousand dollars ($15,000),
