9292 SECTION 2. Section 22-23B-2 NMSA 1978 (being Laws 2010,
9393 Chapter 108, Section 2 and Laws 2010, Chapter 114, Section 2)

9595 "22-23B-2. PURPOSE.--The purpose of the Hispanic
9696 Education Act is to:
9797 A. provide for the study, development and
9898 implementation of educational systems that affect the
9999 educational success of Hispanic students to close the
100100 achievement gap and increase graduation rates;
101101 B. encourage and foster parental involvement in the
102102 education of their children; [and ]
103103 C. provide mechanisms for parents, community,
104104 community-based and business organizations, public schools,
105105 school districts, charter schools, public post-secondary
106106 educational institutions, the higher education department , the
107107 department and state and local policymakers to work together to
108108 improve educational opportunities for Hispanic students for the
109109 purpose of closing the achievement gap, increasing graduation
110110 rates and increasing post-secondary enrollment, retention and
111111 completion; and
112112 D. ensure the maintenance of the Spanish language ."

144144 "22-23B-4. HISPANIC EDUCATION LIAISON--CREATED--DUTIES.--
145145 A. The "Hispanic education liaison" is created in
146146 the department.
147147 B. The liaison shall:
148148 (1) focus on issues related to Hispanic
149149 education and advise the secretary on the development and
150150 implementation of policy regarding the education of Hispanic
151151 students;
152152 (2) advise the department and the commission
153153 on the development and implementation of the five-year
154154 strategic plan for public elementary, [and ] secondary education
155155 and post-secondary education in the state as the plan relates
156156 to Hispanic student education;
157157 (3) assist and be assisted by other staff in
158158 the department to improve elementary, secondary and post-
159159 secondary educational outcomes for Hispanic students;
160160 (4) serve as a resource to enable school
161161 districts and charter schools to provide equitable and
162162 culturally relevant learning environments, educational
163163 opportunities and culturally relevant instructional materials
164164 for Hispanic students enrolled in public schools;
165165 (5) support and consult with the Hispanic
166166 education advisory council; and
167167 (6) support school districts and charter
168168 schools to recruit parents on site-based and school district

199199 SECTION 4. Section 22-23B-6 NMSA 1978 (being Laws 2010,
200200 Chapter 108, Section 6 and Laws 2010, Chapter 114, Section 6,
201201 as amended) is amended to read:
202202 "22-23B-6. STATEWIDE STATUS REPORT.--
203203 A. The department, in collaboration with the higher
204204 education department, shall submit an annual preschool through
205205 post-secondary statewide Hispanic education status report no
206206 later than November 15 to the governor and the legislature
207207 through the legislative education study committee. A copy
208208 shall be provided to the legislative library in the legislative
209209 council service.
210210 B. The status report shall include the following
211211 information, by school district, by charter school and
212212 statewide, which may be compiled from data otherwise required
213213 to be submitted to the department:
214214 (1) Hispanic student achievement at all grades
215215 as measured by a statewide test approved by the department with
216216 results desegregated by ethnicity ;
217217 (2) attendance for all grades;
218218 (3) the graduation rates for Hispanic
219219 students; [and]
220220 (4) the number and type of bilingual and
221221 multicultural programs in each school district and charter

252252 the number of school dropouts and increase attendance .
253253 C. The status report shall include the following
254254 information, by post-secondary educational institution, which
255255 may be compiled from data otherwise required to be submitted to
256256 the higher education department:
257257 (1) Hispanic student enrollment;
258258 (2) Hispanic student retention; and
259259 (3) Hispanic student completion rates."
260260 SECTION 5. A new section of the Hispanic Education Act is
261261 enacted to read:
262262 "[NEW MATERIAL] SYSTEMIC FRAMEWORK.--
263263 A. School districts shall develop and publish a
264264 systemic framework for improving educational outcomes for
265265 Hispanic students. A school district shall develop the
266266 framework in collaboration with school employees, Hispanic
267267 students and families, social service providers and community
268268 and civic organizations. The Hispanic education liaison shall
269269 assist the school district as required during the development
270270 and implementation of the framework. The school district may
271271 request assistance from schools of education at state post-
272272 secondary educational institutions to identify best practices
273273 in collecting and using student-centered data to inform
274274 teaching strategies and schoolwide efforts to close the

305305 B. The systemic framework shall include culturally
306306 relevant programs, services, curricula, instructional
307307 materials, activities and professional development that need to
308308 be provided to improve Hispanic education in the state.
309309 C. Academic and other programs may include:
310310 (1) high-quality professional development for
311311 teaching professionals and paraprofessionals;
312312 (2) family-based early childhood programs that
313313 provide screening and referral and provide services to children
314314 with developmental delays or disabilities;
315315 (3) bilingual and bicultural programs and
316316 projects; and
317317 (4) programs designed to encourage and assist
318318 Hispanic students to work toward, and gain entrance into,
319319 institutions of higher education.
320320 D. Culturally related activities may include:
321321 (1) culturally related activities that support
322322 the academic program of the public school;
323323 (2) activities that support the Spanish
324324 language programs;
325325 (3) activities that promote the incorporation
326326 of culturally responsive teaching and learning strategies into
327327 the public school's educational program; and

358358 E. Services to be provided may include:
359359 (1) early interventions to help struggling
360360 students, such as after-school programs, tutoring and mentoring
361361 and school and community interventions to prevent truancy and
362362 reduce dropout rates;
363363 (2) comprehensive guidance and counseling
364364 services;
365365 (3) integrated educational services in
366366 combination with other programs that meet the needs of Hispanic
367367 students and their families, including programs that promote
368368 parental involvement in school activities and increase student
369369 achievement; and
370370 (4) family literacy services, including adult
371371 basic education programs."
