5252 THE COMMITTEE'S MEMBERSHIP AND DUTIES; MAKING AN APPROPRIATION.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. [NEW MATERIAL] BIPARTISAN BLUE RIBBON
5555 BEHAVIORAL HEALTH STATUTORY REVIEW COMMITTEE CREATED--
5656 MEMBERSHIP--APPOINTMENT--DUTIES.--
5757 A. The "bipartisan blue ribbon behavioral health
5858 statutory review committee" is created and shall function from
5959 the date of its appointment until June 30, 2027.
6060 B. The committee shall consist of subject matter
6161 experts appointed by the New Mexico legislative council.
6262 Committee members shall be adept at evaluating current New

9090 Mexico policies and practices for recommendations and
9191 enhancements to ensure that marginalized populations receive
9292 appropriate behavioral health care and support. The committee
9393 shall appoint a "criminal justice policy collaborative task
9494 force" that includes four representatives from each of the
9595 judicial districts in New Mexico, two active district attorneys
9696 and two active public defenders to advise the committee
9797 regarding criminal-justice-involved practices needing
9898 improvement in their respective judicial districts. These
9999 recommendations shall also be based on successful, well-
100100 established treatment law, policies and programs currently in
101101 law in other states.
102102 C. The committee shall elect a chair and such other
103103 officers as it deems necessary to carry out its duties. The
104104 committee shall meet at the call of the chair as necessary to
105105 carry out its duties, but no less than twice a month. The
106106 first meeting shall be held no later than July 1, 2025.
107107 D. The committee shall propose statewide policies
108108 and practices for trauma-informed adult, young adult and
109109 juvenile treatment court programs. The committee's policy
110110 recommendations shall address both addiction and mental health
111111 treatment using assisted outpatient treatment and longer term
112112 comprehensive inpatient care best practices.
113113 E. The committee shall develop recommendations for
114114 reform of New Mexico's behavioral health laws. To carry out

143143 this task, the committee shall examine New Mexico's behavioral
144144 health laws, identify strengths and deficiencies and consider a
145145 broad range of improvements that could be made to modernize the
146146 behavioral health system. The committee shall submit a report
147147 of its findings, including specific recommendations and
148148 proposed legislation, to the governor, the appropriate interim
149149 legislative committees and the supreme court commission on
150150 mental health no later than October 1, 2026.
151151 F. The committee shall hire or contract for expert
152152 staff who are well-versed and have previous successful
153153 experience working with legislators on behavioral treatment law
154154 reform. Staff shall assist the committee as directed by the
155155 chair, including conducting interviews with parties that wish
156156 to express their views to the committee and synthesizing this
157157 information for the committee. The committee may request
158158 assistance from the legislative council service.
159159 G. A majority of the members appointed to the
160160 committee constitutes a quorum for the transaction of business.
161161 The support of a majority of the members appointed is required
162162 for adoption of any recommendation of the committee.
163163 H. Members of the committee and the criminal
164164 justice policy collaborative task force who are not public
165165 employees are entitled to per diem and mileage as provided in
166166 the Per Diem and Mileage Act but shall receive no other
167167 compensation, perquisite or allowance.

196196 SECTION 2. APPROPRIATION.--Three hundred thousand
197197 dollars ($300,000) is appropriated from the general fund to the
198198 legislative council service for expenditure in fiscal years
199199 2026 and 2027 to carry out the provisions of this act,
200200 including staff salaries and reimbursement of the per diem and
201201 mileage expenses of the bipartisan blue ribbon behavioral
202202 health statutory review committee and the criminal justice
203203 policy collaborative task force. Any unexpended or
204204 unencumbered balance remaining at the end of fiscal year 2027
205205 shall revert to the general fund.
