49	49	RELATING TO INSURANCE; AMENDING THE HEALTH CARE PURCHASING ACT
50	50	AND SECTIONS OF THE NEW MEXICO INSURANCE CODE TO PROHIBIT COST
51	51	SHARING FOR CHOLESTEROL-LOWERING DRUGS.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Health Care Purchasing
54	54	Act is enacted to read:
55	55	"[NEW MATERIAL] COVERAGE FOR CHOLESTEROL-LOWERING DRUGS.--
56	56	A. Group health coverage, including any form of
57	57	self-insurance, offered, issued or renewed under the Health Care
58	58	Purchasing Act that provides coverage for cholesterol-lowering
59	59	drugs shall not impose cost sharing on those drugs.
60	60	B. For the purposes of this section, "cost sharing"
61	61	means a copayment, coinsurance, a deductible or any other form
62	62	of financial obligation of an enrollee other than a premium or a

93	93	SECTION 2. A new section of Chapter 59A, Article 22 NMSA
94	94	1978 is enacted to read:
95	95	"[NEW MATERIAL] COVERAGE FOR CHOLESTEROL-LOWERING DRUGS.--
96	96	A. An individual or group health insurance policy,
97	97	health care plan or certificate of health insurance that is
98	98	delivered, issued for delivery or renewed in this state that
99	99	provides coverage for cholesterol-lowering drugs shall not
100	100	impose cost sharing on those drugs.
101	101	B. For the purposes of this section, "cost
102	102	sharing" means a copayment, coinsurance, a deductible or any
103	103	other form of financial obligation of the insured other than a
104	104	premium or a share of a premium, or any combination of any of
105	105	these financial obligations, as defined by the terms of an
106	106	individual or group health insurance policy, health care plan
107	107	or certificate of health insurance."
108	108	SECTION 3. A new section of Chapter 59A, Article 23 NMSA
109	109	is enacted to read:
110	110	"[NEW MATERIAL] COVERAGE FOR CHOLESTEROL-LOWERING DRUGS.--
111	111	A. A group or blanket health insurance policy,
112	112	health care plan or certificate of health insurance that is
113	113	delivered, issued for delivery or renewed in this state that
114	114	provides coverage for cholesterol-lowering drugs shall not

151	151	SECTION 4. A new section of the Health Maintenance
152	152	Organization Law is enacted to read:
153	153	"[NEW MATERIAL] COVERAGE FOR CHOLESTEROL-LOWERING DRUGS.--
154	154	A. An individual or group health maintenance
155	155	organization contract that is delivered, issued for delivery or
156	156	renewed in this state that provides coverage for cholesterol-
157	157	lowering drugs shall not impose cost sharing on those drugs.
158	158	B. For the purposes of this section, "cost sharing"
159	159	means a copayment, coinsurance, a deductible or any other form
160	160	of financial obligation of an enrollee other than a premium or
161	161	a share of a premium, or any combination of any of these
162	162	financial obligations, as defined by the terms of an individual
163	163	or group health maintenance organization contract."
164	164	SECTION 5. A new section of the Nonprofit Health Care
165	165	Plan Law is enacted to read:
166	166	"[NEW MATERIAL] COVERAGE FOR CHOLESTEROL-LOWERING DRUGS.--
