4242 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4343 SECTION 1. Section 60-6A-4 NMSA 1978 (being Laws 1981,
4444 Chapter 39, Section 21, as amended) is amended to read:

7373 A. A local option district may approve the issuance
7474 of restaurant licenses for the sale of beer and wine by holding
7575 an election on that question pursuant to the procedures set out
7676 in Section 60-5A-1 NMSA 1978. The election also may be
7777 initiated by a resolution adopted by the governing body of the
7878 local option district without a petition from qualified
7979 electors having been submitted.
8080 B. A local option district that has approved the
8181 issuance of restaurant licenses for the sale of beer and wine
8282 is deemed to have approved the issuance of restaurant licenses
8383 for the sale of beer, wine and spirituous liquors in
8484 restaurants unless the local option district affirmatively
8585 adopts an ordinance prohibiting such licenses, except that a
8686 local option district within a class B county having a
8787 population of between fifty-six thousand and fifty-seven
8888 thousand according to the 1980 federal decennial census that
8989 has approved the issuance of restaurant licenses for the sale
9090 of beer and wine is deemed not to have approved the issuance of
9191 restaurant licenses for the sale of beer, wine and spirituous
9292 liquors in restaurants unless the local option district
9393 affirmatively adopts an ordinance approving such licenses.
9494 C. A restaurant license issued or renewed on or
9595 after July 1, [2021] 2025 that permits the sale and service of
9696 beer, [and] wine and spirituous liquors produced or bottled by
9797 or for a craft distiller pursuant to Section 60-6A-6.1 NMSA

127127 license shall be issued in accordance with the provisions of
128128 this section and rules adopted by the department.
129129 D. A restaurant license issued on or after July 1,
130130 2021 that permits the sale and service of beer, wine and
131131 spirituous liquors shall be designated a restaurant B license.
132132 The license shall be issued in accordance with the provisions
133133 of this section and rules adopted by the department.
134134 E. A restaurant license issued or renewed on or
135135 after July 1, 2025 that permits the sale and service of beer
136136 and wine only shall be designated a restaurant C license. The
137137 license shall be issued in accordance with the provisions of
138138 this section and rules adopted by the department.
139139 [E.] F. After the approval of restaurant licenses
140140 by the qualified electors of the local option district for the
141141 sale of beer and wine and upon completion of all requirements
142142 in the Liquor Control Act for the issuance of licenses, a
143143 restaurant located or to be located within the local option
144144 district may receive a restaurant A license to sell, serve or
145145 allow the consumption of beer, [and ] wine and spirituous
146146 liquors produced or bottled by or for a craft distiller
147147 pursuant to Section 60-6A-6.1 NMSA 1978; a restaurant B license
148148 to sell, serve or allow the consumption of beer, wine and
149149 spirituous liquors; or a restaurant C license to sell, serve or
150150 allow the consumption of beer and wine subject to the following

179179 requirements and restrictions:
180180 (1) the applicant shall submit evidence to the
181181 department that the applicant has a current valid food service
182182 establishment permit;
183183 (2) the applicant shall satisfy the director
184184 that the primary source of revenue from the operation of the
185185 restaurant will be derived from food and not from the sale of
186186 beer and wine;
187187 (3) the director shall condition renewal upon
188188 a requirement that no less than sixty percent of gross receipts
189189 from the preceding twelve months' operation of the licensed
190190 restaurant was derived from the sale of food;
191191 (4) upon application for renewal, the licensee
192192 shall submit an annual report to the director indicating the
193193 annual gross receipts from the sale of food and from beer and
194194 wine sales;
195195 (5) all sales, services and consumption of
196196 beer and wine authorized by a restaurant A license shall cease
197197 at the time food sales and services cease or at 11:00 p.m.,
198198 whichever time is earlier; and
199199 [(6) if Sunday sales have been approved in the
200200 local option district, a restaurant licensee may serve beer and
201201 wine on Sundays until the time meal sales and services cease or
202202 11:00 p.m., whichever time is earlier; and

235235 [F. Upon completion of all requirements in the
236236 Liquor Control Act for the issuance of licenses on and after
237237 July 1, 2021, and barring the adoption of an opt-out ordinance
238238 by the governing body of a local option district, a restaurant
239239 located or to be located within the local option district may
240240 receive a restaurant B license to sell, serve or allow the
241241 consumption of beer, wine and spirituous liquors subject to the
242242 following requirements and restrictions:
243243 (1) the applicant shall submit evidence to the

286286 (5) all sales, service and consumption of
287287 beer, wine and spirituous liquors authorized by a restaurant B

290290 (6) a restaurant B licensee shall serve a
291291 single patron no more than three drinks containing not more
292292 than one and one-half ounces of spirituous liquor during any
293293 one visit to the restaurant;
294294 (7) if Sunday sales have been approved in the
295295 local option district, a restaurant B licensee may serve beer,
296296 wine and spirituous liquors on Sundays until the time meal
297297 sales and services cease or 11:00 p.m., whichever time is
298298 earlier; and
299299 (8) a restaurant B license shall not be
300300 transferable from person to person but shall be transferable
301301 from one location to another location within the same local
302302 option district.]
303303 G. The provisions of Section 60-6A-18 NMSA 1978
304304 shall not apply to restaurant licenses.
305305 H. Nothing in this section shall prevent a
306306 restaurant licensee from receiving other licenses pursuant to
307307 the Liquor Control Act.
308308 [I. A person that has held a restaurant A license
309309 in good standing for a period of at least twelve consecutive

339339 ($500), be entitled to a restaurant A New Mexico spirituous
340340 liquors permit. In addition to being permitted to sell and
341341 serve beer and wine as authorized by a restaurant A license,
342342 the restaurant A New Mexico spirituous liquors permit shall
343343 entitle the licensee to also sell and serve spirituous liquors
344344 produced or bottled by or for a craft distiller pursuant to
345345 Section 60-6A-6.1 NMSA 1978. ]"
346346 SECTION 2. Section 60-6A-15 NMSA 1978 (being Laws 1981,
347347 Chapter 39, Section 32, as amended) is amended to read:
348348 "60-6A-15. LICENSE AND PERMIT FEES.--Except for calendar
349349 years 2022 through 2031 for license holders who purchased their
350350 license during the calendar years 2017 through 2021, who shall
351351 be charged no fee for the issuance or renewal of a license,
352352 every application for the issuance or renewal of the following
353353 licenses and permits shall be accompanied by a fee in the
354354 following specified amounts:
355355 A. manufacturer's license as a distiller, except a
356356 brandy manufacturer, three thousand dollars ($3,000);
357357 B. manufacturer's license as a brewer, three
358358 thousand dollars ($3,000);
359359 C. manufacturer's license as a rectifier, one
360360 thousand fifty dollars ($1,050);
361361 D. wholesaler's license to sell all alcoholic
362362 beverages for resale only, two thousand five hundred dollars

508508 SECTION 3. A new section of the Liquor Control Act is
509509 enacted to read:
510510 "[NEW MATERIAL] LOCAL ENTERTAINMENT ZONES.--
511511 A. The governing body of any county or municipality
512512 may, by ordinance or resolution, create and designate an
513513 "entertainment zone" within its jurisdiction.
514514 B. The designation of an entertainment zone shall
515515 be based on the governing body's determination that the area is
516516 suitable for leisure, arts, culture and entertainment
517517 activities, as evidenced by a concentration of restaurants,
518518 bars, theaters, music venues and other entertainment-related
519519 businesses. An entertainment zone designation shall include a
520520 clearly defined geographic boundary in the creation ordinance
521521 or resolution.

551551 Liquor Control Act, within any entertainment zone, the
552552 governing body may adopt its own regulations governing the
553553 public purchase, possession and consumption of alcohol,
554554 including open container allowances, hours of operation and
555555 licensing provisions.
556556 D. An establishment within an entertainment zone
557557 that sells or serves alcoholic beverages must comply with all
558558 applicable Liquor Control Act licensing requirements and any
559559 additional conditions imposed by the governing body."
560560 SECTION 4. REPEAL.--Section 60-6B-10 NMSA 1978 (being
561561 Laws 1981, Chapter 39, Section 45, as amended) is repealed.
562562 SECTION 5. EFFECTIVE DATE.--The effective date of the
563563 provisions of this act is July 1, 2025.
