3838 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3939 SECTION 1. Section 29-3A-3 NMSA 1978 (being Laws 2019,
4040 Chapter 203, Section 3) is amended to read:
4141 "29-3A-3. EXPUNGEMENT OF RECORDS UPON IDENTITY
4242 THEFT.--
4343 A. A person who is wrongfully identified in arrest
4444 records or public records as a result of identity theft may
4545 petition the district court for an order to expunge arrest
4646 records and public records.

7474 B. After a hearing on the petition and upon a
7575 showing that the person is a victim of identity theft, the
7676 court shall issue an order [within thirty days of the hearing ]
7777 requiring that all arrest records and public records be
7878 expunged.
7979 C. The court shall cause a copy of the order to be
8080 delivered to all relevant law enforcement agencies and courts.
8181 The order shall prohibit all relevant law enforcement agencies
8282 and courts from releasing copies of such records to any person,
8383 except upon order of the court.
8484 D. After notice to and a hearing for all interested
8585 parties and in compliance with all applicable law, the court
8686 shall insert in the records the correct name and other
8787 identifying information of the offender, if known or
8888 ascertainable, in lieu of the name of the person wrongly
8989 identified."
9090 SECTION 2. Section 29-3A-4 NMSA 1978 (being Laws 2019,
9191 Chapter 203, Section 4, as amended) is amended to read:
9292 "29-3A-4. EXPUNGEMENT OF RECORDS UPON RELEASE WITHOUT
9393 CONVICTION.--
9494 A. One year from the date of the final disposition
9595 in the case, a person released without conviction for a
9696 violation of a municipal ordinance, misdemeanor, felony,
9797 penalty assessments under the Criminal Code and the Motor
9898 Vehicle Code or violations and deferred sentences under the

127127 Motor Vehicle Code may petition the district court in the
128128 district in which the charges against the person originated for
129129 an order to expunge arrest records and public records related
130130 to that case.
131131 B. A petitioner shall provide notice by first-class
132132 United States mail of the filed petition to the [following
133133 parties] district attorney for that district , which [parties]
134134 shall be given thirty days in which to provide to the district
135135 court any objections to the petition
136136 [(1) the district attorney for that district;
137137 and
138138 (2) the department of public safety ].
139139 C. A single petition filed pursuant to Subsection A
140140 of this section may include a request to expunge multiple
141141 arrest records and public records that originated within the
142142 jurisdiction of a district. A petition shall be filed under
143143 seal or under pseudonym. Petitions brought pursuant to the
144144 Criminal Record Expungement Act and all records of proceedings
145145 thereunder shall be expunged upon the conclusion of
146146 proceedings. The petitioner shall attach to and file with the
147147 petition copies of the petitioner's record of arrest and
148148 prosecutions from the department of public safety dated no
149149 earlier than ninety days prior to the date the petition is
150150 filed.
151151 D. A party that seeks to object to a petition on

180180 the basis of the contents of a petitioner's record of arrest
181181 and prosecutions from the federal bureau of investigation must
182182 provide a copy of that record to a petitioner at no charge at
183183 the time the party objects.
184184 E. After a hearing on the petition, the court shall
185185 issue an order [within thirty days of the hearing ] requiring
186186 that all arrest records and public records related to the case
187187 be expunged if it finds that no other charge or proceeding is
188188 pending against the petitioner and if the petitioner was
189189 released without a conviction, including:
190190 (1) an acquittal or finding of not guilty;
191191 (2) a nolle prosequi, a no bill or other
192192 dismissal;
193193 (3) a referral to a preprosecution diversion
194194 program;
195195 (4) an order of conditional discharge pursuant
196196 to Section 31-20-13 NMSA 1978; or
197197 (5) the proceedings were otherwise discharged.
198198 F. The court shall cause a copy of the order to be
199199 delivered to all relevant law enforcement agencies and courts.
200200 The order shall prohibit all relevant law enforcement agencies
201201 and courts from releasing copies of the records to any person,
202202 except upon order of the court."
203203 SECTION 3. Section 29-3A-5 NMSA 1978 (being Laws 2019,
204204 Chapter 203, Section 5) is amended to read:

233233 "29-3A-5. EXPUNGEMENT OF RECORDS UPON CONVICTION.--
234234 A. A person convicted of a violation of a municipal
235235 ordinance, misdemeanor or felony, following the completion of
236236 the person's sentence and the payment of any fines or fees owed
237237 to the state for the conviction, may petition the district
238238 court in which the person was convicted for an order to expunge
239239 arrest records and public records related to that conviction.
240240 B. A petitioner shall provide notice of the filed
241241 petition to the [following parties ] district attorney for that
242242 district, which [parties] shall be given an opportunity to
243243 provide to the district court any objections to the petition
244244 [(1) the district attorney for that district;
245245 (2) the department of public safety; and
246246 (3) the law enforcement agency that arrested
247247 the petitioner].
248248 C. After a hearing on a petition, the court shall
249249 issue an order [within thirty days of the hearing ] requiring
250250 that all arrest records and public records related to the
251251 conviction be expunged if the court finds that:
252252 (1) no other charge or proceeding is pending
253253 against the petitioner;
254254 (2) justice will be served by an order to
255255 expunge;
256256 (3) the petitioner has fulfilled any victim
257257 restitution ordered by the court in connection with the

287287 (4) no other criminal conviction of the
288288 petitioner has occurred for a period of:
289289 (a) two years if the petition relates to
290290 a conviction for a violation of a municipal ordinance or a
291291 misdemeanor not otherwise provided in this paragraph;
292292 (b) four years if the petition relates
293293 to a misdemeanor conviction for aggravated battery as provided
294294 in Subsection B of Section 30-3-5 NMSA 1978 or to a conviction
295295 for a fourth degree felony not otherwise provided in this
296296 paragraph;
297297 (c) six years if the petition relates to
298298 a conviction for a third degree felony not otherwise provided
299299 in this paragraph;
300300 (d) eight years if the petition relates
301301 to a conviction for a second degree felony not otherwise
302302 provided in this paragraph; or
303303 (e) ten years if the petition relates to
304304 a conviction for a first degree felony or for any offense
305305 provided in the Crimes Against Household Members Act.
306306 D. The court shall cause a copy of the order to be
307307 delivered to all relevant law enforcement agencies and courts.
308308 The order shall prohibit all relevant law enforcement agencies
309309 and courts from releasing copies of such records to any person,
310310 except upon order of the court.

339339 E. To determine whether justice will be served by
340340 an order to expunge, the court shall consider:
341341 (1) the nature and gravity of the offense or
342342 conduct that resulted in the petitioner's conviction;
343343 (2) the petitioner's age, criminal history and
344344 employment history;
345345 (3) the length of time that has passed since
346346 the offense was committed and the related sentence was
347347 completed;
348348 (4) the specific adverse consequences the
349349 petitioner may be subject to if the petition is denied; and
350350 (5) any reasons to deny expungement of the
351351 records submitted by the district attorney.
352352 F. For the purposes of determining the time lapsed
353353 since a criminal conviction as required in Subsection C of this
354354 section, time shall be measured from the last date on which a
355355 person completed a sentence for a conviction in any
356356 jurisdiction.
357357 G. The provisions of Subsection A of this section
358358 do not apply to an offense committed against a child, an
359359 offense that caused great bodily harm or death to another
360360 person, a sex offense as defined in Section 29-11A-3 NMSA 1978
361361 [embezzlement pursuant to Section 30-16-8 NMSA 1978 ] or an
362362 offense involving driving while under the influence of
363363 intoxicating liquor or drugs."

392392 SECTION 4. REPEAL.--Section 29-10-8 NMSA 1978 (being Laws
