37	37	AND HUMAN SERVICES COMMITTEE'S AND ITS SUBCOMMITTEES' REQUESTS
38	38	FOR INFORMATION; ESTABLISHING THE COMMITTEE'S AND
39	39	SUBCOMMITTEES' POWER TO ADMINISTER OATHS AND ISSUE SUBPOENAS;
40	40	MAKING AN APPROPRIATION.
41	41	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
42	42	SECTION 1. Section 2-13-1 NMSA 1978 (being Laws 1989,
43	43	Chapter 349, Section 1) is amended to read:
44	44	"2-13-1. CREATION OF COMMITTEE--MEMBERS--APPOINTMENT--
45	45	TERMS.--
46	46	A. There is created a permanent joint [interim ]

74	74	committee of the legislature to be called the "legislative
75	75	health and human services committee". The committee shall be
76	76	composed of [eight] twelve members. [The legislative council
77	77	shall appoint four] Six members from the house of
78	78	representatives [and four ] shall be appointed by the speaker of
79	79	the house of representatives. Six members from the senate [At
80	80	the time of making the appointment, the legislative council
81	81	shall designate the chairman and vice chairman of the
82	82	committee] shall be appointed by the committees' committee of
83	83	the senate or, if the senate appointments are made in the
84	84	interim, by the president pro tempore of the senate after
85	85	consultation with and agreement of a majority of the members of
86	86	the committees' committee . Members shall be appointed so as to
87	87	give the two major political parties in each house the same
88	88	proportionate representation on the committee as prevails in
89	89	each house; provided that in no event shall either of such
90	90	parties have less than one member from each house on the
91	91	committee. [Members may be removed from the committee by the
92	92	legislative council, at the request of the committee chairman,
93	93	for nonattendance according to council policy. ] Vacancies on
94	94	the committee, however caused, may be filled [by the
95	95	legislative council, or the council may reduce the size of the
96	96	committee by not making replacement appointments and in such
97	97	case need not readjust party representation ] for the unexpired
98	98	term by appointment from the house of representatives or senate

127	127	by the respective appointing authority that makes the original
128	128	appointments and subject to the same recommendations; provided
129	129	that the new members shall be from the same house of the
130	130	legislature and the same party from which their predecessors
131	131	were appointed. No action shall be taken by the committee if a
132	132	majority of the total membership from either house on the
133	133	committee rejects such action.
134	134	B. The chair and vice chair shall be appointed for
135	135	terms coterminous with their membership on the committee. The
136	136	chair and vice chair shall alternate between the respective
137	137	houses every two years. For the terms beginning in 2025, the
138	138	chair shall be a house member, and the vice chair shall be a
139	139	senate member. The appointing authority of each house shall
140	140	exercise its appointing authority by naming the chair and vice
141	141	chair, respectively, on this alternating basis. "
142	142	SECTION 2. Section 2-13-2 NMSA 1978 (being Laws 1989,
143	143	Chapter 349, Section 2) is amended to read:
144	144	"2-13-2. DUTIES OF THE COMMITTEE.--The legislative health
145	145	and human services committee shall [conduct a continuing study
146	146	of] monitor and oversee the programs, agencies, policies,
147	147	issues and needs relating to health and human services,
148	148	including [review and study ] monitoring and oversight of the
149	149	statutes, constitutional provisions, regulations and court
150	150	decisions governing such programs, agencies, policies and
151	151	issues. The committee shall also [study ] monitor and oversee

181	181	needed for children and families and the aging population. The
182	182	committee shall make an annual report of its findings and
183	183	recommendations and recommend any necessary legislation to each
184	184	session of the legislature."
185	185	SECTION 3. Section 2-13-5 NMSA 1978 (being Laws 1989,
186	186	Chapter 349, Section 5) is amended to read:
187	187	"2-13-5. STAFF.--The [staff for the ] legislative health
188	188	and human services committee shall [be provided by the
189	189	legislative council service ] have a year-round staff assigned
190	190	exclusively to carrying out the duties of the committee. The
191	191	legislative council service shall provide the staff for the
192	192	legislative health and human services committee, which shall
193	193	include individuals with expertise in law, policy or finance
194	194	related to health care delivery or finance or to human services
195	195	matters."
196	196	SECTION 4. A new Section 2-13-6 NMSA 1978 is enacted to
197	197	read:
198	198	"2-13-6. [NEW MATERIAL ] COMPLIANCE WITH REQUESTS FOR
199	199	INFORMATION.--Each agency or institution of the state and its
200	200	political subdivisions shall furnish and make available to the
201	201	legislative health and human services committee or any of its
202	202	subcommittees such documents, material or information not made
203	203	confidential by law and that are requested by the committee or
204	204	any of its subcommittees upon a majority vote of the respective

234	234	SECTION 5. A new Section 2-13-7 NMSA 1978 is enacted to
235	235	read:
236	236	"2-13-7. [NEW MATERIAL ] SUBPOENA POWER.--The legislative
237	237	health and human services committee may conduct hearings and
238	238	administer oaths. The legislative health and human services
239	239	committee may issue a subpoena upon a vote of a majority of the
240	240	members of the committee. The subpoena may be enforced through
241	241	any district court of the state. Process of the committee
242	242	shall be served by any sheriff or any member of the New Mexico
243	243	state police and shall be served without cost to the committee
244	244	or its subcommittees."
245	245	SECTION 6. APPROPRIATION.--Five hundred thousand dollars
246	246	($500,000) is appropriated from the general fund to the
247	247	legislative council service for expenditure in fiscal years
248	248	2025 and 2026 to fund staffing for and the activities of the
249	249	legislative health and human services committee pursuant to
250	250	this act. Any unexpended or unencumbered balance remaining at
251	251	the end of fiscal year 2026 shall revert to the general fund.
