5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. Section 61-14B-2 NMSA 1978 (being Laws 1996,
5656 Chapter 57, Section 2, as amended) is amended to read:
5757 "61-14B-2. DEFINITIONS.--As used in the Speech-Language
5858 Pathology, Audiology and Hearing Aid Dispensing Practices Act:
5959 [A. "apprentice" means a person working toward full
6060 licensure in speech-language pathology who meets the
6161 requirements for licensure as an apprentice in speech and
6262 language pursuant to the Speech-Language Pathology, Audiology

9696 [C.] B. "auditory trainer" means a custom-fitted FM

9999 [D.] C. "audiologist" means a person who engages in
100100 the practice of audiology, who may or may not dispense hearing
101101 aids and who meets the qualifications set forth in the Speech-
102102 Language Pathology, Audiology and Hearing Aid Dispensing
103103 Practices Act;
104104 [E.] D. "bilingual-multicultural endorsement" means
105105 an endorsement that is issued pursuant to the Speech-Language
106106 Pathology, Audiology and Hearing Aid Dispensing Practices Act
107107 to a qualified speech-language pathologist and that recognizes
108108 the licensee's or applicant's demonstrated proficiency in the
109109 use of languages other than English to provide speech-language
110110 pathology services;
111111 [F.] E. "board" means the speech-language
112112 pathology, audiology and hearing aid dispensing practices
113113 board;
114114 [G.] F. "business location" means a permanent

145145 [H.] G. "certification by a national professional
146146 association" means certification issued by a board-approved
147147 national speech-language or hearing association;
148148 [I.] H. "clinical fellow" means a person who has
149149 completed all academic course work and practicum requirements
150150 for a master's degree or the equivalent in speech-language
151151 pathology and engages in the practice of speech-language
152152 pathology as set forth in the provisions of the Speech-Language
153153 Pathology, Audiology and Hearing Aid Dispensing Practices Act;
154154 [J.] I. "clinical fellowship year" or "CFY" means
155155 the time following the completion of all academic course work
156156 and practicum requirements for a master's degree in speech-
157157 language pathology and during which a clinical fellow is
158158 working toward certification by a national professional
159159 association;
160160 [K.] J. "department" means the regulation and
161161 licensing department;
162162 K. "direct contact" means a level of supervision in
163163 which a supervisor is able to provide immediate feedback to a
164164 person that the supervisor is supervising;
165165 L. "hearing aid" means a wearable instrument or
166166 device designed or offered for the purpose of aiding or
167167 compensating for impaired human hearing and any parts,

198198 M. "hearing aid dispenser" means a person other
199199 than an audiologist or an otolaryngologist who is licensed to
200200 sell, fit and service hearing aids pursuant to the Speech-
201201 Language Pathology, Audiology and Hearing Aid Dispensing
202202 Practices Act and maintains or occupies a permanent physical
203203 business location in New Mexico where records can be examined
204204 and process can be served;
205205 N. "otolaryngologist" means a licensed physician
206206 who has completed a recognized residency in otolaryngology and
207207 is certified by the American board of otolaryngology;
208208 O. "paraprofessional" means a person who provides
209209 adjunct speech-pathology or audiology services under the direct
210210 supervision of a licensed speech-language pathologist or
211211 audiologist;
212212 P. "practice of audiology" means the application of
213213 principles, methods and procedures of measurement, testing,
214214 appraisal, prognostication, aural rehabilitation, aural
215215 habilitation, consultation, hearing aid selection and fitting,
216216 counseling, instruction and research related to hearing and
217217 disorders of hearing for the purpose of nonmedical diagnosis,
218218 prevention, identification, amelioration or the modification of
219219 communicative disorders involving speech, language auditory
220220 function or other aberrant behavior related to hearing

250250 Q. "practice of hearing aid dispensing" means the
251251 behavioral measurement of human hearing for the purpose of the
252252 selection and fitting of hearing aids or other rehabilitative
253253 devices to ameliorate the dysfunction of hearing sensitivity;
254254 this may include otoscopic inspection of the ear, fabrication
255255 of ear impressions and earmolds, instruction, consultation and
256256 counseling on the use and care of these instruments, medical
257257 referral when appropriate and the analysis of function and
258258 servicing of these instruments involving their modification or
259259 adjustment;
260260 R. "practice of speech-language pathology" means
261261 the rendering or offering to render to individuals, groups,
262262 organizations or the public any service in speech or language
263263 pathology involving the nonmedical application of principles,
264264 methods and procedures for the measurement, testing, diagnosis,
265265 prognostication, counseling and instruction related to the
266266 development and disorders of communications, speech, fluency,
267267 voice, verbal and written language, auditory comprehension,
268268 cognition, dysphagia, oral pharyngeal or laryngeal sensorimotor
269269 competencies and treatment of persons requiring use of an
270270 augmentative communication device for the purpose of nonmedical
271271 diagnosing, preventing, treating and ameliorating such
272272 disorders and conditions in individuals and groups of
273273 individuals;

302302 S. "repetitive, mechanical or routine tasks" means
303303 tasks that are simple, predictable or rote and do not require
304304 the expertise of a speech-language pathologist to administer.
305305 These activities are essential for maintaining consistency and
306306 effectiveness in therapy services provided by speech-language
307307 pathologists. "Repetitive, mechanical or routine tasks"
308308 includes implementing routine therapy sessions, recording and
309309 documenting data, preparing therapy materials and setting up
310310 clean environments;
311311 [S.] T. "screening" means a pass-fail procedure to
312312 identify individuals who may require further assessment in the
313313 areas of speech-language pathology, audiology or hearing aid
314314 dispensing;
315315 [T.] U. "speech-language pathologist" means a
316316 person who engages in the practice of speech-language pathology
317317 and who meets the qualifications set forth in the Speech-
318318 Language Pathology, Audiology and Hearing Aid Dispensing
319319 Practices Act;
320320 V. "speech-language pathology assistant" means a
321321 person who assists in the practice of speech-language pathology
322322 and meets the qualifications set forth in the Speech-Language
323323 Pathology, Audiology and Hearing Aid Dispensing Practices Act;
324324 [U.] W. "sponsor" means a licensed hearing aid
325325 dispenser, audiologist or otolaryngologist who has an
326326 endorsement to dispense hearing aids and:

356356 where the trainee is being trained; and
357357 (2) has been actively engaged in the
358358 dispensing of hearing aids during three of the past five years;
359359 [V.] X. "student" means a person who is a full- or
360360 part-time student enrolled in an accredited college or
361361 university program in speech-language pathology, audiology or
362362 communicative disorders;
363363 [W.] Y. "supervisor" means a speech-language
364364 pathologist or audiologist licensed pursuant to the provisions
365365 of the Speech-Language Pathology, Audiology and Hearing Aid
366366 Dispensing Practices Act who provides supervision in the area
367367 of speech-language pathology or audiology; and
368368 [X.] Z. "trainee" means a person working toward
369369 full licensure as a hearing aid dispenser under the direct
370370 supervision of a sponsor."
371371 SECTION 2. A new section of the Speech-Language
372372 Pathology, Audiology and Hearing Aid Dispensing Practices Act,
373373 Section 61-14B-3.3 NMSA 1978, is enacted to read:
374374 "61-14B-3.3. [NEW MATERIAL ] SCOPE OF PRACTICE--SPEECH-
375375 LANGUAGE PATHOLOGY ASSISTANT.--
376376 A. The scope of practice for a speech-language
377377 pathology assistant is to assist a speech-language pathologist
378378 with administrative, clinically related and clinical tasks that
379379 are planned, selected, directed or designed by the speech-

408408 language pathology assistant's appropriate supervisor. The
409409 appropriate supervisor of a speech-language pathology assistant
410410 may delegate to a speech-language pathology assistant certain
411411 repetitive, mechanical or routine tasks that fall within the
412412 scope of the practice of speech-language pathology. The
413413 appropriate supervisor of a speech-language pathology assistant
414414 retains full legal and ethical responsibility for every patient
415415 to whom the speech-language pathology assistant provides
416416 services. The scope of practice for a speech-language
417417 pathology assistant may include:
418418 (1) providing clerical, administrative,
419419 prevention, advocacy and clinically related support to a
420420 supervising speech-language pathologist;
421421 (2) at the discretion of the supervising
422422 speech-language pathologist, assisting with or conducting
423423 speech, language and hearing screenings without providing
424424 clinical interpretation;
425425 (3) documenting a patient's performance and
426426 reporting the information to the supervising speech-language
427427 pathologist;
428428 (4) assisting a supervising speech-language
429429 pathologist in the provision of services to a patient who
430430 speaks a language other than English, if the speech-language
431431 pathology assistant has demonstrated competency in the language
432432 the patient speaks;

462462 the use of augmentative and alternative communication devices;
463463 (6) providing guidance and treatment via
464464 telepractice to students who are selected by an appropriate
465465 supervisor; and
466466 (7) assisting and supporting an appropriate
467467 supervisor during feeding and swallowing evaluations and
468468 treatments.
469469 B. A speech-language pathology assistant shall not:
470470 (1) represent the speech-language pathology
471471 assistant's self as a speech-language pathologist;
472472 (2) disclose clinical or confidential
473473 information either orally or in writing to anyone other than
474474 the supervising speech-language pathologist, unless otherwise
475475 mandated by law;
476476 (3) perform or interpret diagnostic tests,
477477 instrumental dysphagia exams, feeding assessments or swallowing
478478 assessments or strategies;
479479 (4) write, develop or modify a patient's
480480 treatment plan;
481481 (5) provide interpretative information to a
482482 patient or a patient's family regarding the patient's status or
483483 services;
484484 (6) select patients or plan treatment
485485 sessions;

516516 (8) treat medically fragile patients
517517 independently;
518518 (9) discharge a patient from therapy services;

520520 (10) make referrals for additional service.
521521 C. The board shall promulgate rules to outline the
522522 types of procedures that a speech-language pathology assistant
523523 may or may not perform under the supervision of an appropriate
524524 supervisor.
525525 D. For the purposes of this section, "medically
526526 fragile patient" means a person who has a chronic physical
527527 condition that results in a prolonged dependency on medical
528528 care for which daily skilled nursing intervention is medically
529529 necessary."
530530 SECTION 3. A new section of the Speech-Language
531531 Pathology, Audiology and Hearing Aid Dispensing Practices Act,
532532 Section 61-14B-15.2 NMSA 1978, is enacted to read:
533533 "61-14B-15.2. [NEW MATERIAL ] REQUIREMENTS FOR LICENSURE--
534534 SPEECH-LANGUAGE PATHOLOGY ASSISTANT.--A license to practice as
535535 a speech-language pathology assistant shall be issued by the
536536 board to a person who files a completed application, pays the
537537 required fees and submits documentation and evidence to
538538 demonstrate that the person has met either of the following

571571 nationally recognized speech-language-hearing association;
572572 (2) and passage of a nationally recognized
573573 standard examination for speech-language pathology assistant
574574 verification; and
575575 (3) of at least one hundred supervised
576576 clinical hours under the supervision of a certified speech-
577577 language pathologist; or
578578 B. active certification as a speech-language
579579 pathology assistant from a nationally recognized certification
580580 body and proof of passage of a state jurisprudence exam for
581581 speech-language pathology assistants."
582582 SECTION 4. A new section of the Speech-Language
583583 Pathology, Audiology and Hearing Aid Dispensing Practices Act,
584584 Section 61-14B-15.3 NMSA 1978, is enacted to read:
585585 "61-14B-15.3. [NEW MATERIAL ] SPEECH-LANGUAGE PATHOLOGY
586586 ASSISTANT SUPERVISION REQUIREMENTS.--
587587 A. A speech-language pathology assistant shall be
588588 supervised by an appropriate supervisor who:
589589 (1) has consented in writing to supervise the
590590 speech-language pathology assistant;
591591 (2) is licensed pursuant to the Speech-

622622 (3) has completed a minimum of two hours of
623623 board-approved training in clinical instruction and
624624 supervision.
625625 B. An appropriate supervisor shall:
626626 (1) provide supervision to no more than two
627627 full-time or three part-time speech-language pathology
628628 assistants;
629629 (2) be responsible for an entire caseload and
630630 workload. The appropriate supervisor shall ensure that the
631631 speech-language pathology assistant does not have an individual
632632 caseload or workload that is separate from the appropriate
633633 supervisor's;
634634 (3) be present for the first and last contact
635635 with each patient;
636636 (4) provide a level of supervision necessary
637637 for each situation, based on the:
638638 (a) competencies, skills and experience
639639 of the speech-language pathology assistant;
640640 (b) needs of the patient being served;
641641 and
642642 (c) service setting; and
643643 (5) provide direct contact to speech-language
644644 pathology assistants when a speech-language pathology assistant

675675 SECTION 5. Section 61-14B-16.1 NMSA 1978 (being Laws
676676 2022, Chapter 39, Section 63) is amended to read:
677677 "61-14B-16.1. EXPEDITED LICENSURE.--
678678 A. The board shall issue an expedited license
679679 without examination to a speech-language pathologist, speech-
680680 language pathology assistant , audiologist or hearing aid
681681 dispenser licensed in another licensing jurisdiction in
682682 accordance with Section 61-1-31.1 NMSA 1978. The board shall
683683 issue the expedited license as soon as practicable but no later
684684 than thirty days after the person files an application with the
685685 required fees and demonstrates that the person holds a valid,
686686 unrestricted license and is in good standing with the licensing
687687 board in the other licensing jurisdiction. If the board issues
688688 an expedited license to a person whose prior licensing
689689 jurisdiction did not require examination, the board may require
690690 the person to pass an examination before license renewal.
691691 B. The board by rule shall determine the states and
692692 territories of the United States and the District of Columbia
693693 from which it will not accept an applicant for expedited
694694 licensure and determine any foreign countries from which it
695695 will accept an applicant for expedited licensure. The board
696696 shall post the lists of disapproved and approved licensing
697697 jurisdictions on its website. The list of disapproved

726726 licensing jurisdictions shall include specific reasons for
727727 disapproval. The lists shall be reviewed annually to determine
728728 if amendments to the rule are warranted."
729729 SECTION 6. Section 61-14B-19 NMSA 1978 (being Laws 1996,
730730 Chapter 57, Section 19, as amended) is amended to read:
731731 "61-14B-19. LICENSE RENEWAL.--
732732 A. Each licensee shall renew the licensee's license
733733 biennially by submitting a renewal application as provided for
734734 in the board's regulations. The board may require proof of
735735 continuing education as a requirement for renewal. The board
736736 may establish a method to provide for staggered biennial terms.
737737 The board may authorize license renewal for one year to
738738 establish the renewal cycle.
739739 B. A sixty-day grace period shall be allowed to
740740 each licensee after each licensing period. A license may be
741741 renewed during the grace period upon payment of a renewal fee
742742 and a late fee as prescribed by the board.
743743 C. Any license not renewed by the end of the grace
744744 period will be considered expired and the licensee shall not be
745745 eligible to practice within the state until the license is
746746 renewed. The board shall develop rules regarding requirements
747747 for renewal of an expired license and may require the licensee
748748 to reapply as a new applicant.
749749 D. Clinical fellow licenses may be renewed annually
750750 for no more than three years; provided the clinical fellow has

781781 clinical fellow's second year of the CFY. The CFY license
782782 shall not be renewed for a second year without evidence of
783783 passing a recognized standard national examination in speech-
784784 language pathology.
785785 [E. An apprentice in speech-language pathology
786786 shall renew the apprentice's license annually; provided that
787787 the apprentice is accepted into a master's-level program in
788788 speech-language pathology or communicative disorders within two
789789 years of initial licensing.
790790 F.] E. The board may issue rules providing for
791791 inactive status of licenses."
792792 SECTION 7. Section 61-14B-20 NMSA 1978 (being Laws 1996,
793793 Chapter 57, Section 20, as amended) is amended to read:
794794 "61-14B-20. FEES.--Except as provided in Section 61-1-34
795795 NMSA 1978, the board shall establish a schedule of reasonable
796796 fees for applications, licenses, renewal of licenses, exams,
797797 penalties and administrative fees. The license and license
798798 renewal fees shall not exceed:
799799 A. one hundred dollars ($100) for clinical fellows
800800 and [apprentices in speech and language ] speech-language
801801 pathology assistants;
802802 B. two hundred dollars ($200) for audiologists or
803803 speech-language pathologists;
