3232 AN ACT
3333 RELATING TO INSURANCE; ENACTING A NEW SECTION OF THE FAIR PLAN
3434 ACT; PROVIDING A MAXIMUM INSURABLE VALUE FOR PROPERTIES INSURED
3535 UNDER THE FAIR PLAN.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. A new section of the FAIR Plan Act is enacted
3838 to read:
3939 "[NEW MATERIAL] FIRE DEPARTMENT INSURANCE LIMITS.--
4040 A. The maximum limit of liability for a property
4141 insured and subsequently damaged or destroyed by fire that is
4242 located in the service area of a fire department that may be
4343 insured under a FAIR plan shall be:
4444 (1) six hundred thousand dollars ($600,000)
4545 for a property insured and subsequently damaged or destroyed by
4646 fire that is located in the service area of a fire department

7474 with a class rating of eight, nine or ten or a similar rating
7575 system as determined by a nationally recognized insurance
7676 service; and
7777 (2) seven hundred fifty thousand dollars
7878 ($750,000) for a property insured and subsequently damaged or
7979 destroyed by fire that is located in the service area of a
8080 well-staffed and well-equipped fire department with a class
8181 rating of one through seven or a similar rating system as
8282 determined by a nationally recognized insurance service.
8383 B. As used in this section, "nationally recognized
8484 insurance service" means an organization that collects
8585 statistical data, promulgates rating information, develops
8686 standard policy forms and files information with state
8787 regulators of insurance on behalf of insurance companies and
8888 rates fire departments based on the following factors:
8989 (1) emergency communication systems, including
9090 911 dispatch;
9191 (2) fire department staffing, training and
9292 equipment;
9393 (3) water supply availability and pressure;
9494 and
9595 (4) community risk reduction programs and
9696 other factors."
