35	35	A GAMING OPERATOR'S LICENSE; ESTABLISHING A RACE MEET MINIMUM

37	37	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
38	38	SECTION 1. Section 60-1A-2 NMSA 1978 (being Laws 2007,
39	39	Chapter 39, Section 2) is amended to read:
40	40	"60-1A-2. DEFINITIONS.--As used in the Horse Racing Act:
41	41	A. "board" means the gaming control board;
42	42	B. "breakage" means the odd cents by which the
43	43	amount payable on each dollar wagered exceeds a multiple of
44	44	ten;
45	45	C. "commission" means the state racing commission;
46	46	D. "exotic wagering" means all wagering other than

77	77	horse racetrack from the originating horse racetrack to another

79	79	F. "guest state" means a jurisdiction, other than
80	80	the jurisdiction in which a horse race is run, in which a horse
81	81	racetrack, off-track wagering facility or other facility that
82	82	is a member of and subject to an interstate common pool is
83	83	located;
84	84	G. "guest track" means a horse racetrack, off-track
85	85	wagering facility or other licensed facility in a location
86	86	other than the state in which a horse race is run that is a
87	87	member of and subject to an interstate common pool;
88	88	H. "handle" means the total of all pari-mutuel
89	89	wagering sales, excluding refunds and cancellations;
90	90	I. "horse race" means a competition among
91	91	racehorses on a predetermined course in which the horse
92	92	completing the course in the least amount of time generally
93	93	wins;
94	94	J. "host state" means the jurisdiction within which
95	95	a sending track is located, also known as a "sending state";
96	96	K. "host track" means the horse racetrack from
97	97	which a horse race subject to an interstate common pool is
98	98	transmitted to members of that interstate common pool, also

128	128	L. "import" means to receive a live audiovisual

130	130	M. "interstate common pool" means a pari-mutuel
131	131	pool that combines comparable pari-mutuel pools from one or
132	132	more locations that accept wagers on a horse race run at a
133	133	sending track for purposes of establishing payoff prices at the
134	134	pool members' locations, including pools in which pool members
135	135	from more than one state simultaneously combine pari-mutuel
136	136	pools to form an interstate common pool;
137	137	N. "jockey club" means an organization that
138	138	administers thoroughbred registration records and registers
139	139	thoroughbreds;
140	140	O. "licensed premises" means land, together with
141	141	all buildings, other improvements and personal property located
142	142	on the land, that is under the direct control of a racetrack
143	143	licensee, including the restricted areas, grandstand and public
144	144	parking areas;
145	145	P. "licensee" means a person licensed by the
146	146	commission and includes a holder of an occupational, secondary
147	147	or racetrack license;
148	148	Q. "occupational license" means a license issued by
149	149	the commission to a vendor or to a person having access to a
150	150	restricted area on the licensed premises, including a horse
151	151	owner, trainer, jockey, agent, apprentice, groom, exercise

181	181	secretary, pari-mutuel clerk and other personnel designated by
182	182	the commission whose work, in whole or in part, is conducted
183	183	around racehorses or pari-mutuel betting windows;
184	184	R. "pari-mutuel wagering" means a system of
185	185	wagering in which bets on a live or simulcast horse race are
186	186	pooled and held by the racetrack licensee for distribution of
187	187	the total amount, less the deductions authorized by law, to
188	188	holders of winning tickets; "pari-mutuel wagering" does not
189	189	include bookmaking or pool selling;
190	190	S. "pari-mutuel wagering pool" means the money
191	191	wagered on a specific horse race through pari-mutuel wagering;
192	192	T. "practical breeder" means a person who has
193	193	practical experience in breeding horses, although the person
194	194	may not be actively involved in breeding horses;
195	195	U. "primary residence" means the domicile where a
196	196	person resides for most of the year, and, if the person is
197	197	temporarily out of state, the address where a person will
198	198	return when the person returns to New Mexico or the address
199	199	that a person uses for purposes of a driver's license, passport
200	200	or voting;
201	201	V. "quarter horse" means a racehorse that is
202	202	registered with the American quarter horse association or any
203	203	successor association;
204	204	W. "race meet" means a period of time within dates

237	237	thoroughbred that is bred and trained to compete in horse

239	239	Y. "racetrack license" means a license to conduct

241	241	Z. "racetrack licensee" means a person who has been
242	242	issued a racetrack license;
243	243	AA. "racing grounds" means the area of the
244	244	restricted area of licensed premises used for the purpose of
245	245	conducting horse races and all activities ancillary to the
246	246	conduct of horse races, including the track, stable area,
247	247	jockey's quarters and horse training areas;
248	248	BB. "retainage" means money that is retained from
249	249	wagers on win, place and show and on exotic wagers by a
250	250	racetrack licensee pursuant to the Horse Racing Act;
251	251	CC. "restricted areas" means the stable area, the
252	252	area behind the pari-mutuel betting windows and anywhere on the
253	253	racing grounds;
254	254	DD. "secondary licensee" means all officers,
255	255	directors, shareholders, lenders or holders of evidence of
256	256	indebtedness of a corporation or legal entity owning a horse
257	257	racetrack, and all persons holding a direct or indirect

287	287	including interests or positions that deal with the funds of
288	288	the racetrack or that are administrative, policymaking or
289	289	supervisory;
290	290	EE. "simulcast" means a transmission of a live
291	291	audiovisual broadcast of a horse race being run at a horse
292	292	racetrack other than the horse racetrack or other licensed
293	293	facility at which the broadcast is being received for viewing
294	294	pursuant to a simulcasting contract;
295	295	FF. "stakes race" means a horse race in which
296	296	nominations or entry or starting fees contribute to the purse;
297	297	an overnight race is not a stakes race;
298	298	GG. "steward" means an employee of the commission
299	299	who supervises horse races and oversees a race meet while in
300	300	progress, including holding hearings regarding licensees and
301	301	enforcing the rules of the commission and the horse racetrack;
302	302	HH. "takeout" means amounts authorized by statute
303	303	to be deducted from the pari-mutuel wagers;
304	304	II. "thoroughbred" means a racehorse that is
305	305	registered with the jockey club;
306	306	JJ. "track" means the surfaced oval area on which
307	307	horse races are conducted; and
308	308	KK. "vendor" means a person who provides goods or
309	309	services to or in the racing grounds or restricted area of the
310	310	licensed premises of a horse racetrack."

339	339	SECTION 2. A new section of the Horse Racing Act is
340	340	enacted to read:
341	341	"[NEW MATERIAL] RACE MEETS--FIFTEEN-WEEK MINIMUM--LIVE
342	342	RACING DAYS.--Live racing shall begin on the first day of a
343	343	race meet authorized for a racetrack licensee and shall
344	344	conclude on the final day of the authorized race meet. A race
345	345	meet shall be composed of three live race days for each week of
346	346	the race meet with at least ten live races per day for a
347	347	racetrack licensee that paid gaming tax to the state on its net
348	348	take in an amount equal to eight million dollars ($8,000,000)
349	349	or less in the prior fiscal year or four live race days for
350	350	each week of the race meet with at least nine live races per
351	351	day for a racetrack licensee that paid gaming tax to the state
352	352	on its net take in an amount greater than eight million dollars
353	353	($8,000,000) in the prior fiscal year. There shall be a lapse
354	354	of no more than three consecutive days in live racing from the
355	355	date a race meet ends at the racing grounds of one racetrack
356	356	licensee and the beginning of a race meet for another racetrack
357	357	licensee. A race meet shall be a minimum of fifteen weeks
358	358	long."
359	359	SECTION 3. EFFECTIVE DATE.--The effective date of the
360	360	provisions of this act is July 1, 2025.
