3333 RELATING TO HORSE RACING; AMENDING THE TIME FRAME FOR THE
3434 NUMBER OF LIVE RACE DAYS NECESSARY FOR A RACETRACK TO MAINTAIN
3535 A GAMING OPERATOR'S LICENSE; ESTABLISHING A RACE MEET MINIMUM
3636 LENGTH OF TIME.
3737 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3838 SECTION 1. Section 60-1A-2 NMSA 1978 (being Laws 2007,
3939 Chapter 39, Section 2) is amended to read:
4040 "60-1A-2. DEFINITIONS.--As used in the Horse Racing Act:
4141 A. "board" means the gaming control board;
4242 B. "breakage" means the odd cents by which the
4343 amount payable on each dollar wagered exceeds a multiple of
4444 ten;
4545 C. "commission" means the state racing commission;
4646 D. "exotic wagering" means all wagering other than

7777 horse racetrack from the originating horse racetrack to another

7979 F. "guest state" means a jurisdiction, other than
8080 the jurisdiction in which a horse race is run, in which a horse
8181 racetrack, off-track wagering facility or other facility that
8282 is a member of and subject to an interstate common pool is
8383 located;
8484 G. "guest track" means a horse racetrack, off-track
8585 wagering facility or other licensed facility in a location
8686 other than the state in which a horse race is run that is a
8787 member of and subject to an interstate common pool;
8888 H. "handle" means the total of all pari-mutuel
8989 wagering sales, excluding refunds and cancellations;
9090 I. "horse race" means a competition among
9191 racehorses on a predetermined course in which the horse
9292 completing the course in the least amount of time generally
9393 wins;
9494 J. "host state" means the jurisdiction within which
9595 a sending track is located, also known as a "sending state";
9696 K. "host track" means the horse racetrack from
9797 which a horse race subject to an interstate common pool is
9898 transmitted to members of that interstate common pool, also

128128 L. "import" means to receive a live audiovisual
129129 broadcast of a horse race;
130130 M. "interstate common pool" means a pari-mutuel
131131 pool that combines comparable pari-mutuel pools from one or
132132 more locations that accept wagers on a horse race run at a
133133 sending track for purposes of establishing payoff prices at the
134134 pool members' locations, including pools in which pool members
135135 from more than one state simultaneously combine pari-mutuel
136136 pools to form an interstate common pool;
137137 N. "jockey club" means an organization that
138138 administers thoroughbred registration records and registers
139139 thoroughbreds;
140140 O. "licensed premises" means land, together with
141141 all buildings, other improvements and personal property located
142142 on the land, that is under the direct control of a racetrack
143143 licensee, including the restricted areas, grandstand and public
144144 parking areas;
145145 P. "licensee" means a person licensed by the
146146 commission and includes a holder of an occupational, secondary
147147 or racetrack license;
148148 Q. "occupational license" means a license issued by
149149 the commission to a vendor or to a person having access to a
150150 restricted area on the licensed premises, including a horse
151151 owner, trainer, jockey, agent, apprentice, groom, exercise

180180 person, veterinarian, valet, farrier, starter, clocker, racing
181181 secretary, pari-mutuel clerk and other personnel designated by
182182 the commission whose work, in whole or in part, is conducted
183183 around racehorses or pari-mutuel betting windows;
184184 R. "pari-mutuel wagering" means a system of
185185 wagering in which bets on a live or simulcast horse race are
186186 pooled and held by the racetrack licensee for distribution of
187187 the total amount, less the deductions authorized by law, to
188188 holders of winning tickets; "pari-mutuel wagering" does not
189189 include bookmaking or pool selling;
190190 S. "pari-mutuel wagering pool" means the money
191191 wagered on a specific horse race through pari-mutuel wagering;
192192 T. "practical breeder" means a person who has
193193 practical experience in breeding horses, although the person
194194 may not be actively involved in breeding horses;
195195 U. "primary residence" means the domicile where a
196196 person resides for most of the year, and, if the person is
197197 temporarily out of state, the address where a person will
198198 return when the person returns to New Mexico or the address
199199 that a person uses for purposes of a driver's license, passport
200200 or voting;
201201 V. "quarter horse" means a racehorse that is
202202 registered with the American quarter horse association or any
203203 successor association;
204204 W. "race meet" means a period of time within dates

236236 X. "racehorse" means a quarter horse or
237237 thoroughbred that is bred and trained to compete in horse
238238 races;
239239 Y. "racetrack license" means a license to conduct
240240 horse races issued by the commission;
241241 Z. "racetrack licensee" means a person who has been
242242 issued a racetrack license;
243243 AA. "racing grounds" means the area of the
244244 restricted area of licensed premises used for the purpose of
245245 conducting horse races and all activities ancillary to the
246246 conduct of horse races, including the track, stable area,
247247 jockey's quarters and horse training areas;
248248 BB. "retainage" means money that is retained from
249249 wagers on win, place and show and on exotic wagers by a
250250 racetrack licensee pursuant to the Horse Racing Act;
251251 CC. "restricted areas" means the stable area, the
252252 area behind the pari-mutuel betting windows and anywhere on the
253253 racing grounds;
254254 DD. "secondary licensee" means all officers,
255255 directors, shareholders, lenders or holders of evidence of
256256 indebtedness of a corporation or legal entity owning a horse
257257 racetrack, and all persons holding a direct or indirect

287287 including interests or positions that deal with the funds of
288288 the racetrack or that are administrative, policymaking or
289289 supervisory;
290290 EE. "simulcast" means a transmission of a live
291291 audiovisual broadcast of a horse race being run at a horse
292292 racetrack other than the horse racetrack or other licensed
293293 facility at which the broadcast is being received for viewing
294294 pursuant to a simulcasting contract;
295295 FF. "stakes race" means a horse race in which
296296 nominations or entry or starting fees contribute to the purse;
297297 an overnight race is not a stakes race;
298298 GG. "steward" means an employee of the commission
299299 who supervises horse races and oversees a race meet while in
300300 progress, including holding hearings regarding licensees and
301301 enforcing the rules of the commission and the horse racetrack;
302302 HH. "takeout" means amounts authorized by statute
303303 to be deducted from the pari-mutuel wagers;
304304 II. "thoroughbred" means a racehorse that is
305305 registered with the jockey club;
306306 JJ. "track" means the surfaced oval area on which
307307 horse races are conducted; and
308308 KK. "vendor" means a person who provides goods or
309309 services to or in the racing grounds or restricted area of the
310310 licensed premises of a horse racetrack."

339339 SECTION 2. A new section of the Horse Racing Act is
340340 enacted to read:
341341 "[NEW MATERIAL] RACE MEETS--FIFTEEN-WEEK MINIMUM--LIVE
342342 RACING DAYS.--Live racing shall begin on the first day of a
343343 race meet authorized for a racetrack licensee and shall
344344 conclude on the final day of the authorized race meet. A race
345345 meet shall be composed of three live race days for each week of
346346 the race meet with at least ten live races per day for a
347347 racetrack licensee that paid gaming tax to the state on its net
348348 take in an amount equal to eight million dollars ($8,000,000)
349349 or less in the prior fiscal year or four live race days for
350350 each week of the race meet with at least nine live races per
351351 day for a racetrack licensee that paid gaming tax to the state
352352 on its net take in an amount greater than eight million dollars
353353 ($8,000,000) in the prior fiscal year. There shall be a lapse
354354 of no more than three consecutive days in live racing from the
355355 date a race meet ends at the racing grounds of one racetrack
356356 licensee and the beginning of a race meet for another racetrack
357357 licensee. A race meet shall be a minimum of fifteen weeks
358358 long."
359359 SECTION 3. EFFECTIVE DATE.--The effective date of the
360360 provisions of this act is July 1, 2025.
