2949 RELATING TO PROFESSIONAL PSYCHOLOGISTS; AMENDING THE
3050 PROFESSIONAL PSYCHOLOGIST ACT; ADDING CERTAIN PRESCRIBING
3151 PSYCHOLOGISTS WITH INDEPENDENT EXPERIENCE IN PRESCRIBING
3252 PSYCHOTROPIC MEDICATION TO THE DEFINITION OF "INDEPENDENTLY
3353 LICENSED PRESCRIBING CLINICIAN".
3454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3555 SECTION 1. Section 61-9-3 NMSA 1978 (being Laws 1963,
3656 Chapter 92, Section 3, as amended) is amended to read:
3757 "61-9-3. DEFINITIONS.--As used in the Professional
3858 Psychologist Act:
3959 A. "board" means the New Mexico state board of
4060 psychologist examiners;
4161 B. "conditional prescription certificate" means a
4262 document issued by the board to a licensed psychologist that
43-permits the holder to prescribe psychotropic medication under
44-the supervision of a supervising clinician pursuant to the
45-Professional Psychologist Act;
46-C. "independently licensed prescribing clinician"
47-means a licensed physician, osteopathic physician,
48-prescribing psychologist who has at least four years of
49-independent experience in prescribing psychotropic medication
50-to treat behavioral and emotional conditions and mental
51-illness, nurse practitioner, psychiatric nurse practitioner SB 53

81102 E. "prescribing psychologist" means a licensed
82103 psychologist who holds a valid prescription certificate;
83104 F. "prescription certificate" means a document
84-issued by the board to a licensed psychologist that permits
85-the holder to prescribe psychotropic medication pursuant to
86-the Professional Psychologist Act;
105+issued by the board to a licensed psychologist that permits the
106+holder to prescribe psychotropic medication pursuant to the
107+Professional Psychologist Act;
87108 G. "psychotropic medication" means a controlled
88109 substance or dangerous drug that may not be dispensed or
89110 administered without a prescription but is limited to only
90111 those agents related to the diagnosis and treatment or
91-management of mental, nervous, emotional, behavioral,
92-substance use or cognitive disorders, including the
93-management of or protection from side effects that are a
94-direct result from the use of those agents, whose use is
95-consistent with the standards of practice for clinical
96-psychopharmacology;
97-H. "psychologist" means a person who engages in
98-the practice of psychology or holds the person's self out to
99-the public by any title or description of services
100-representing the person as a psychologist, which incorporates
101-the words "psychological", "psychologist", "psychology", or
102-when a person describes the person's self as above and, under SB 53

143-is received for services rendered. The practice of
144-psychology includes psychological testing or
145-neuropsychological testing and the evaluation or assessment
146-of personal characteristics such as intelligence,
147-personality, abilities, interests, aptitudes and
148-neuropsychological functioning; counseling, psychoanalysis,
149-psychotherapy, hypnosis, biofeedback, behavior analysis and
150-therapy; diagnosis and treatment of a mental and emotional
151-disorder or disability, alcoholism and substance abuse,
152-disorders of habit or conduct and the psychological aspects
153-of physical illness, accident, injury and disability; and SB 53

158+methods and procedures for the purpose of preventing or
159+eliminating symptomatic, maladaptive or undesired behavior and
