100100 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
101101 SECTION 1. Section 9-3-5 NMSA 1978 (being Laws 1977,
102102 Chapter 257, Section 6, as amended) is amended to read:
103103 "9-3-5. SECRETARY--DUTIES AND GENERAL POWERS.--
104104 A. The secretary of corrections is responsible to
105105 the governor for the operation of the corrections department.
106106 It is [his] the secretary's duty to manage all operations of
107107 the department and to administer and enforce the laws with
108108 which [he] the secretary or the department is charged.
109109 B. To perform [his] the secretary's duties, the
110110 secretary has every power expressly enumerated in the laws,
111111 whether granted to the secretary of the department or any
112112 division of the department, except where authority conferred
113113 upon any division is explicitly exempted from the secretary's
114114 authority by statute. In accordance with these provisions, the

144144 (1) except as otherwise provided in the
145145 Corrections Department Act, exercise general supervisory and
146146 appointing authority over all department employees, subject to
147147 any applicable personnel laws and [regulations ] rules;
148148 (2) delegate authority to subordinates as [he ]
149149 the secretary deems necessary and appropriate, clearly
150150 delineating such delegated authority and the limitations
151151 thereto;
152152 (3) organize the department into those
153153 organizational units [he ] the secretary deems will enable it to
154154 function most efficiently, subject to any provisions of law
155155 requiring or establishing specific organizational units;
156156 (4) within the limitations of available
157157 appropriations and applicable laws, employ and fix the
158158 compensation of those persons necessary to discharge [his ] the
159159 secretary's duties, including incentive and stipend programs
160160 for academy and specialty trainers ;
161161 (5) take administrative action by issuing
162162 orders and instructions, not inconsistent with the law, to
163163 assure implementation of and compliance with the provisions of
164164 law for whose administration or execution [he ] the secretary is
165165 responsible and to enforce those orders and instructions by
166166 appropriate administrative action or actions in the courts;
167167 (6) conduct research and studies that will

197197 services to the [citizens ] residents of the state;
198198 (7) provide courses of instruction and
199199 practical training for employees of the department, [and ] other
200200 persons involved in the administration of programs [with the
201201 objective of improving the operations and efficiency of
202202 administration] and a county detention officer ;
203203 (8) prepare an annual budget of the
204204 department;
205205 (9) provide cooperation, at the request of
206206 heads of administratively attached agencies, in order to:
207207 (a) minimize or eliminate duplication of
208208 services and jurisdictional conflicts;
209209 (b) coordinate activities and resolve
210210 problems of mutual concern; and
211211 (c) resolve by agreement the manner and
212212 extent to which the department shall provide budgeting,
213213 [record-keeping] recordkeeping and related clerical assistance
214214 to administratively attached agencies;
215215 (10) appoint, with the governor's consent, a
216216 "director" for each division. These appointed positions are
217217 exempt from the provisions of the Personnel Act. Persons
218218 appointed to these positions shall serve at the pleasure of the
219219 secretary;
220220 (11) give bond as provided in the Surety Bond

249249 Act. The department shall pay the costs of the bonds; and
250250 (12) require performance bonds of such
251251 department employees and officers as [he ] the secretary deems
252252 necessary, as provided in the Surety Bond Act. The department
253253 shall pay the costs of the bonds.
254254 C. The secretary may apply for and receive, with
255255 the governor's approval, in the name of the department any
256256 public or private funds, including United States government
257257 funds, available to the department to carry out its programs,
258258 duties or services.
259259 D. Where functions of departments overlap or a
260260 function assigned to one department could better be performed
261261 by another department, a secretary may recommend appropriate
262262 legislation to the next session of the legislature for its
263263 approval.
264264 E. The secretary may make and adopt such reasonable
265265 [and] procedural rules [and regulations ] as may be necessary to
266266 carry out the duties of the department and its divisions. No
267267 rule [or regulation] promulgated by the director of any
268268 division in carrying out the functions and duties of the
269269 division shall be effective until approved by the secretary.
270270 Unless otherwise provided by statute, no [regulation ] rule
271271 affecting any person or agency outside the department shall be
272272 adopted, amended or repealed without a public hearing on the
273273 proposed action before the secretary or a hearing officer

303303 held in Santa Fe unless otherwise permitted by statute. Notice
304304 of the subject matter of the [regulation ] rule, the action
305305 proposed to be taken, the time and place of the hearing, the
306306 manner in which interested persons may present their views and
307307 the method by which copies of the proposed [regulation ] rule or
308308 proposed amendment or repeal of an existing [regulation ] rule
309309 may be obtained shall be published once at least thirty days
310310 prior to the hearing date in a newspaper of general circulation
311311 and mailed at least thirty days prior to the hearing date to
312312 all persons who have made a written request for advance notice
313313 of hearing. All rules [and regulations ] shall be filed in
314314 accordance with the State Rules Act.
315315 F. Behavioral health services, including mental
316316 health and substance abuse services, provided by the department
317317 for persons under the department's supervision shall be in
318318 compliance with the requirements of Section 9-7-6.4 NMSA 1978.
319319 The corrections department shall enforce health care authority
320320 orders and rules pertaining to behavioral health in
321321 corrections."
322322 SECTION 2. Section 9-3-10 NMSA 1978 (being Laws 1977,
323323 Chapter 257, Section 11, as amended) is amended to read:

356356 B. The New Mexico sentencing commission shall be
357357 composed of twenty-seven members. Appointed members shall
358358 serve at the pleasure of the appointing authority. The
359359 commission shall reflect reasonable geographical and urban-
360360 rural balances and regard for the incidence of crime and the
361361 distribution and concentration of law enforcement services in
362362 the state. The commission shall consist of the following
363363 individuals or their designees:
364364 (1) the attorney general;
365365 (2) a district attorney appointed by the New
366366 Mexico district attorney's association or its successor agency;
367367 (3) the chief public defender;
368368 (4) two district court judges, one of whom
369369 shall be a children's court judge, appointed by the district
370370 and metropolitan judges association or its successor agency;
371371 (5) a magistrate judge appointed by the chief
372372 justice of the supreme court;
373373 (6) the dean of the university of New Mexico
374374 school of law;
375375 (7) the secretary of corrections;
376376 (8) the secretary of public safety;
377377 (9) the secretary of children, youth and
378378 families;

428428 state bar association; and

430430 governor who is a representative of a New Mexico victims'

463463 D. The New Mexico sentencing commission shall:
464464 (1) hold meetings at times and for periods as
465465 the commission deems necessary;
466466 (2) hire staff as needed to assist the
467467 commission in the performance of its duties;
468468 (3) prepare an annual budget;
469469 (4) establish policies for the operation of
470470 the commission and supervision of the activities of commission
471471 staff;
472472 (5) advise the executive, judicial and
473473 legislative branches of government on policy matters relating
474474 to criminal and juvenile justice;
475475 (6) make recommendations to the legislature
476476 concerning proposed changes to laws relating to the criminal
477477 and juvenile justice systems that the commission determines
478478 would improve those systems;
479479 (7) annually assess, monitor and report to the
480480 legislature on the impact of any enacted sentencing standards
481481 and guidelines on state and local correctional resources and
482482 programs and the need for further sentencing reform;
483483 (8) when developing proposed sentencing
484484 reform:
485485 (a) study sentencing models in other

526526 database for simulating the impact of various sentencing

528528 (e) study the full range of prison,
529529 nonprison and intermediate sanctions;
530530 (f) determine the principal purpose for
531531 criminal sanctions;
532532 (g) rank criminal offenses by degree of
533533 seriousness;
534534 (h) determine the role of criminal
535535 history in making criminal sentencing decisions;
536536 (i) define dispositional policy that
537537 determines when adult felony offenders are confined in state

674674 and statewide criminal justice systems and programs and
675675 supporting, encouraging and accomplishing information sharing
676676 among criminal justice agencies and criminal justice

678678 (16) create a public crime data dashboard in
679679 conjunction with the department of public safety pursuant to
680680 Section 29-3-11 NMSA 1978, to be hosted on the website of the
681681 New Mexico sentencing commission;

686686 data-sharing network, data dashboard and data analysis pursuant

688688 subsection. The rules shall include procedures to:
689689 (a) fulfill any requirements related to
690690 data privacy, security and protection so that information
691691 access and sharing [is ] are permitted for authorized purposes,
692692 as defined by law, court order or for business practices that
693693 are a necessary component of the requesting agency's duties and
694694 functions and [is] are compatible with the purpose and
695695 expectations of use under which the information was collected;
696696 (b) guide participating agencies to
697697 ensure accuracy, completeness, currency and reliability of

738738 users who access the network and the data dashboard .
739739 E. The members of the New Mexico sentencing
740740 commission shall be paid pursuant to the Per Diem and Mileage
741741 Act and shall receive no other perquisite, compensation or
742742 allowance.
743743 F. The New Mexico sentencing commission is
744744 administratively attached to the office of the governor."
745745 SECTION 3. A new section of the Department of Public
746746 Safety Act is enacted to read:
747747 "[NEW MATERIAL] FORENSIC LABORATORY BUREAU FUND.--The
748748 "forensic laboratory bureau fund" is created as a nonreverting
749749 fund in the state treasury. The fund consists of
750750 appropriations, gifts, grants and donations. The department

782782 evidence processing. Disbursements from the fund shall be made
783783 by warrant of the secretary of finance and administration
784784 pursuant to vouchers signed by the secretary of public safety
785785 or the secretary's authorized representative."
786786 SECTION 4. Section 21-22D-6 NMSA 1978 (being Laws 1995,
787787 Chapter 144, Section 21, as amended) is amended to read:
788788 "21-22D-6. AWARD CRITERIA--CONTRACT TERMS--PAYMENT.--
789789 A. Prior to receiving an award, the health
790790 professional shall file with the higher education department a
791791 declaration of intent to practice as a health professional in
792792 areas of New Mexico designated as underserved by the
793793 department. The department shall consult with the department
794794 of health when designating areas as underserved.
795795 B. Award criteria shall provide that:
796796 (1) amounts shall be dependent upon the
797797 location of the practice, the applicant's total health
798798 professional education indebtedness and characteristics of the
799799 practice;
800800 (2) preference in making awards shall be to
801801 individuals who have graduated from a New Mexico post-secondary
802802 educational institution;
803803 (3) recruitment awards shall be made to

17441744 regional law enforcement training facility and who is
17451745 currently certifiable by the academy, which employee is
17461746 responsible for the prevention and detection of crime or the
17471747 enforcement of the penal, or traffic or highway laws of this
17481748 state. The term specifically includes deputy sheriffs.
17491749 Sheriffs are eligible to attend the academy and are eligible
17501750 to receive certification as provided in the Law Enforcement
17511751 Training Act. As used in this subsection, "commissioned"
17521752 means an employee of a law enforcement agency who is
17531753 authorized by a sheriff or chief of police to apprehend,
17541754 arrest and bring before the court all violators within the
17551755 law enforcement agency's jurisdiction; and
17561756 [K.] L. "certified regional law enforcement
17571757 training facility" means a law enforcement training facility

17971797 create a training program for a county detention officer,
17981798 subject to review and approval by the jail administrator.
17991799 B. A county detention officer is eligible to
18001800 attend the academy and receive certification upon successful
18011801 completion of the program.
18021802 C. Per diem, mileage and tuition expenses of a
18031803 county detention officer shall be paid for by the detention
18041804 and corrections workforce capacity building fund for
18051805 attending and completing the training.
18061806 D. As used in Subsection A of this section, "jail
18071807 administrator" means the person hired by a county or
18081808 municipality or a combination of these who supervises the
18091809 entire operation of the jail and reports directly to the
18101810 administrative head of the local governmental entity or local

20672067 properly addressed, can reduce that person's likelihood of
20682068 committing future criminal behavior ."

21712171 an individual is experiencing a behavioral health crisis and
21722172 requires nonmedical intervention, the law enforcement officer
21732173 may resolve the intervention without charges on a voluntary

23882388 shall have the case placed on the calendar in the judicial
23892389 district from which the case originated and the statute of
23902390 limitations shall be tolled the entire period the defendant
23912391 was participating in the program.
23922392 D. If participation in the treatment court
