5353 OLDER AND DIAGNOSED WITH A CHRONIC DEBILITATING DISEASE; MAKING
5454 AN APPROPRIATION; DECLARING AN EMERGENCY.
5555 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5656 SECTION 1. A new section of the Public Assistance Act is
5757 enacted to read:
5858 "[NEW MATERIAL] HOME-BASED HEALTH CARE MEDICAID WAIVER.--
5959 A. As used in this section:
6060 (1) "chronic debilitating disease" means a
6161 disease that persists over a long period of time, impairs a
6262 person's physical or mental abilities and significantly impacts

9090 a person's quality of life; and
9191 (2) "home-based health care" means health care
9292 services provided to a person in the person's home or place of
9393 residence. "Home-based health care" includes the following
9494 services provided in a person's home or place of residence:
9595 (a) skilled nursing;
9696 (b) home health aide services;
9797 (c) palliative care;
9898 (d) primary care;
9999 (e) personal care services;
100100 (f) in-home respite care;
101101 (g) physical therapy;
102102 (h) occupational therapy;
103103 (i) speech therapy; and
104104 (j) non-emergency medical
105105 transportation.
106106 B. No later than August 1, 2025, the authority
107107 shall submit an application to the federal centers for medicare
108108 and medicaid services for authorization to develop and
109109 implement a medicaid waiver program that would provide home-
110110 based health care services to individuals who are sixty-five
111111 years of age or older and diagnosed with a chronic debilitating
112112 disease. If the federal centers for medicare and medicaid
113113 services approves the waiver application, the authority shall
114114 promulgate rules to implement and administer the waiver

143143 program, subject to the availability of state funds and
144144 consistent with the federal Social Security Act. The rules
145145 shall:
146146 (1) be developed in consultation with persons
147147 with chronic debilitating diseases and health care providers;
148148 (2) create an application process to allow
149149 people to apply to participate in the waiver program; and
150150 (3) provide for a system of home-based health
151151 care services that seniors with chronic debilitating diseases
152152 can access."
153153 SECTION 2. APPROPRIATION.--Two million dollars
154154 ($2,000,000) is appropriated from the general fund to the
155155 health care authority for expenditure in fiscal years 2025 and
156156 2026 to develop a waiver application for a home-based health
157157 care program for people who are sixty-five years of age or
158158 older and diagnosed with a chronic debilitating disease. Any
159159 unexpended or unencumbered balance remaining at the end of
160160 fiscal year 2026 shall revert to the general fund.
161161 SECTION 3. EMERGENCY.--It is necessary for the public
162162 peace, health and safety that this act take effect immediately.
