33	33	RELATING TO LIVESTOCK; ENACTING A NEW SECTION OF THE LIVESTOCK
34	34	CODE; RESTRICTING ACCESS TO CERTAIN INFORMATION DURING AN
35	35	EPIDEMIC.
36	36	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
37	37	SECTION 1. A new section of The Livestock Code, Section
38	38	77-3-13.1 NMSA 1978, is enacted to read:
39	39	"77-3-13.1. [NEW MATERIAL ] RESTRICTIONS ON INFORMATION
40	40	ACCESS.--
41	41	A. When the board or any of its authorized
42	42	representatives finds pursuant to Section 77-3-13 NMSA 1978
43	43	that a disease has become epidemic or exists in a locality in a
44	44	country, state or territory beyond the limits of this state,
45	45	the board or any of its authorized representatives may deny
46	46	access to the following information regarding persons involved

74	74	with the livestock industry if the dissemination of such
75	75	information would cause harm to such persons or would be
76	76	contrary to the public interest:
77	77	(1) specific operational details of livestock
78	78	operations, including:
79	79	(a) ownership, numbers, locations and
80	80	movements of livestock;
81	81	(b) financial information;
82	82	(c) the purchase and sale of livestock;
83	83	(d) account numbers or unique
84	84	identifiers issued by government or private entities;
85	85	(e) operational protocols; and
86	86	(f) participation in an all-hazards
87	87	security system;
88	88	(2) information related to livestock disease
89	89	or injury that:
90	90	(a) would identify a person or location;
91	91	or
92	92	(b) contains confidential data pursuant
93	93	to the veterinarian-patient-client privilege pursuant to
94	94	Subsection S of Section 16.25.3.8 NMAC; and
95	95	(3) records of ongoing investigations that
96	96	pertain to livestock.
97	97	B. Information shall not be withheld pursuant to
98	98	Subsection A of this section if an investigation by the board

127	127	has concluded and the person being investigated is found by the
128	128	board or its authorized representatives to have violated any
129	129	provision of The Livestock Code that pertains to livestock.
130	130	C. If access to information is denied pursuant to
131	131	Subsection A of this section, the board or any of its
132	132	authorized representatives shall redact confidential
133	133	information and make the remaining information available for
134	134	disclosure.
135	135	D. Nothing in this section shall be construed to
136	136	authorize the board or any of its authorized representatives to
137	137	obtain information not otherwise permitted by law.
138	138	E. Nothing in this section shall:
139	139	(1) preclude a person in interest from
140	140	accessing the person's own information;
141	141	(2) prevent the release of biological
142	142	livestock samples to authorized third-party entities for
143	143	scientific testing, so long as the testing entity agrees to
144	144	maintain the confidentiality of the information it receives; or
145	145	(3) apply when the board or its authorized
146	146	representatives determine that disclosure of livestock
147	147	information is necessary to prevent or address an immediate
148	148	threat to the health and safety of a person or animal.
149	149	F. When disclosing information pursuant to
150	150	Subsection E of this section, the board or its authorized
151	151	representatives shall release only as much information as is
