4949 RELATING TO CHILDREN; EXPANDING ELIGIBILITY FOR THE FOSTERING
5050 CONNECTIONS PROGRAM.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. Section 32A-26-3 NMSA 1978 (being Laws 2019,
5353 Chapter 149, Section 3, as amended) is amended to read:
5454 "32A-26-3. FOSTERING CONNECTIONS PROGRAM--ELIGIBILITY.--
5555 A. The "fostering connections program" is
5656 established in the department. The department shall make the
5757 fostering connections program available, on a voluntary basis,
5858 to an eligible adult who:
5959 (1) has attained at least eighteen years of
6060 age and who is younger than:
6161 (a) as of July 1, [2020 ] 2021, nineteen
6262 years of age;

9090 (b) as of July 1, [2021 ] 2022, twenty
9191 years of age; and
9292 (c) after July 1, [2022 ] 2023, twenty-
9393 one years of age;
9494 (2) meets one of the following criteria:
9595 (a) has attained at least eighteen years
9696 of age [and] while: 1) [was adjudicated ] in the legal custody
9797 of the department as a result of abuse and neglect proceedings,
9898 families in need of court-ordered services proceedings or a
9999 voluntary placement agreement pursuant to the Children's Code
100100 or its equivalent under tribal law; 2) [was ] subject to a court
101101 order or voluntary placement agreement that placement and care
102102 be the responsibility of the department or the Indian tribe
103103 that entered into an agreement with the department; and 3)
104104 [was] subject to [an] out-of-home placement [order ]; or
105105 (b) attained at least fourteen years of
106106 age when a guardianship assistance agreement or adoption
107107 assistance agreement was in effect and whose guardianship
108108 assistance agreement or adoption assistance agreement was
109109 terminated or the guardian or parents are no longer willing to
110110 provide emotional or financial support after the child attained
111111 eighteen years of age;
112112 (3) is:
113113 (a) completing secondary education or an
114114 educational program leading to an equivalent credential;

143143 (b) enrolled in an institution that
144144 provides post-secondary or vocational education;
145145 (c) employed for at least eighty hours
146146 per month;
147147 (d) participating in a program or
148148 activity designed to promote employment or remove barriers to
149149 employment; or
150150 (e) incapable of doing any of the
151151 activities described in Subparagraphs (a) through (d) of this
152152 paragraph due to a medical or behavioral condition that is
153153 supported by regularly updated information in the transition
154154 plan; and
155155 (4) enters into a voluntary services and
156156 support agreement with the department pursuant to the Fostering
157157 Connections Act.
158158 B. The citizenship or immigration status of a young
159159 adult shall not be a factor when determining the young adult's
160160 eligibility pursuant to this section."
