49	49	RELATING TO CHILDREN; EXPANDING ELIGIBILITY FOR THE FOSTERING
50	50	CONNECTIONS PROGRAM.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 32A-26-3 NMSA 1978 (being Laws 2019,
53	53	Chapter 149, Section 3, as amended) is amended to read:
54	54	"32A-26-3. FOSTERING CONNECTIONS PROGRAM--ELIGIBILITY.--
55	55	A. The "fostering connections program" is
56	56	established in the department. The department shall make the
57	57	fostering connections program available, on a voluntary basis,
58	58	to an eligible adult who:
59	59	(1) has attained at least eighteen years of
60	60	age and who is younger than:
61	61	(a) as of July 1, [2020 ] 2021, nineteen
62	62	years of age;

90	90	(b) as of July 1, [2021 ] 2022, twenty
91	91	years of age; and
92	92	(c) after July 1, [2022 ] 2023, twenty-
93	93	one years of age;
94	94	(2) meets one of the following criteria:
95	95	(a) has attained at least eighteen years
96	96	of age [and] while: 1) [was adjudicated ] in the legal custody
97	97	of the department as a result of abuse and neglect proceedings,
98	98	families in need of court-ordered services proceedings or a
99	99	voluntary placement agreement pursuant to the Children's Code
100	100	or its equivalent under tribal law; 2) [was ] subject to a court
101	101	order or voluntary placement agreement that placement and care
102	102	be the responsibility of the department or the Indian tribe
103	103	that entered into an agreement with the department; and 3)
104	104	[was] subject to [an] out-of-home placement [order ]; or
105	105	(b) attained at least fourteen years of
106	106	age when a guardianship assistance agreement or adoption
107	107	assistance agreement was in effect and whose guardianship
108	108	assistance agreement or adoption assistance agreement was
109	109	terminated or the guardian or parents are no longer willing to
110	110	provide emotional or financial support after the child attained
111	111	eighteen years of age;
112	112	(3) is:
113	113	(a) completing secondary education or an
114	114	educational program leading to an equivalent credential;

143	143	(b) enrolled in an institution that
144	144	provides post-secondary or vocational education;
145	145	(c) employed for at least eighty hours
146	146	per month;
147	147	(d) participating in a program or
148	148	activity designed to promote employment or remove barriers to
149	149	employment; or
150	150	(e) incapable of doing any of the
151	151	activities described in Subparagraphs (a) through (d) of this
152	152	paragraph due to a medical or behavioral condition that is
153	153	supported by regularly updated information in the transition
154	154	plan; and
155	155	(4) enters into a voluntary services and
156	156	support agreement with the department pursuant to the Fostering
157	157	Connections Act.
158	158	B. The citizenship or immigration status of a young
159	159	adult shall not be a factor when determining the young adult's
160	160	eligibility pursuant to this section."
