55	55	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
56	56	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
57	57	cited as the "Right to Repair Consumer Electronics Act".
58	58	SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
59	59	Right to Repair Consumer Electronics Act:
60	60	A. "authorized service provider" means a person
61	61	that has an arrangement with an original equipment manufacturer
62	62	pursuant to which the original equipment manufacturer grants to

91	91	proprietary identifier when offering to diagnose, maintain or
92	92	repair equipment in the name of or on behalf of the original
93	93	equipment manufacturer. "Authorized service provider" includes
94	94	an original equipment manufacturer that offers the services of
95	95	diagnosis, maintenance or repair of its own equipment;
96	96	B. "certifying entity" means a person that engages
97	97	in evaluating and certifying the technical capabilities and
98	98	competence of independent repair providers in accordance with
99	99	standards that the certifying entity or an original equipment
100	100	manufacturer specifies;
101	101	C. "consumer electronic equipment" means a product
102	102	that:
103	103	(1) is tangible personal property;
104	104	(2) functions, in whole or in part, on the
105	105	basis of digital electronics that are embedded within or
106	106	attached to the product;
107	107	(3) is generally used for personal, family or
108	108	household purposes;
109	109	(4) is sold, used or supplied in New Mexico;
110	110	and
111	111	(5) might be, but is not necessarily, capable
112	112	of attachment to or installation in real property;
113	113	D. "documentation" means a manual, diagram,
114	114	reporting output, service code description, schematic diagram,

144	144	enables a person to diagnose, maintain or repair consumer
145	145	electronic equipment;
146	146	E. "independent repair provider" means a person
147	147	that engages in the business of diagnosing, maintaining or
148	148	repairing consumer electronic equipment in New Mexico but is
149	149	not an authorized service provider and that possesses a valid
150	150	and unexpired certification from a certifying entity;
151	151	F. "medical device" means an instrument, apparatus,
152	152	implement, machine, contrivance, implant, in vitro reagent or
153	153	other similar or related article, including a component, part
154	154	or accessory, that is:
155	155	(1) recognized in an official compendium;
156	156	(2) intended for use in the diagnosis of
157	157	disease or other conditions or in the cure, mitigation,
158	158	treatment or prevention of disease in humans or other animals;
159	159	or
160	160	(3) intended to affect the structure or a
161	161	function of the human body or the bodies of other animals and
162	162	that does not achieve its principal intended purposes through
163	163	chemical action within or on the human body or the bodies of
164	164	other animals and that is not dependent on being metabolized
165	165	for achievement of its principal intended purposes;
166	166	G. "original equipment manufacturer" means a person
167	167	engaged in the business of selling, leasing or otherwise

197	197	on behalf of itself;
198	198	H. "owner" means a person that owns or leases
199	199	consumer electronic equipment purchased or used in New Mexico;
200	200	I. "part" means a new or used replacement component
201	201	for consumer electronic equipment made available for the
202	202	purpose of maintaining or repairing consumer electronic
203	203	equipment;
204	204	J. "parts pairing" means an original equipment
205	205	manufacturer's practice of using software to identify component
206	206	parts through a unique identifier;
207	207	K. "repair certification" means evidence that an
208	208	independent repair provider has the technical and financial
209	209	capability and competence necessary to repair consumer
210	210	electronic equipment;
211	211	L. "tool" means software, a hardware implement or
212	212	an apparatus by means of which a person can diagnose, maintain
213	213	or repair consumer electronic equipment, including software, or
214	214	a mechanism that provisions, programs or pairs a new part;
215	215	M. "trade secret" means all forms and types of
216	216	financial, business, scientific, technical, economic or
217	217	engineering information, including patterns, plans,
218	218	compilations, program devices, formulas, designs, prototypes,
219	219	methods, techniques, processes, procedures, programs or codes,
220	220	whether tangible or intangible, and whether or how stored,

250	250	graphically, photographically or in writing if:
251	251	(1) the owner of the information has taken
252	252	reasonable measures to keep the information secret; and
253	253	(2) the information derives independent
254	254	economic value, actual or potential, from not being generally
255	255	known to, and not being readily ascertainable through proper
256	256	means by, another person who can obtain economic value from the
257	257	disclosure or use of the information; and
258	258	N. "video game console" means a computing device
259	259	and its components and peripherals that is intended primarily
260	260	for interactive video games. "Video game console" does not
261	261	include a general purpose personal computer that has the
262	262	capability to run video games alongside other computing
263	263	functions.
264	264	SECTION 3. [NEW MATERIAL] ORIGINAL EQUIPMENT
265	265	MANUFACTURER'S OBLIGATIONS REGARDING REPAIR SERVICES.--
266	266	A. An original equipment manufacturer shall make
267	267	available to an owner or an independent repair provider on fair
268	268	and reasonable terms all documentation, tools or parts that the
269	269	original equipment manufacturer makes available to an
270	270	authorized service provider to diagnose, maintain or repair
271	271	consumer electronic equipment that the original equipment
272	272	manufacturer makes or sells and that is sold or used in this
273	273	state.

303	303	manufactured, sold or used in New Mexico after January 1, 2026,
304	304	an original equipment manufacturer shall not use parts pairing
305	305	to:
306	306	(1) prevent or inhibit an owner or independent
307	307	repair provider from installing or enabling the function of an
308	308	otherwise functional part or a component of consumer electronic
309	309	equipment;
310	310	(2) reduce the functionality or performance of
311	311	consumer electronic equipment; or
312	312	(3) cause consumer electronic equipment to
313	313	display misleading alerts or warnings about unidentified parts
314	314	that the owner or independent repair provider cannot
315	315	immediately dismiss.
316	316	SECTION 4. [NEW MATERIAL] FAIR AND REASONABLE TERMS AND
317	317	COSTS REQUIRED FOR DOCUMENTATION, TOOLS AND PARTS.--
318	318	Documentation, tools and parts provided by an original
319	319	equipment manufacturer shall be offered at fair and reasonable
320	320	terms and costs. The original equipment manufacturer shall:
321	321	A. make documentation available at no charge,
322	322	except that the original equipment manufacturer may charge for
323	323	the reasonable and actual costs of preparing, printing and
324	324	sending all documentation that is requested;
325	325	B. make tools used to diagnose, maintain or repair
326	326	consumer electronic equipment available at no charge and

356	356	cost-effective use of the tools, except that the original
357	357	equipment manufacturer may charge for the reasonable and actual
358	358	costs of preparing and shipping physical tools;
359	359	C. make parts available directly or through an
360	360	authorized service provider to an owner or independent repair
361	361	provider at costs and on terms that are equivalent to the most
362	362	favorable costs and terms at which the original equipment
363	363	manufacturer offers the parts to an authorized service provider
364	364	and that:
365	365	(1) accounts for a discount, rebate,
366	366	convenient means of delivery, means of enabling fully restored
367	367	and updated functionality, rights of use or other incentive or
368	368	preference the original equipment manufacturer offers to an
369	369	authorized service provider or that imposes an additional cost,
370	370	burden or impediment on an owner or independent repair provider
371	371	that the original equipment manufacturer also imposes on an
372	372	authorized service provider;
373	373	(2) does not impose a substantial condition,
374	374	obligation or restriction that is not reasonably necessary to
375	375	enable an owner or independent repair provider to diagnose,
376	376	maintain and repair consumer electronic equipment that the
377	377	original equipment manufacturer makes or sells; and
378	378	(3) does not require an owner or independent
379	379	repair provider to become an authorized service provider; and

409	409	authorized service providers for sale to owners and independent
410	410	repair providers without:
411	411	(1) imposing allocation limitations or
412	412	advertising restrictions on the authorized service provider as
413	413	retaliation or as a means of hindering the sale of parts; or
414	414	(2) imposing a substantial condition,
415	415	obligation or restriction not reasonably necessary to enable an
416	416	owner or independent repair provider to diagnose, maintain or
417	417	repair consumer electronic equipment that the original
418	418	equipment manufacturer makes or sells.
419	419	SECTION 5. [NEW MATERIAL] LIMITATIONS OF ACT.--The Right
420	420	to Repair Consumer Electronics Act does not:
421	421	A. require an original equipment manufacturer to
422	422	disclose a trade secret or license intellectual property,
423	423	including copyrights or patents, to an independent repair
424	424	provider or an owner except as necessary to provide on fair and
425	425	reasonable terms all documentation, tools or parts used to
426	426	diagnose, maintain or repair consumer electronic equipment;
427	427	B. alter the terms of the agreement between an
428	428	original equipment manufacturer and an authorized service
429	429	provider, including the authorized service provider's
430	430	performance or provision of warranty service or recall repair
431	431	work on the original equipment manufacturer's behalf pursuant
432	432	to the agreement; provided, however, that any provision in the

462	462	original equipment manufacturer's compliance with the Right to
463	463	Repair Consumer Electronics Act is void and unenforceable;
464	464	C. impose liability on an original equipment
465	465	manufacturer for bodily injury or damage to consumer electronic
466	466	equipment that an independent repair provider or an owner
467	467	causes while diagnosing, maintaining or repairing the consumer
468	468	electronic equipment using documentation, tools or parts that
469	469	the original equipment manufacturer made available before the
470	470	date of the diagnosis, maintenance or repair; provided,
471	471	however, that an original equipment manufacturer remains
472	472	strictly liable for defects in the design or manufacture of the
473	473	consumer electronic equipment;
474	474	D. require an original equipment manufacturer to
475	475	make available special documentation, tools or parts that would
476	476	disable or override, without an owner's authorization, anti-
477	477	theft or privacy security measures that the owner sets for
478	478	consumer electronic equipment;
479	479	E. require an original equipment manufacturer to
480	480	provide to an independent repair provider or an owner a part
481	481	that the equipment manufacturer no longer makes or no longer
482	482	provides to authorized service providers;
483	483	F. prohibit parts pairing that reduces the
484	484	functionality of a battery if a thermal event occurs; or
485	485	G. apply to:

525	525	product manufactured for or service provided for use in
526	526	diagnosis or monitoring in an acute care hospital, a long-term
527	527	care facility such as a nursing home or skilled nursing
528	528	facility, a physician's office, an urgent care center, an
529	529	outpatient clinic, a home setting where health care is provided
530	530	by or at the direction of a licensed health care provider or an
531	531	emergency medical services facility or for use in diagnosis or
532	532	monitoring at a site where health care is routinely delivered
533	533	on premises that are not otherwise a health care facility, such
534	534	as a medical clinic within a school;
535	535	(c) provides heat, ventilation or air
536	536	conditioning or recharges refrigerant gases;
537	537	(d) is a system, mechanism or series of
538	538	mechanisms that generates, stores or combines generation and

574	574	accordance with an applicable utility tariff or interconnection
575	575	agreement;
576	576	(3) a vehicle, an engine, equipment or a power
577	577	source or a person that engages directly in, or acts for or is
578	578	subject to the control of another person that engages directly
579	579	in, manufacturing, assembling, distributing, selling, importing
580	580	for resale, maintaining, servicing or repairing a vehicle, an
581	581	engine, equipment or a power source with the characteristics
582	582	of:
583	583	(a) an internal combustion engine,
584	584	including the engine's fuel system or other power sources such
585	585	as an electric battery or a fuel cell, that is not used in a
586	586	motor vehicle or in a vehicle used solely for competition or
587	587	that is not subject to standards of performance for stationary
588	588	sources or emission standards for new motor vehicles or new
589	589	motor vehicle engines pursuant to the federal Clean Air Act;
590	590	(b) a vehicle or equipment that is not a
591	591	motor vehicle or a vehicle used solely for competition and is

626	626	cell, that is not used in a motor vehicle, in a vehicle used
627	627	solely for competition or in a vehicle or equipment described
628	628	in Subparagraph (b) of this paragraph or equipment that is
629	629	powered by the internal combustion engine or other power
630	630	source, together with tools, technology, attachments,
631	631	accessories, components or repair parts for the internal
632	632	combustion engine, the other power source or the equipment; or
633	633	(d) an engine or other power source,
634	634	including an electric battery or a fuel cell, that is used for
635	635	propulsion or power generation in a maritime environment or a
636	636	waterway, together with all tools, technology, attachments,
637	637	accessories, components or repair parts for the engine or the
638	638	other power source;
639	639	(4) a manufacturer, distributor or dealer of
640	640	off-road equipment or of tools, technology, attachments,
641	641	accessories, components or repair parts for off-road equipment,
642	642	including farm and utility tractors; farm implements and
643	643	machinery; equipment for forestry, industry, utilities,
644	644	construction, mining or maintaining a yard, garden or turf;

674	674	in marine environments, for sports, recreation and racing;
675	675	all-terrain vehicles; power tools; and stand-alone or
676	676	integrated mobile or stationary internal combustion engines or
677	677	power sources such as generator sets and battery or fuel cell
678	678	power; or
679	679	(5) electric toothbrushes.
680	680	SECTION 6. [NEW MATERIAL] REPAIR PROVIDER DUTIES.--
681	681	A. Before repairing consumer electronic equipment,
682	682	an authorized service provider or independent repair provider
683	683	shall:
684	684	(1) post a notice that:
685	685	(a) specifies the steps the provider
686	686	takes to ensure the privacy and the security of the customer's
687	687	consumer electronic equipment;
688	688	(b) informs the customer about the
689	689	customer's rights to privacy pursuant to the laws of this
690	690	state; and
691	691	(c) informs the customer about all
692	692	potential safety concerns about the parts being installed; and
693	693	(2) display all of the provider's repair
694	694	certifications.
695	695	B. Before repairing consumer electronic equipment,
696	696	an independent repair provider shall disclose to each customer:
697	697	(1) that the independent repair provider is

727	727	(2) whether replacement parts the independent
728	728	repair provider incorporates into repairs are used replacement
729	729	parts or are replacement parts provided by suppliers other than
730	730	the original equipment manufacturer.
731	731	SECTION 7. [NEW MATERIAL] DETERMINING VIOLATIONS OF THE
732	732	RIGHT TO REPAIR CONSUMER ELECTRONICS ACT--PRESCRIBING
733	733	PENALTIES.--
734	734	A. If the attorney general determines in response
735	735	to a complaint from a consumer that a person has or controls
736	736	information, documents, physical evidence or other material
737	737	that is relevant to an investigation of a violation of the
738	738	Right to Repair Consumer Electronics Act, or that could lead to
739	739	a discovery of relevant information in an investigation of a
740	740	violation of that act, the attorney general may execute and
741	741	cause an investigative demand to be served on the person. The
742	742	investigative demand may require that the person:
743	743	(1) appear and testify under oath at the time
744	744	and place stated in the investigative demand;
745	745	(2) answer written interrogatories; and
746	746	(3) produce relevant information, documents,
747	747	physical evidence or other material for examination at the time
748	748	and place stated in the investigative demand.
749	749	B. An investigative demand pursuant to this section
750	750	shall be served and enforced as provided in Section 57-12-12

783	783	modify or set aside the investigative demand. The petition
784	784	shall state good cause, including all privileged material.
785	785	C. Information the attorney general obtains
786	786	pursuant to this section that is a trade secret is confidential
787	787	and is not subject to public disclosure.
788	788	D. If the attorney general finds in response to a
789	789	complaint that a person has violated the Right to Repair
790	790	Consumer Electronics Act, the attorney general may bring a
791	791	civil action in the first judicial district court to:
792	792	(1) obtain an injunction to restrain the
793	793	violation; or
794	794	(2) impose a civil penalty of not more than
795	795	one thousand dollars ($1,000) for each day on which the
796	796	violation continues.
797	797	E. Civil penalties shall be deposited to the credit
798	798	of the current school fund as provided in Article 12, Section 4
799	799	of the constitution of New Mexico.
800	800	SECTION 8. [NEW MATERIAL] ATTORNEY GENERAL REPORT
801	801	REQUIRED.--The attorney general shall submit not later than
802	802	December 31, 2028 a report to the governor and legislature that
803	803	specifies the number and nature of consumer complaints from

833	833	years pertaining to original equipment manufacturers that did
834	834	not provide upon request documentation, tools, parts or other
835	835	devices or implements necessary to diagnose, maintain or repair
836	836	consumer electronic equipment that the original equipment
837	837	manufacturer makes or sells.
838	838	SECTION 9. APPLICABILITY.--
839	839	A. Except as provided in Subsection B of this
840	840	section, the provisions of Section 3 of the Right to Repair
841	841	Consumer Electronics Act apply to consumer electronic equipment
842	842	sold in this state or in use in this state on or after the
843	843	effective date of that act.
844	844	B. The provisions of Section 3 of the Right to
845	845	Repair Consumer Electronics Act do not apply to:
846	846	(1) a cell phone that was manufactured for the
847	847	first time and first sold or used in this state before July 1,
848	848	2021; or
849	849	(2) consumer electronic equipment other than a
850	850	cell phone that was manufactured for the first time and first
851	851	sold or used in this state before July 1, 2015.
852	852	SECTION 10. EFFECTIVE DATE FOR ENFORCEMENT ACTIONS BY THE
853	853	ATTORNEY GENERAL.--Section 7 of the Right to Repair Consumer
854	854	Electronics Act applies to violations of Section 3 of that act
855	855	that occur on or after July 1, 2027.
