97 | 97 | | in evaluating and certifying the technical capabilities and |
---|
98 | 98 | | competence of independent repair providers in accordance with |
---|
99 | 99 | | standards that the certifying entity or an original equipment |
---|
100 | 100 | | manufacturer specifies; |
---|
101 | 101 | | C. "consumer electronic equipment" means a product |
---|
102 | 102 | | that: |
---|
103 | 103 | | (1) is tangible personal property; |
---|
104 | 104 | | (2) functions, in whole or in part, on the |
---|
105 | 105 | | basis of digital electronics that are embedded within or |
---|
106 | 106 | | attached to the product; |
---|
107 | 107 | | (3) is generally used for personal, family or |
---|
108 | 108 | | household purposes; |
---|
109 | 109 | | (4) is sold, used or supplied in New Mexico; |
---|
110 | 110 | | and |
---|
111 | 111 | | (5) might be, but is not necessarily, capable |
---|
112 | 112 | | of attachment to or installation in real property; |
---|
113 | 113 | | D. "documentation" means a manual, diagram, |

150 | 150 | | and unexpired certification from a certifying entity; |

151 | 151 | | F. "medical device" means an instrument, apparatus, |
---|
152 | 152 | | implement, machine, contrivance, implant, in vitro reagent or |
---|
153 | 153 | | other similar or related article, including a component, part |
---|
154 | 154 | | or accessory, that is: |
---|
155 | 155 | | (1) recognized in an official compendium; |
---|
156 | 156 | | (2) intended for use in the diagnosis of |
---|
157 | 157 | | disease or other conditions or in the cure, mitigation, |
---|
158 | 158 | | treatment or prevention of disease in humans or other animals; |
---|
159 | 159 | | or |
---|
160 | 160 | | (3) intended to affect the structure or a |
---|
161 | 161 | | function of the human body or the bodies of other animals and |
---|
162 | 162 | | that does not achieve its principal intended purposes through |
---|
163 | 163 | | chemical action within or on the human body or the bodies of |
---|
164 | 164 | | other animals and that is not dependent on being metabolized |
---|
165 | 165 | | for achievement of its principal intended purposes; |

---|
205 | 205 | | manufacturer's practice of using software to identify component |
---|
206 | 206 | | parts through a unique identifier; |
---|
207 | 207 | | K. "repair certification" means evidence that an |
---|
208 | 208 | | independent repair provider has the technical and financial |
---|
209 | 209 | | capability and competence necessary to repair consumer |
---|
210 | 210 | | electronic equipment; |
---|
211 | 211 | | L. "tool" means software, a hardware implement or |
---|
212 | 212 | | an apparatus by means of which a person can diagnose, maintain |
---|
213 | 213 | | or repair consumer electronic equipment, including software, or |
---|
214 | 214 | | a mechanism that provisions, programs or pairs a new part; |
---|
215 | 215 | | M. "trade secret" means all forms and types of |
---|
216 | 216 | | financial, business, scientific, technical, economic or |
---|
217 | 217 | | engineering information, including patterns, plans, |
---|
218 | 218 | | compilations, program devices, formulas, designs, prototypes, |
---|
219 | 219 | | methods, techniques, processes, procedures, programs or codes, |
---|
220 | 220 | | whether tangible or intangible, and whether or how stored, |
---|

---|
259 | 259 | | and its components and peripherals that is intended primarily |
---|
260 | 260 | | for interactive video games. "Video game console" does not |
---|
261 | 261 | | include a general purpose personal computer that has the |
---|
262 | 262 | | capability to run video games alongside other computing |
---|
263 | 263 | | functions. |
---|
264 | 264 | | SECTION 3. [NEW MATERIAL] ORIGINAL EQUIPMENT |
---|
265 | 265 | | MANUFACTURER'S OBLIGATIONS REGARDING REPAIR SERVICES.-- |
---|
266 | 266 | | A. An original equipment manufacturer shall make |
---|
267 | 267 | | available to an owner or an independent repair provider on fair |
---|
268 | 268 | | and reasonable terms all documentation, tools or parts that the |
---|
269 | 269 | | original equipment manufacturer makes available to an |
---|
270 | 270 | | authorized service provider to diagnose, maintain or repair |
---|
271 | 271 | | consumer electronic equipment that the original equipment |
---|
272 | 272 | | manufacturer makes or sells and that is sold or used in this |
---|

312 | 312 | | (3) cause consumer electronic equipment to |

313 | 313 | | display misleading alerts or warnings about unidentified parts |
---|
314 | 314 | | that the owner or independent repair provider cannot |
---|
315 | 315 | | immediately dismiss. |
---|
316 | 316 | | SECTION 4. [NEW MATERIAL] FAIR AND REASONABLE TERMS AND |
---|
317 | 317 | | COSTS REQUIRED FOR DOCUMENTATION, TOOLS AND PARTS.-- |
---|
318 | 318 | | Documentation, tools and parts provided by an original |
---|
319 | 319 | | equipment manufacturer shall be offered at fair and reasonable |

320 | 320 | | terms and costs. The original equipment manufacturer shall: |

322 | 322 | | except that the original equipment manufacturer may charge for |

323 | 323 | | the reasonable and actual costs of preparing, printing and |

324 | 324 | | sending all documentation that is requested; |

325 | 325 | | B. make tools used to diagnose, maintain or repair |

---|
366 | 366 | | convenient means of delivery, means of enabling fully restored |
---|
367 | 367 | | and updated functionality, rights of use or other incentive or |
---|
368 | 368 | | preference the original equipment manufacturer offers to an |
---|
369 | 369 | | authorized service provider or that imposes an additional cost, |
---|
370 | 370 | | burden or impediment on an owner or independent repair provider |
---|
371 | 371 | | that the original equipment manufacturer also imposes on an |
---|
372 | 372 | | authorized service provider; |
---|
373 | 373 | | (2) does not impose a substantial condition, |

374 | 374 | | obligation or restriction that is not reasonably necessary to |

---|
419 | 419 | | SECTION 5. [NEW MATERIAL] LIMITATIONS OF ACT.--The Right |
---|
420 | 420 | | to Repair Consumer Electronics Act does not: |
---|
421 | 421 | | A. require an original equipment manufacturer to |
---|
422 | 422 | | disclose a trade secret or license intellectual property, |
---|
423 | 423 | | including copyrights or patents, to an independent repair |
---|
424 | 424 | | provider or an owner except as necessary to provide on fair and |
---|
425 | 425 | | reasonable terms all documentation, tools or parts used to |
---|
426 | 426 | | diagnose, maintain or repair consumer electronic equipment; |
---|
427 | 427 | | B. alter the terms of the agreement between an |
---|
428 | 428 | | original equipment manufacturer and an authorized service |
---|
429 | 429 | | provider, including the authorized service provider's |
---|
430 | 430 | | performance or provision of warranty service or recall repair |
---|
431 | 431 | | work on the original equipment manufacturer's behalf pursuant |
