4949 RELATING TO CRIME; MAKING THE DISTRIBUTION OF FENTANYL
5050 RESULTING IN DEATH A CAPITAL FELONY; PRESCRIBING A PENALTY.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. A new section of the Controlled Substances Act
5353 is enacted to read:
5454 "[NEW MATERIAL] DISTRIBUTION OF FENTANYL RESULTING IN
5555 DEATH.--
5656 A. Distribution of fentanyl resulting in death is
5757 the intentional and unlawful distribution of any amount of
5858 fentanyl or a fentanyl-related substance to another person that
5959 results in the death of that person by cause of injecting,
6060 inhaling, absorbing or ingesting the fentanyl or fentanyl-
6161 related substance. Whoever commits distribution of fentanyl
6262 resulting in death is guilty of a capital felony and shall be

9090 sentenced pursuant to the provisions of Section 31-18-14 NMSA
9191 1978.
9292 B. In any prosecution for distribution of fentanyl
9393 resulting in death, it is no defense that the deceased
9494 purposefully, knowingly, recklessly or negligently injected,
9595 inhaled, absorbed or ingested any amount of fentanyl or
9696 fentanyl-related substance.
9797 C. For the purposes of this section, "fentanyl-
9898 related substance" means any substance not otherwise assigned a
9999 number pursuant to the federal Controlled Substances Act and
100100 for which no exemption or approval is in effect under Section
101101 505 of the Federal Food, Drug, and Cosmetic Act that is
102102 structurally related to fentanyl by one or more of the
103103 following modifications:
104104 (1) replacement of the phenyl portion of the
105105 phenethyl group by any monocycle, whether or not further
106106 substituted in or on the monocycle;
107107 (2) substitution in or on the phenethyl group
108108 with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino
109109 or nitro groups;
110110 (3) substitution in or on the piperidine ring
111111 with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo,
112112 haloalkyl, amino or nitro groups;
113113 (4) replacement of the aniline ring with any
114114 aromatic monocycle whether or not further substituted in or on
