3838 PROPOSING TO AMEND ARTICLE 4 OF THE CONSTITUTION OF NEW MEXICO
3939 TO ADD A NEW SECTION TO CREATE A CITIZEN COMMISSION ON
4040 LEGISLATIVE SALARIES TO ESTABLISH, ADJUST AND LIMIT THE
4141 SALARIES OF MEMBERS OF THE LEGISLATURE AND TO AMEND SECTION 10
4242 TO AUTHORIZE PAYMENT OF LEGISLATIVE SALARIES.
4343 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4444 SECTION 1. It is proposed to amend Article 4 of the
4545 constitution of New Mexico by adding a new Section 43 to read:
4646 "A. The "citizen commission on legislative
4747 salaries" is established as an independent state agency for the
4848 purpose of establishing, adjusting and limiting the salaries of
4949 members of the legislature.
5050 B. The citizen commission on legislative salaries
5151 is composed of nine public members, not more than four of whom

7979 shall belong to the same political party at the time of
8080 appointment, and whose appointments, terms and qualification
8181 shall be provided by law.
8282 C. The citizen commission on legislative salaries
8383 shall review, research and consider salaries for members of the
8484 legislature, adopt a final report on its determination to
8585 establish, adjust or limit those salaries and file that report
8686 with the secretary of state on or before October 1, 2028 and at
8787 least every four years thereafter.
8888 D. The salaries established or adjusted as adopted
8989 in a report of the commission shall become effective on the
9090 first full state employee pay period in July following the
9191 filing of the report with the secretary of state.
9292 E. An affirmative vote of at least five members of
9393 the citizen commission on legislative salaries is required for
9494 adoption of a report of the commission establishing or
9595 adjusting salaries for members of the legislature.
9696 F. A member of the citizen commission on
9797 legislative salaries shall serve without compensation, but is
9898 entitled to receive per diem and mileage as provided by law for
9999 similar boards and commissions."
100100 SECTION 2. It is proposed to amend Article 4, Section 10
101101 of the constitution of New Mexico to read:
102102 "Each member of the legislature shall receive:

132132 diem rate set by the federal general services administration or
133133 successor agency for federal employees and officials for the
134134 city of Santa Fe for each day's attendance during each session
135135 of the legislature and the internal revenue service standard
136136 mileage rate for each mile traveled in going to and returning
137137 from the seat of government by the usual traveled route, once
138138 each session as defined by Article 4, Section 5 of this
139139 constitution;
140140 B. per diem expense and mileage at the same rates
141141 as provided in Subsection A of this section for service at
142142 meetings required by legislative committees established by the
143143 legislature to meet in the interim between sessions; [and ]
144144 C. a salary established or adjusted pursuant to
145145 Section 43 of this article; and
146146 [C.] D. no other compensation, perquisite or
147147 allowance."
148148 SECTION 3. The amendment proposed by this resolution
149149 shall be submitted to the people for their approval or
150150 rejection at the next general election or at any special
151151 election prior to that date that may be called for that
152152 purpose.
