38	38	PROPOSING TO AMEND ARTICLE 4 OF THE CONSTITUTION OF NEW MEXICO
39	39	TO ADD A NEW SECTION TO CREATE A CITIZEN COMMISSION ON
40	40	LEGISLATIVE SALARIES TO ESTABLISH, ADJUST AND LIMIT THE
41	41	SALARIES OF MEMBERS OF THE LEGISLATURE AND TO AMEND SECTION 10
42	42	TO AUTHORIZE PAYMENT OF LEGISLATIVE SALARIES.
43	43	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
44	44	SECTION 1. It is proposed to amend Article 4 of the
45	45	constitution of New Mexico by adding a new Section 43 to read:
46	46	"A. The "citizen commission on legislative
47	47	salaries" is established as an independent state agency for the
48	48	purpose of establishing, adjusting and limiting the salaries of
49	49	members of the legislature.
50	50	B. The citizen commission on legislative salaries
51	51	is composed of nine public members, not more than four of whom

79	79	shall belong to the same political party at the time of
80	80	appointment, and whose appointments, terms and qualification
81	81	shall be provided by law.
82	82	C. The citizen commission on legislative salaries
83	83	shall review, research and consider salaries for members of the
84	84	legislature, adopt a final report on its determination to
85	85	establish, adjust or limit those salaries and file that report
86	86	with the secretary of state on or before October 1, 2028 and at
87	87	least every four years thereafter.
88	88	D. The salaries established or adjusted as adopted
89	89	in a report of the commission shall become effective on the
90	90	first full state employee pay period in July following the
91	91	filing of the report with the secretary of state.
92	92	E. An affirmative vote of at least five members of
93	93	the citizen commission on legislative salaries is required for
94	94	adoption of a report of the commission establishing or
95	95	adjusting salaries for members of the legislature.
96	96	F. A member of the citizen commission on
97	97	legislative salaries shall serve without compensation, but is
98	98	entitled to receive per diem and mileage as provided by law for
99	99	similar boards and commissions."
100	100	SECTION 2. It is proposed to amend Article 4, Section 10
101	101	of the constitution of New Mexico to read:
102	102	"Each member of the legislature shall receive:
103	103	A. per diem at the [internal revenue service ] per

132	132	diem rate set by the federal general services administration or
133	133	successor agency for federal employees and officials for the
134	134	city of Santa Fe for each day's attendance during each session
135	135	of the legislature and the internal revenue service standard
136	136	mileage rate for each mile traveled in going to and returning
137	137	from the seat of government by the usual traveled route, once
138	138	each session as defined by Article 4, Section 5 of this
139	139	constitution;
140	140	B. per diem expense and mileage at the same rates
141	141	as provided in Subsection A of this section for service at
142	142	meetings required by legislative committees established by the
143	143	legislature to meet in the interim between sessions; [and ]
144	144	C. a salary established or adjusted pursuant to
145	145	Section 43 of this article; and
146	146	[C.] D. no other compensation, perquisite or
147	147	allowance."
148	148	SECTION 3. The amendment proposed by this resolution
149	149	shall be submitted to the people for their approval or
150	150	rejection at the next general election or at any special
151	151	election prior to that date that may be called for that
152	152	purpose.
