3737 ONE HUNDRED PERCENT OF THE RETIREE'S FINAL AVERAGE SALARY AS AN
3838 EMERGENCY FIRST RESPONDER IF THE ACTIVE OR RETIRED EMERGENCY
3939 FIRST RESPONDER OCCUPIES THE PROPERTY AS THE PERSON'S PRIMARY

4141 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4242 SECTION 1. It is proposed to amend Article 8, Section 5
4343 of the constitution of New Mexico to read:
4444 "A. The legislature shall exempt from taxation the
4545 property of each head of the family in the amount of two
4646 thousand dollars ($2,000).

7474 B. The legislature shall exempt from taxation the
7575 property, including the community or joint property of married
7676 individuals, of every honorably discharged member of the armed
7777 forces of the United States and the [widow or widower ]
7878 surviving spouse of every such honorably discharged member of
7979 the armed forces of the United States, in the sum of:
8080 (1) in 2006 and in each year through 2023,
8181 four thousand dollars ($4,000);
8282 (2) in 2024, ten thousand dollars ($10,000);
8383 and
8484 (3) in 2025 and each subsequent year, the
8585 amount provided in Paragraph (2) of this subsection, adjusted
8686 for inflation.
8787 [C. In every case where exemption is claimed on the
8888 ground of the claimant's having served with the armed forces of
8989 the United States pursuant to Subsection B of this section, the
9090 burden of proving actual and bona fide ownership of such
9191 property upon which exemption is claimed shall be upon the
9292 claimant.]
9393 C. The legislature shall exempt from taxation fifty
9494 percent of the value of property of each certified emergency
9595 first responder, as provided by law, who:
9696 (1) is active, full-time and certified and has
9797 worked as an emergency first responder for at least one year
9898 since successfully completing any probationary period required

128128 (2) is retired and has earned an amount of
129129 pension equal to one hundred percent of the person's final
130130 average salary as an emergency first responder calculated in
131131 accordance with the provisions of the applicable public
132132 employees retirement system retirement plan, as provided by
133133 law; and
134134 (3) occupies the property as the primary
135135 residence of the first responder.
136136 D. The burden of proving eligibility for an
137137 exemption provided by this section is on the person claiming
138138 the exemption."
139139 SECTION 2. The amendment proposed by this resolution
140140 shall be submitted to the people for their approval or
141141 rejection at the next general election or at any special
142142 election prior to that date that may be called for that
143143 purpose.
