3737 PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO BY ADDING A

3939 WITH ENVIRONMENTAL RIGHTS, INCLUDING THE RIGHT TO CLEAN AND
4040 HEALTHY AIR, WATER, SOIL AND ENVIRONMENTS, HEALTHY NATIVE
4141 FLORA, FAUNA AND ECOSYSTEMS, A SAFE CLIMATE AND THE
4242 PRESERVATION OF THE NATURAL, CULTURAL, SCENIC AND HEALTHFUL
4343 QUALITIES OF THE ENVIRONMENT, AND DIRECTS THE STATE, COUNTIES
4444 AND MUNICIPALITIES TO SERVE AS TRUSTEES OF THE NATURAL
4545 RESOURCES OF NEW MEXICO FOR THE BENEFIT OF ALL THE PEOPLE.
4646 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4747 SECTION 1. It is proposed to amend Article 2 of the
4848 constitution of New Mexico by adding a new section to read:
4949 "A. The people of the state shall have a right to
5050 clean and healthy air, water, soil and environments; healthy

7878 native flora, fauna and ecosystems; a safe climate; and the
7979 preservation of the natural, cultural, scenic and healthful
8080 qualities of the environment. The state shall protect these
8181 rights equitably for all people regardless of race, ethnicity,
8282 tribal affiliation, gender, socioeconomics or geography.
8383 B. The state, counties and municipalities shall
8484 serve as trustees of the natural resources of New Mexico and
8585 shall conserve, protect and maintain these resources for the
8686 benefit of all the people, including present and future
8787 generations.
8888 C. The provisions of this section are self-
8989 executing. Monetary damages shall not be awarded for a
9090 violation of this section. This section is enforceable against
9191 the state, counties and municipalities."
9292 SECTION 2. The amendment proposed by this resolution
9393 shall be submitted to the people for their approval or
9494 rejection at the next general election or at any special
9595 election prior to that date that may be called for that
9696 purpose.
