37	37	PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO BY ADDING A
38	38	NEW SECTION OF ARTICLE 2 THAT PROVIDES THE PEOPLE OF THE STATE
39	39	WITH ENVIRONMENTAL RIGHTS, INCLUDING THE RIGHT TO CLEAN AND
40	40	HEALTHY AIR, WATER, SOIL AND ENVIRONMENTS, HEALTHY NATIVE
41	41	FLORA, FAUNA AND ECOSYSTEMS, A SAFE CLIMATE AND THE
42	42	PRESERVATION OF THE NATURAL, CULTURAL, SCENIC AND HEALTHFUL
43	43	QUALITIES OF THE ENVIRONMENT, AND DIRECTS THE STATE, COUNTIES
44	44	AND MUNICIPALITIES TO SERVE AS TRUSTEES OF THE NATURAL
45	45	RESOURCES OF NEW MEXICO FOR THE BENEFIT OF ALL THE PEOPLE.
46	46	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
47	47	SECTION 1. It is proposed to amend Article 2 of the
48	48	constitution of New Mexico by adding a new section to read:
49	49	"A. The people of the state shall have a right to
50	50	clean and healthy air, water, soil and environments; healthy

78	78	native flora, fauna and ecosystems; a safe climate; and the
79	79	preservation of the natural, cultural, scenic and healthful
80	80	qualities of the environment. The state shall protect these
81	81	rights equitably for all people regardless of race, ethnicity,
82	82	tribal affiliation, gender, socioeconomics or geography.
83	83	B. The state, counties and municipalities shall
84	84	serve as trustees of the natural resources of New Mexico and
85	85	shall conserve, protect and maintain these resources for the
86	86	benefit of all the people, including present and future
87	87	generations.
88	88	C. The provisions of this section are self-
89	89	executing. Monetary damages shall not be awarded for a
90	90	violation of this section. This section is enforceable against
91	91	the state, counties and municipalities."
92	92	SECTION 2. The amendment proposed by this resolution
93	93	shall be submitted to the people for their approval or
94	94	rejection at the next general election or at any special
95	95	election prior to that date that may be called for that
96	96	purpose.
