3737 REQUESTING THE OFFICE OF SUPERINTENDENT OF INSURANCE, THE
3838 DEPARTMENT OF HEALTH AND THE HEALTH CARE AUTHORITY TO CONVENE A
3939 JOINT TASK FORCE TO EXAMINE THE MEDICAL MALPRACTICE SYSTEM IN
4040 NEW MEXICO TO IDENTIFY ISSUES IN THE SYSTEM AND RECOMMEND

4242 WHEREAS, the Medical Malpractice Act is necessary to make
4343 patients who are injured due to negligence whole and to promote
4444 patient safety in New Mexico; and
4545 WHEREAS, all health care providers covered by the Medical
4646 Malpractice Act are required to carry malpractice insurance;
4747 and
4848 WHEREAS, New Mexico is experiencing a massive health care
4949 provider shortage; and
5050 WHEREAS, many health care providers have identified many

7979 for medical malpractice insurance and low levels of

8181 WHEREAS, there may be many factors that could contribute
8282 to increases in insurance premiums; and
8383 WHEREAS, it is essential to have a fair and equitable
8484 medical malpractice system to balance the rights of patients
8585 with the necessity to make New Mexico an attractive place for
8686 health care providers to practice;
8787 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE
8888 OF NEW MEXICO that the office of superintendent of insurance,
8989 the department of health and the health care authority be
9090 requested to convene a joint task force to examine the medical
9191 malpractice system in New Mexico to identify issues in the
9292 system and recommend solutions to those issues; and
9393 BE IT FURTHER RESOLVED that the task force be composed of
9494 a diverse group of members representing stakeholders throughout
9595 the medical malpractice and health care provider systems,
9696 including:
9797 A. four members who represent the interests of
9898 patients affected by medical malpractice, appointed as follows:
9999 (1) one member appointed by the governor;
100100 (2) one member appointed by the speaker of the
101101 house of representatives;
