37	37	REQUESTING THE OFFICE OF SUPERINTENDENT OF INSURANCE, THE
38	38	DEPARTMENT OF HEALTH AND THE HEALTH CARE AUTHORITY TO CONVENE A
39	39	JOINT TASK FORCE TO EXAMINE THE MEDICAL MALPRACTICE SYSTEM IN
40	40	NEW MEXICO TO IDENTIFY ISSUES IN THE SYSTEM AND RECOMMEND
41	41	SOLUTIONS TO THOSE ISSUES.
42	42	WHEREAS, the Medical Malpractice Act is necessary to make
43	43	patients who are injured due to negligence whole and to promote
44	44	patient safety in New Mexico; and
45	45	WHEREAS, all health care providers covered by the Medical
46	46	Malpractice Act are required to carry malpractice insurance;
47	47	and
48	48	WHEREAS, New Mexico is experiencing a massive health care
49	49	provider shortage; and
50	50	WHEREAS, many health care providers have identified many

79	79	for medical malpractice insurance and low levels of
80	80	reimbursement for services; and
81	81	WHEREAS, there may be many factors that could contribute
82	82	to increases in insurance premiums; and
83	83	WHEREAS, it is essential to have a fair and equitable
84	84	medical malpractice system to balance the rights of patients
85	85	with the necessity to make New Mexico an attractive place for
86	86	health care providers to practice;
87	87	NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE
88	88	OF NEW MEXICO that the office of superintendent of insurance,
89	89	the department of health and the health care authority be
90	90	requested to convene a joint task force to examine the medical
91	91	malpractice system in New Mexico to identify issues in the
92	92	system and recommend solutions to those issues; and
93	93	BE IT FURTHER RESOLVED that the task force be composed of
94	94	a diverse group of members representing stakeholders throughout
95	95	the medical malpractice and health care provider systems,
96	96	including:
97	97	A. four members who represent the interests of
98	98	patients affected by medical malpractice, appointed as follows:
99	99	(1) one member appointed by the governor;
100	100	(2) one member appointed by the speaker of the
101	101	house of representatives;
