21 | 21 | | Existing law requires each employee organization recognized by a local |
---|
22 | 22 | | government employer, including, without limitation, a school district, in this State |
---|
23 | 23 | | to file a report with the Government Employee-Management Relations Board each |
---|
24 | 24 | | year containing certain information, including, without limitation, the total number |
---|
25 | 25 | | of persons in each bargaining unit represented by the employee organization. (NRS |
---|
26 | 26 | | 288.165) Section 1 of this bill requires, with certain exception, that each school |
---|
27 | 27 | | district provide each employee organization recognized by the school district the |
---|
28 | 28 | | name, address, electronic mail address, telephone number, work contact |
---|
29 | 29 | | information and work location of each employee in the bargaining unit represented |
---|
30 | 30 | | by the employee organization at least on a semiannual basis, unless the school |
---|
31 | 31 | | district and an employee organization recognized by the school district agree |
---|
32 | 32 | | otherwise. Section 1 further provides that if a school district employee notifies his |
---|
33 | 33 | | or her employer in writing that he or she does not want the employer to provide his |
---|
34 | 34 | | or her information to the employee organization, the school district must not |
---|
35 | 35 | | provide the information to the employee organization but must still provide the |
---|
36 | 36 | | information to the Government Employee-Management Relations Board when |
---|
37 | 37 | | requested by order of the Board. Section 1 also provides that information about any |
---|
38 | 38 | | school district employee provided to an employee organization or the Board is |
---|
39 | 39 | | confidential and is not a public record. Section 3 of this bill makes a conforming |
---|
40 | 40 | | change relating to making such information confidential and not a public record. |
---|
41 | 41 | | Existing law sets forth the requirements for collective bargaining between the |
---|
42 | 42 | | Executive Department of State Government and employee organizations that |
---|
43 | 43 | | represent classified employees, including the subjects of mandatory bargaining. |
---|
44 | 44 | | (NRS 288.500) Section 2.5 of this bill additionally requires such collective |
---|
45 | 45 | | bargaining to include matters relating to parking and transportation. |

65 | 65 | | Section 1. Chapter 288 of NRS is hereby amended by adding |
---|
66 | 66 | | thereto a new section to read as follows: |
---|
67 | 67 | | 1. Except as otherwise provided in this subsection and |
---|
68 | 68 | | subsection 3, at least twice each year, on or before January 1 and |
---|
69 | 69 | | July 1, each school district shall provide each employee |
---|
70 | 70 | | organization recognized by the school district the name, address, |
---|
71 | 71 | | electronic mail address, telephone number, work contact |
---|
72 | 72 | | information and work location of each school district employee of |
---|
73 | 73 | | the bargaining unit represented by the employee organization. A |
---|
74 | 74 | | school district and an employee organization may agree to provide |
---|
75 | 75 | | such information about school district employees at other times |
---|
76 | 76 | | that are in addition to or in place of January 1 and July 1 of each |
---|
77 | 77 | | year. |
---|
78 | 78 | | 2. Except as otherwise provided in subsection 3, a school |
---|
79 | 79 | | district is required to provide an employee organization with the |
---|
80 | 80 | | information about a school district employee pursuant to |
---|
81 | 81 | | subsection 1 regardless of whether the employee has joined the |
---|
82 | 82 | | employee organization. |
---|
83 | 83 | | 3. If a school district employee notifies the school district in |
---|
84 | 84 | | writing that he or she does not want the school district to provide |
---|
85 | 85 | | any of his or her information to the employee organization |
---|
86 | 86 | | recognized by the school district, the school district: |
---|
87 | 87 | | (a) Must not provide the information set forth in subsection 1 |
---|
88 | 88 | | to the employee organization; and |
---|
89 | 89 | | (b) Must still provide the information set forth in subsection 1 |
---|
90 | 90 | | to the Government Employee-Management Relations Board when |
---|
91 | 91 | | requested by the order of the Board. |
---|
92 | 92 | | 4. Information about any school district employee that is |
---|
93 | 93 | | provided pursuant to this section to an employee organization or |
---|
94 | 94 | | the Government Employee-Management Relations Board is |
---|
95 | 95 | | confidential and is not a public record. |

113 | 113 | | (b) Refrain from engaging in such activity. |

114 | 114 | | 2. Collective bargaining and supplemental bargaining entail a |
---|
115 | 115 | | mutual obligation of the Executive Department and an exclusive |
---|
116 | 116 | | representative to meet at reasonable times and to bargain in good |
---|
117 | 117 | | faith with respect to: |
---|
118 | 118 | | (a) The subjects of mandatory bargaining set forth in subsection |
---|
119 | 119 | | 2 of NRS 288.150, except paragraph (f) of that subsection; |
---|
120 | 120 | | (b) Matters relating to parking and transportation; |
---|
121 | 121 | | (c) The negotiation of an agreement; |
---|
122 | 122 | | [(c)] (d) The resolution of any question arising under an |
---|
123 | 123 | | agreement; and |
---|
124 | 124 | | [(d)] (e) The execution of a written contract incorporating the |
---|
125 | 125 | | provisions of an agreement, if requested by either party. |
---|
126 | 126 | | 3. The subject matters set forth in subsection 3 of NRS 288.150 |
---|
127 | 127 | | are not within the scope of mandatory bargaining and are reserved to |
---|
128 | 128 | | the Executive Department without negotiation. |
---|
129 | 129 | | 4. Notwithstanding the provisions of any collective bargaining |
---|
130 | 130 | | agreement negotiated pursuant to the provisions of NRS 288.400 to |
---|
131 | 131 | | 288.630, inclusive, the Executive Department is entitled to take the |
---|
132 | 132 | | actions set forth in paragraph (b) of subsection 6 of NRS 288.150. |
---|
133 | 133 | | Any action taken under the provisions of this subsection must not be |
---|
134 | 134 | | construed as a failure to negotiate in good faith. |
---|
135 | 135 | | 5. This section does not preclude, but the provisions of NRS |
---|
136 | 136 | | 288.400 to 288.630, inclusive, do not require, the Executive |
---|
137 | 137 | | Department to negotiate subject matters set forth in subsection 3 |
---|
138 | 138 | | which are outside the scope of mandatory bargaining. The Executive |
---|
139 | 139 | | Department shall discuss subject matters outside the scope of |
---|
140 | 140 | | mandatory bargaining but it is not required to negotiate those |
---|
141 | 141 | | matters. |
---|
142 | 142 | | 6. The Executive Department shall furnish to an exclusive |
---|
143 | 143 | | representative data that is maintained in the ordinary course of |
---|
144 | 144 | | business and which is relevant and necessary to the discussion of the |
---|
145 | 145 | | subjects of mandatory bargaining described in subsection 2. This |
---|
146 | 146 | | subsection shall not be construed to require the Executive |
---|
147 | 147 | | Department to furnish to the exclusive representative any advice or |
---|

---|
269 | 269 | | 2. A governmental entity may not reject a book or record |
---|
270 | 270 | | which is copyrighted solely because it is copyrighted. |
---|
271 | 271 | | 3. A governmental entity that has legal custody or control of a |
---|
272 | 272 | | public book or record shall not deny a request made pursuant to |
---|
273 | 273 | | subsection 1 to inspect or copy or receive a copy of a public book or |
---|
274 | 274 | | record on the basis that the requested public book or record contains |
---|
275 | 275 | | information that is confidential if the governmental entity can |
---|

299 | 299 | | has legal custody or control of a public record: |

300 | 300 | | (a) Shall not refuse to provide a copy of that public record in the |
---|
301 | 301 | | medium that is requested because the officer, employee or agent has |
---|
302 | 302 | | already prepared or would prefer to provide the copy in a different |
---|
303 | 303 | | medium. |
