1111 AN ACT relating to collective bargaining; requiring, with certain
1212 exceptions, each school district to semiannually provide each
1313 employee organization recognized by the school district
1414 certain information relating to each employee of the
1515 bargaining unit represented by the employee organization;
1616 requiring collective bargaining between the Executive
1717 Department of State Government and classified employees to
1818 include matters relating to parking and transportation; and
1919 providing other matters properly relating thereto.

2121 Existing law requires each employee organization recognized by a local
2222 government employer, including, without limitation, a school district, in this State
2323 to file a report with the Government Employee-Management Relations Board each
2424 year containing certain information, including, without limitation, the total number
2525 of persons in each bargaining unit represented by the employee organization. (NRS
2626 288.165) Section 1 of this bill requires, with certain exception, that each school
2727 district provide each employee organization recognized by the school district the
2828 name, address, electronic mail address, telephone number, work contact
2929 information and work location of each employee in the bargaining unit represented
3030 by the employee organization at least on a semiannual basis, unless the school
3131 district and an employee organization recognized by the school district agree
3232 otherwise. Section 1 further provides that if a school district employee notifies his
3333 or her employer in writing that he or she does not want the employer to provide his
3434 or her information to the employee organization, the school district must not
3535 provide the information to the employee organization but must still provide the
3636 information to the Government Employee-Management Relations Board when
3737 requested by order of the Board. Section 1 also provides that information about any
3838 school district employee provided to an employee organization or the Board is
3939 confidential and is not a public record. Section 3 of this bill makes a conforming
4040 change relating to making such information confidential and not a public record.
4141 Existing law sets forth the requirements for collective bargaining between the
4242 Executive Department of State Government and employee organizations that
4343 represent classified employees, including the subjects of mandatory bargaining.
4444 (NRS 288.500) Section 2.5 of this bill additionally requires such collective
4545 bargaining to include matters relating to parking and transportation.
4646 Section 2 of this bill makes a conforming change to indicate the proper
4747 placement of section 1 in the Nevada Revised Statutes.

6262 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
6363 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

6565 Section 1. Chapter 288 of NRS is hereby amended by adding
6666 thereto a new section to read as follows:
6767 1. Except as otherwise provided in this subsection and
6868 subsection 3, at least twice each year, on or before January 1 and
6969 July 1, each school district shall provide each employee
7070 organization recognized by the school district the name, address,
7171 electronic mail address, telephone number, work contact
7272 information and work location of each school district employee of
7373 the bargaining unit represented by the employee organization. A
7474 school district and an employee organization may agree to provide
7575 such information about school district employees at other times
7676 that are in addition to or in place of January 1 and July 1 of each
7777 year.
7878 2. Except as otherwise provided in subsection 3, a school
7979 district is required to provide an employee organization with the
8080 information about a school district employee pursuant to
8181 subsection 1 regardless of whether the employee has joined the
8282 employee organization.
8383 3. If a school district employee notifies the school district in
8484 writing that he or she does not want the school district to provide
8585 any of his or her information to the employee organization
8686 recognized by the school district, the school district:
8787 (a) Must not provide the information set forth in subsection 1
8888 to the employee organization; and
8989 (b) Must still provide the information set forth in subsection 1
9090 to the Government Employee-Management Relations Board when
9191 requested by the order of the Board.
9292 4. Information about any school district employee that is
9393 provided pursuant to this section to an employee organization or
9494 the Government Employee-Management Relations Board is
9595 confidential and is not a public record.
9696 Sec. 2. NRS 288.131 is hereby amended to read as follows:
9797 288.131 As used in NRS 288.131 to 288.280, inclusive, and
9898 section 1 of this act, unless the context otherwise requires, the
9999 words and terms defined in NRS 288.132 to 288.138, inclusive,

105105 Sec. 2.5. NRS 288.500 is hereby amended to read as follows:
106106 288.500 1. For the purposes of collective bargaining,
107107 supplemental bargaining and other mutual aid or protection,
108108 employees have the right to:
109109 (a) Organize, form, join and assist labor organizations, engage in
110110 collective bargaining and supplemental bargaining through
111111 exclusive representatives and engage in other concerted activities;
112112 and
113113 (b) Refrain from engaging in such activity.
114114 2. Collective bargaining and supplemental bargaining entail a
115115 mutual obligation of the Executive Department and an exclusive
116116 representative to meet at reasonable times and to bargain in good
117117 faith with respect to:
118118 (a) The subjects of mandatory bargaining set forth in subsection
119119 2 of NRS 288.150, except paragraph (f) of that subsection;
120120 (b) Matters relating to parking and transportation;
121121 (c) The negotiation of an agreement;
122122 [(c)] (d) The resolution of any question arising under an
123123 agreement; and
124124 [(d)] (e) The execution of a written contract incorporating the
125125 provisions of an agreement, if requested by either party.
126126 3. The subject matters set forth in subsection 3 of NRS 288.150
127127 are not within the scope of mandatory bargaining and are reserved to
128128 the Executive Department without negotiation.
129129 4. Notwithstanding the provisions of any collective bargaining
130130 agreement negotiated pursuant to the provisions of NRS 288.400 to
131131 288.630, inclusive, the Executive Department is entitled to take the
132132 actions set forth in paragraph (b) of subsection 6 of NRS 288.150.
133133 Any action taken under the provisions of this subsection must not be
134134 construed as a failure to negotiate in good faith.
135135 5. This section does not preclude, but the provisions of NRS
136136 288.400 to 288.630, inclusive, do not require, the Executive
137137 Department to negotiate subject matters set forth in subsection 3
138138 which are outside the scope of mandatory bargaining. The Executive
139139 Department shall discuss subject matters outside the scope of
140140 mandatory bargaining but it is not required to negotiate those
141141 matters.
142142 6. The Executive Department shall furnish to an exclusive
143143 representative data that is maintained in the ordinary course of
144144 business and which is relevant and necessary to the discussion of the
145145 subjects of mandatory bargaining described in subsection 2. This
146146 subsection shall not be construed to require the Executive
147147 Department to furnish to the exclusive representative any advice or

152152 training received by representatives of the Executive Department
153153 concerning collective bargaining.
154154 7. To the greatest extent practicable, any decision issued by the
155155 Board before October 1, 2019, relating to the interpretation of, or
156156 the performance under, the provisions of NRS 288.150 shall be
157157 deemed to apply to any complaint arising out of the interpretation
158158 of, or performance under, the provisions of this section.

263263 general public with copies, abstracts or memoranda of the records or
264264 may be used in any other way to the advantage of the governmental
265265 entity or of the general public. This section does not supersede or in
266266 any manner affect the federal laws governing copyrights or enlarge,
267267 diminish or affect in any other manner the rights of a person in any
268268 written book or record which is copyrighted pursuant to federal law.
269269 2. A governmental entity may not reject a book or record
270270 which is copyrighted solely because it is copyrighted.
271271 3. A governmental entity that has legal custody or control of a
272272 public book or record shall not deny a request made pursuant to
273273 subsection 1 to inspect or copy or receive a copy of a public book or
274274 record on the basis that the requested public book or record contains
275275 information that is confidential if the governmental entity can
276276 redact, delete, conceal or separate, including, without limitation,
277277 electronically, the confidential information from the information
278278 included in the public book or record that is not otherwise
279279 confidential.
280280 4. If requested, a governmental entity shall provide a copy of a
281281 public record in an electronic format by means of an electronic
282282 medium. Nothing in this subsection requires a governmental entity
283283 to provide a copy of a public record in an electronic format or by
284284 means of an electronic medium if:
285285 (a) The public record:
286286 (1) Was not created or prepared in an electronic format; and
287287 (2) Is not available in an electronic format; or

292292 (b) Providing the public record in an electronic format or by
293293 means of an electronic medium would:
294294 (1) Give access to proprietary software; or
295295 (2) Require the production of information that is confidential
296296 and that cannot be redacted, deleted, concealed or separated from
297297 information that is not otherwise confidential.
298298 5. An officer, employee or agent of a governmental entity who
299299 has legal custody or control of a public record:
300300 (a) Shall not refuse to provide a copy of that public record in the
301301 medium that is requested because the officer, employee or agent has
302302 already prepared or would prefer to provide the copy in a different
303303 medium.
304304 (b) Except as otherwise provided in NRS 239.030, shall, upon
305305 request, prepare the copy of the public record and shall not require
306306 the person who has requested the copy to prepare the copy himself
307307 or herself.
