1111 AN ACT relating to special license plates; revising provisions
1212 governing the distribution of fees collected for the issuance
1313 or renewal of special license plates indicating support for the
1414 Divine Nine; and providing other matters properly relating
1515 thereto.
1616 Legislative Counsel’s Digest:
1717 Existing law requires the Department of Motor Vehicles to design, prepare and
1818 issue special license plates that indicate support for the Divine Nine, which are a
1919 group of historically Black collegiate fraternities and sororities. (NRS 482.37941)
2020 Existing law requires the fees collected for the special license plates that are in
2121 addition to all other applicable registration and license fees and governmental
2222 services taxes to be deposited with the State Treasurer, who must, on a quarterly
2323 basis, distribute: (1) 10 percent of the fees to the United Negro College Fund; and
2424 (2) the remaining 90 percent of the fees equally among certain chapters or
2525 organizations associated with the Divine Nine for the promotion of community
2626 awareness and action through educational, economic and cultural service activities
2727 within this State. (NRS 482.37941) This bill removes the requirement for the State
2828 Treasurer to make distributions to certain chapters or organizations associated with
2929 the Divine Nine and, instead, requires that all of the fees collected for the special
3030 license plates that are in addition to all other applicable registration and license fees
3131 and governmental service taxes be distributed to the Las Vegas Metropolitan Inter-
3232 Alumni Council of the United Negro College Fund.

3737 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
3838 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

4040 Section 1. NRS 482.37941 is hereby amended to read as
4141 follows:
4242 482.37941 1. The Department, in cooperation with the Las
4343 Vegas Chapter of the National Pan-Hellenic Council, shall design,
4444 prepare and issue a license plate that indicates support for the Divine
4545 Nine, using any colors that the Department deems appropriate.
4646 2. The Department shall issue license plates that indicate
4747 support for the Divine Nine for a passenger car or light commercial
4848 vehicle upon application by a person who is entitled to license plates
4949 pursuant to NRS 482.265 and who otherwise complies with the
5050 requirements for registration and licensing pursuant to this chapter.
5151 A person may request that personalized prestige license plates

5656 issued pursuant to NRS 482.3667 be combined with license plates
5757 that indicate support for the Divine Nine if that person pays the fees
5858 for the personalized prestige license plates in addition to the fees for
5959 the license plates that indicate support for the Divine Nine pursuant
6060 to subsections 3 and 4.
6161 3. The fee for license plates that indicate support for the Divine
6262 Nine is $35, in addition to all other applicable registration and
6363 license fees and governmental services taxes. The license plates are
6464 renewable upon the payment to the Department of $10.
6565 4. In addition to all other applicable registration and license
6666 fees, governmental services taxes and the fee prescribed pursuant to
6767 subsection 3, a person who requests a set of license plates that
6868 indicate support for the Divine Nine must pay a fee of $25 for the
6969 issuance of the plates and a fee of $20 for each renewal of the plates,
7070 to be deposited in accordance with subsection 5.
7171 5. Except as otherwise provided in NRS 482.38279, the
7272 Department shall deposit the fees collected pursuant to subsection 4
7373 with the State Treasurer for credit to the State General Fund. The
7474 State Treasurer shall, on a quarterly basis, distribute [:
7575 (a) Ten percent of] the fees deposited pursuant to this subsection
7676 to the Las Vegas Metropolitan Inter-Alumni Council of the United
7777 Negro College Fund, [Inc.,] or its successor organization, for college
7878 scholarships for Nevada residents attending a college in this State .
7979 [; and
8080 (b) The remaining 90 percent of the fees deposited pursuant to
8181 this subsection to the following organizations in the following
8282 manner for the promotion of community awareness and action
8383 through educational, economic and cultural service activities within
8484 this State:
8585 (1) Ten percent distributed to the Alpha Kappa Alpha
8686 Educational Advancement Foundation, Inc.;
8787 (2) Ten percent equally distributed among the Alpha Phi
8888 Alpha Fraternity chapters in this State;
8989 (3) Ten percent distributed to the Delta Research and
9090 Educational Foundation, Inc.;
9191 (4) Ten percent distributed to the National Iota Foundation,
9292 Inc.;
9393 (5) Ten percent distributed to the Western Province of Kappa
9494 Alpha Psi Fraternity, Inc.;
9595 (6) Ten percent equally distributed among the Omega Psi Phi
9696 Fraternity chapters in this State;
9797 (7) Ten percent distributed to the Western Region of Phi
9898 Beta Sigma Fraternity, Inc.;

103103 (8) Ten percent distributed to the Sigma Gamma Rho
104104 Sorority National Education Fund, Inc.; and
105105 (9) Ten percent equally distributed among the Zeta Phi Beta

107107 6. If, during a registration period, the holder of license plates
108108 issued pursuant to the provisions of this section disposes of the
109109 vehicle to which the plates are affixed, the holder shall:
110110 (a) Retain the plates and affix them to another vehicle that meets
111111 the requirements of this section if the holder pays the fee for the
112112 transfer of the registration and any registration fee or governmental
113113 services tax due pursuant to NRS 482.399; or
114114 (b) Within 30 days after removing the plates from the vehicle,
115115 return them to the Department.
116116 7. The Department may accept any gifts, grants and donations
117117 or other sources of money for the production and issuance of license
118118 plates pursuant to this section. All money received pursuant to this
119119 subsection must be deposited in the Revolving Account for the
120120 Issuance of Special License Plates created by NRS 482.1805.
121121 8. As used in this section, “Divine Nine” means the following
122122 nine member organizations that compose the National Pan-Hellenic
123123 Council:
124124 (a) Alpha Kappa Alpha Sorority, Inc.;
125125 (b) Alpha Phi Alpha Fraternity, Inc.;
126126 (c) Delta Sigma Theta Sorority, Inc.;
127127 (d) Iota Phi Theta Fraternity, Inc.;
128128 (e) Kappa Alpha Psi Fraternity, Inc.;
129129 (f) Omega Psi Phi Fraternity, Inc.;
130130 (g) Phi Beta Sigma Fraternity, Inc.;
131131 (h) Sigma Gamma Rho Sorority, Inc.; and
132132 (i) Zeta Phi Beta Sorority, Inc.
