12	12	governing the distribution of fees collected for the issuance
13	13	or renewal of special license plates indicating support for the
14	14	Divine Nine; and providing other matters properly relating
15	15	thereto.

17	17	Existing law requires the Department of Motor Vehicles to design, prepare and
18	18	issue special license plates that indicate support for the Divine Nine, which are a
19	19	group of historically Black collegiate fraternities and sororities. (NRS 482.37941)
20	20	Existing law requires the fees collected for the special license plates that are in
21	21	addition to all other applicable registration and license fees and governmental
22	22	services taxes to be deposited with the State Treasurer, who must, on a quarterly
23	23	basis, distribute: (1) 10 percent of the fees to the United Negro College Fund; and
24	24	(2) the remaining 90 percent of the fees equally among certain chapters or
25	25	organizations associated with the Divine Nine for the promotion of community
26	26	awareness and action through educational, economic and cultural service activities
27	27	within this State. (NRS 482.37941) This bill removes the requirement for the State
28	28	Treasurer to make distributions to certain chapters or organizations associated with
29	29	the Divine Nine and, instead, requires that all of the fees collected for the special
30	30	license plates that are in addition to all other applicable registration and license fees
31	31	and governmental service taxes be distributed to the Las Vegas Metropolitan Inter-
32	32	Alumni Council of the United Negro College Fund.

37	37	THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
38	38	SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

40	40	Section 1. NRS 482.37941 is hereby amended to read as
41	41	follows:
42	42	482.37941 1. The Department, in cooperation with the Las
43	43	Vegas Chapter of the National Pan-Hellenic Council, shall design,
44	44	prepare and issue a license plate that indicates support for the Divine
45	45	Nine, using any colors that the Department deems appropriate.
46	46	2. The Department shall issue license plates that indicate
47	47	support for the Divine Nine for a passenger car or light commercial
48	48	vehicle upon application by a person who is entitled to license plates
49	49	pursuant to NRS 482.265 and who otherwise complies with the
50	50	requirements for registration and licensing pursuant to this chapter.
51	51	A person may request that personalized prestige license plates

56	56	issued pursuant to NRS 482.3667 be combined with license plates
57	57	that indicate support for the Divine Nine if that person pays the fees
58	58	for the personalized prestige license plates in addition to the fees for
59	59	the license plates that indicate support for the Divine Nine pursuant
60	60	to subsections 3 and 4.
61	61	3. The fee for license plates that indicate support for the Divine
62	62	Nine is $35, in addition to all other applicable registration and
63	63	license fees and governmental services taxes. The license plates are
64	64	renewable upon the payment to the Department of $10.
65	65	4. In addition to all other applicable registration and license
66	66	fees, governmental services taxes and the fee prescribed pursuant to
67	67	subsection 3, a person who requests a set of license plates that
68	68	indicate support for the Divine Nine must pay a fee of $25 for the
69	69	issuance of the plates and a fee of $20 for each renewal of the plates,
70	70	to be deposited in accordance with subsection 5.
71	71	5. Except as otherwise provided in NRS 482.38279, the
72	72	Department shall deposit the fees collected pursuant to subsection 4
73	73	with the State Treasurer for credit to the State General Fund. The
74	74	State Treasurer shall, on a quarterly basis, distribute [:
75	75	(a) Ten percent of] the fees deposited pursuant to this subsection
76	76	to the Las Vegas Metropolitan Inter-Alumni Council of the United
77	77	Negro College Fund, [Inc.,] or its successor organization, for college
78	78	scholarships for Nevada residents attending a college in this State .
79	79	[; and
80	80	(b) The remaining 90 percent of the fees deposited pursuant to
81	81	this subsection to the following organizations in the following
82	82	manner for the promotion of community awareness and action
83	83	through educational, economic and cultural service activities within
84	84	this State:
85	85	(1) Ten percent distributed to the Alpha Kappa Alpha
86	86	Educational Advancement Foundation, Inc.;
87	87	(2) Ten percent equally distributed among the Alpha Phi
88	88	Alpha Fraternity chapters in this State;
89	89	(3) Ten percent distributed to the Delta Research and
90	90	Educational Foundation, Inc.;
91	91	(4) Ten percent distributed to the National Iota Foundation,
92	92	Inc.;
93	93	(5) Ten percent distributed to the Western Province of Kappa
94	94	Alpha Psi Fraternity, Inc.;
95	95	(6) Ten percent equally distributed among the Omega Psi Phi
96	96	Fraternity chapters in this State;
97	97	(7) Ten percent distributed to the Western Region of Phi
98	98	Beta Sigma Fraternity, Inc.;

104	104	Sorority National Education Fund, Inc.; and
105	105	(9) Ten percent equally distributed among the Zeta Phi Beta

107	107	6. If, during a registration period, the holder of license plates
108	108	issued pursuant to the provisions of this section disposes of the
109	109	vehicle to which the plates are affixed, the holder shall:
110	110	(a) Retain the plates and affix them to another vehicle that meets
111	111	the requirements of this section if the holder pays the fee for the
112	112	transfer of the registration and any registration fee or governmental
113	113	services tax due pursuant to NRS 482.399; or
114	114	(b) Within 30 days after removing the plates from the vehicle,
115	115	return them to the Department.
116	116	7. The Department may accept any gifts, grants and donations
117	117	or other sources of money for the production and issuance of license
118	118	plates pursuant to this section. All money received pursuant to this
119	119	subsection must be deposited in the Revolving Account for the
120	120	Issuance of Special License Plates created by NRS 482.1805.
121	121	8. As used in this section, “Divine Nine” means the following
122	122	nine member organizations that compose the National Pan-Hellenic
123	123	Council:
124	124	(a) Alpha Kappa Alpha Sorority, Inc.;
125	125	(b) Alpha Phi Alpha Fraternity, Inc.;
126	126	(c) Delta Sigma Theta Sorority, Inc.;
127	127	(d) Iota Phi Theta Fraternity, Inc.;
128	128	(e) Kappa Alpha Psi Fraternity, Inc.;
129	129	(f) Omega Psi Phi Fraternity, Inc.;
130	130	(g) Phi Beta Sigma Fraternity, Inc.;
131	131	(h) Sigma Gamma Rho Sorority, Inc.; and
132	132	(i) Zeta Phi Beta Sorority, Inc.
