1010 AN ACT relating to education; requiring the board of trustees of a
1111 school district and the State Public Charter School Authority
1212 to submit to the Superintendent of Public Instruction plans
1313 for the provision of summer school to certain pupils;
1414 requiring the submission to certain entities of certain reports
1515 relating to such plans for the provision of summer school;
1616 and providing other matters properly relating thereto.
1717 Legislative Counsel’s Digest:
1818 Section 1 of this bill requires the board of trustees of each school district and
1919 the State Public Charter School Authority to submit to the Superintendent of Public
2020 Instruction a plan to provide summer school to pupils in all grades during the 2023
2121 and 2024 calendar years. Section 1 sets forth certain requirements for the plan to
2222 provide summer school. Section 1 further requires the board of trustees of a school
2323 district or the governing body of a charter school, as applicable, to provide
2424 transportation and certain meals to pupils who attend summer school. Section 1 sets
2525 forth requirements relating to the hiring and payment of teachers and other
2626 personnel for summer school. Section 1 also authorizes the board of trustees of
2727 each school district or the State Public Charter School Authority to use any
2828 available resources for the provision of summer school.
2929 Section 2 of this bill requires the board of trustees of each school district and
3030 the State Public Charter School Authority to submit a report containing certain
3131 information relating to summer school to the Superintendent of Public Instruction
3232 on or before November 30, 2023, and November 30, 2024, respectively. Section 2
3333 also requires the Superintendent of Public Instruction to submit a compilation of
3434 such reports to various governmental entities. Section 2 requires the board of
3535 trustees of a school district and the State Public Charter School Authority to
3636 identify separately for pupils who attended summer school in-person and through a
3737 program of virtual learning one or more measures of pupil achievement, including
3838 measures that compare the results of any standardized assessment or examination
3939 administered: (1) in the spring of the 2022-2023 school year with the results of any
4040 assessment or examination administered in the fall of the 2023-2024 school year;
4141 and (2) in the spring of the 2023-2024 school year with the results of any
4242 assessment or examination administered in the fall of the 2024-2025 school year.

4747 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
4848 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

5050 Section 1. 1. Not later than 30 days after the effective date
5151 of this act, the board of trustees of each school district and the State
5252 Public Charter School Authority shall submit to the Superintendent
5353 of Public Instruction a plan to provide summer school to pupils in

5858 all grades during the 2023 and 2024 calendar years. The plan must
5959 include, without limitation:
6060 (a) The option for pupils to attend summer school either in-
6161 person or through a program of virtual learning; and
6262 (b) The manner in which the school district, schools within the
6363 school district, the State Public Charter School Authority or charter
6464 schools sponsored by the State Public Charter School Authority will
6565 target pupils who are most at risk of loss of learning to receive
6666 services under the plan, including, without limitation:
6767 (1) Pupils who are members of a household that lacks the
6868 financial resources necessary to access services to address loss of
6969 learning;
7070 (2) Pupils in grade 11 or 12 who are credit deficient;
7171 (3) Pupils in prekindergarten or kindergarten;
7272 (4) Pupils in grade 1, 2 or 3 who are deficient in the subject
7373 areas of mathematics or reading;
7474 (5) Pupils in middle school or high school who are deficient
7575 in the subject areas of science, technology, engineering, the arts or
7676 mathematics;
7777 (6) Pupils with disabilities;
7878 (7) Pupils who are English learners; and
7979 (8) Pupils who are chronically absent.
8080 2. The board of trustees of a school district or the governing
8181 body of a charter school, as applicable, shall provide transportation
8282 services and school breakfast and school lunch to pupils who attend
8383 summer school pursuant to subsection 1.
8484 3. All persons hired to work in summer school pursuant to
8585 subsection 1, including, without limitation, teachers, other licensed
8686 personnel and support personnel:
8787 (a) Except as otherwise provided in subsection 4, must already
8888 have a contract to work at a school within the school district or the
8989 charter school, as applicable; and
9090 (b) Shall receive compensation for working in summer school
9191 based upon the rate in the contract between the employee and the
9292 school, in addition to the regular compensation of the employee,
9393 subject to any collective bargaining agreement.
9494 4. If a school district or charter school is unable to hire a
9595 sufficient number of persons to work in summer school pursuant to
9696 paragraph (a) of subsection 3, the school district or charter school
9797 may hire retired public employees pursuant to NRS 286.523. If a
9898 school district or charter school hires a retired public employee
9999 pursuant to this subsection, the public employee must have

105105 body of a charter school or Superintendent of Public Instruction, as
106106 applicable, for a report on the criminal history of the public
107107 employee recently enough that a report on the criminal history of the
108108 public employee does not have to be completed again.
109109 5. The compensation that is paid to an employee pursuant to
110110 subsection 3 must not be included for the purposes of calculating the
111111 future retirement benefits of the employee.
112112 6. The board of trustees of a school district or the governing
113113 body of a charter school are authorized to use any available
114114 resources in carrying out the plan developed pursuant to
115115 subsection 1.
116116 Sec. 2. 1. On or before November 30, 202 3, and
117117 November 30, 2024, respectively, the board of trustees of each
118118 school district and the State Public Charter School Authority shall
119119 submit to the Superintendent of Public Instruction a report on the
120120 plan to provide summer school developed pursuant to section 1 of
121121 this act. On or before December 31, 2023, and December 31, 2024,
122122 respectively, the Superintendent of Public Instruction shall submit a
123123 compilation of the reports received pursuant to this subsection to:
124124 (a) The Fiscal Analysis Division of the Legislative Counsel
125125 Bureau;
126126 (b) The Governor;
127127 (c) The Interim Finance Committee; and
128128 (d) The Joint Interim Standing Committee on Education.
129129 2. The report submitted pursuant to subsection 1 must, without
130130 limitation:
131131 (a) Identify the results of summer school provided to pupils
132132 pursuant to section 1 of this act;
133133 (b) Outline the amount of federal money received and how
134134 federal, state and local money was used to administer summer
135135 school;
136136 (c) State the number of pupils who attended summer school
137137 in-person;
138138 (d) State the number of pupils who attended summer school
139139 through a program of virtual learning;
140140 (e) State the number of pupils who used transportation services;
141141 (f) State the number of pupils who received school breakfast or
142142 school lunch; and
143143 (g) Identify separately for pupils who attended summer school
144144 in-person and pupils who attended summer school through a
145145 program of virtual learning:
146146 (1) One or more measures of pupil achievement, including,
147147 without limitation, measures that compare the results of any

152152 standardized assessment or examination administered by the school
153153 district or charter school, as applicable, during the spring of the
154154 2022-2023 school year with the results of any standardized
155155 assessment or examination administered during the fall of the 2023-
156156 2024 school year;
157157 (2) One or more measures of pupil achievement, including,
158158 without limitation, measures that compare the results of any
159159 standardized assessment or examination administered by the school
160160 district or charter school during the spring of the 2023-2024 school
161161 year with the results of any standardized assessment or examination
162162 administered during the fall of the 2024-2025 school year; and
163163 (3) The attendance of the pupils.
164164 Sec. 3. The provisions of NRS 354.599 do not apply to any
165165 additional expenses of a local government that are related to the
166166 provisions of this act.
167167 Sec. 4. This act becomes effective upon passage and approval,
168168 and expires by limitation on December 31, 2024.
