AN ACT relating to education; prohibiting the charging of a fee in exchange for access to the property or employees of a public school except in certain circumstances; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes, under certain circumstances, the board of trustees of a 1 school district to sell, rent or lease real property belonging to the school district. 2 (NRS 393.220) This bill prohibits any person or entity other than the board of 3 trustees of a school district, governing body of a charter school or governing body 4 of a university school for profoundly gifted pupils, or its designee, or the provisions 5 of a collective bargaining agreement from requiring a fee in exchange for access to 6 the property or employees of a public school. 7 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 393 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 A fee must not be charged in exchange for access to the school 3 property, buildings or grounds of a public school or for the right 4 to provide information to employees of a public school: 5 1. On the authority of any person or entity other than the 6 board of trustees of the school district, governing body of the 7 charter school or governing body of the university school for 8 profoundly gifted pupils responsible for the operation of the public 9 school, as applicable, or the designee of such an entity; or 10 – 2 – - *SB79* 2. Pursuant to any provision of a collective bargaining 1 agreement between a school district, charter school or university 2 school for profoundly gifted pupils and an employee organization. 3 Sec. 2. Insofar as they conflict with the provisions of such an 4 agreement, the amendatory provisions of this act do not apply 5 during the current term of any collective bargaining agreement 6 entered into before July 1, 2023, but do apply to any extension or 7 renewal of such an agreement and to any collective bargaining 8 agreement entered into on or after July 1, 2023. For the purposes of 9 this section, the term of a collective bargaining agreement ends on 10 the date provided in the agreement, notwithstanding any provision 11 of the agreement that it remains in effect, in whole or in part, after 12 that date until a successor agreement becomes effective. 13 Sec. 3.
