99 AN ACT relating to state employment; authorizing, under certain
1010 circumstances, an appointing authority to appoint without
1111 competition certain persons to fill a position in the classified
1212 service of the Executive Department of State Government;
1313 and providing other matters properly relating thereto.
1414 Legislative Counsel’s Digest:
1515 Under existing law, a position in the classified service of the Executive
1616 Department of State Government may be filled without competition only under
1717 certain circumstances. (NRS 284.305) This bill sets forth an additional
1818 circumstance in which a position in the classified service may be filled without
1919 competition. Specifically, this bill authorizes a position in the classified service to
2020 be filled by a person without competition if the person: (1) meets the minimum
2121 qualifications for the position; and (2) has successfully completed at least 900 hours
2222 of service in an AmeriCorps, Youth Conservation Corps or Job Corps program in
2323 this State not more than 2 years before the person applies for the position and such
2424 service in the AmeriCorps, Youth Conservation Corps or Job Corps program, as
2525 applicable, was directly related to the job duties of the position in the classified
2626 service.

3131 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
3232 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

3434 Section 1. Chapter 284 of NRS is hereby amended by adding
3535 thereto a new section to read as follows:
3636 An appointing authority may appoint a person to fill a position
3737 in the classified service without competition if the person:
3838 1. Meets the minimum qualifications for the position; and
3939 2. Has successfully completed at least 900 hours of service in
4040 an AmeriCorps, Youth Conservation Corps or Job Corps program
4141 in this State not more than 2 years before the person applies for
4242 the position in the classified service and such service in the
4343 AmeriCorps, Youth Conservation Corps or Job Corps program, as
4444 applicable, was directly related to the job duties of the position in
4545 the classified service.
4646 Sec. 2. NRS 284.305 is hereby amended to read as follows:
4747 284.305 1. Except as otherwise provided in subsection 2,
4848 positions in the classified service may be filled without competition
4949 only as provided in NRS 284.155, 284.300, 284.307, 284.309,

5656 2. The Commission may adopt regulations which provide for
5757 filling positions in the classified service without competition in
5858 cases involving:
5959 (a) The appointment of a current employee with a disability to a
6060 position at or below the grade of his or her position if the employee
6161 becomes unable to perform the essential functions of his or her
6262 position with or without reasonable accommodation;
6363 (b) The demotion of a current employee;
6464 (c) The reemployment of a current or former employee who was
6565 or will be adversely affected by layoff, military service,
6666 reclassification or a permanent partial disability arising out of and in
6767 the course of the employment of the current or former employee; or
6868 (d) The reappointment of a current employee.
