9	9	AN ACT relating to state employment; authorizing, under certain
10	10	circumstances, an appointing authority to appoint without
11	11	competition certain persons to fill a position in the classified
12	12	service of the Executive Department of State Government;
13	13	and providing other matters properly relating thereto.
14	14	Legislative Counsel’s Digest:
15	15	Under existing law, a position in the classified service of the Executive
16	16	Department of State Government may be filled without competition only under
17	17	certain circumstances. (NRS 284.305) This bill sets forth an additional
18	18	circumstance in which a position in the classified service may be filled without
19	19	competition. Specifically, this bill authorizes a position in the classified service to
20	20	be filled by a person without competition if the person: (1) meets the minimum
21	21	qualifications for the position; and (2) has successfully completed at least 900 hours
22	22	of service in an AmeriCorps, Youth Conservation Corps or Job Corps program in
23	23	this State not more than 2 years before the person applies for the position and such
24	24	service in the AmeriCorps, Youth Conservation Corps or Job Corps program, as
25	25	applicable, was directly related to the job duties of the position in the classified
26	26	service.

31	31	THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
32	32	SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

34	34	Section 1. Chapter 284 of NRS is hereby amended by adding
35	35	thereto a new section to read as follows:
36	36	An appointing authority may appoint a person to fill a position
37	37	in the classified service without competition if the person:
38	38	1. Meets the minimum qualifications for the position; and
39	39	2. Has successfully completed at least 900 hours of service in
40	40	an AmeriCorps, Youth Conservation Corps or Job Corps program
41	41	in this State not more than 2 years before the person applies for
42	42	the position in the classified service and such service in the
43	43	AmeriCorps, Youth Conservation Corps or Job Corps program, as
44	44	applicable, was directly related to the job duties of the position in
45	45	the classified service.
46	46	Sec. 2. NRS 284.305 is hereby amended to read as follows:
47	47	284.305 1. Except as otherwise provided in subsection 2,
48	48	positions in the classified service may be filled without competition
49	49	only as provided in NRS 284.155, 284.300, 284.307, 284.309,

55	55	284.3775 [.] and section 1 of this act.
56	56	2. The Commission may adopt regulations which provide for
57	57	filling positions in the classified service without competition in
58	58	cases involving:
59	59	(a) The appointment of a current employee with a disability to a
60	60	position at or below the grade of his or her position if the employee
61	61	becomes unable to perform the essential functions of his or her
62	62	position with or without reasonable accommodation;
63	63	(b) The demotion of a current employee;
64	64	(c) The reemployment of a current or former employee who was
65	65	or will be adversely affected by layoff, military service,
66	66	reclassification or a permanent partial disability arising out of and in
67	67	the course of the employment of the current or former employee; or
68	68	(d) The reappointment of a current employee.
