AN ACT relating to economic development; providing that money remaining in the Nevada Air Service Development Fund does not revert to the State General Fund at the end of a fiscal year; making an appropriation to the Nevada Air Service Development Fund; making an appropriation to the Fund for Aviation; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law creates within the Office of Economic Development in the Office 1 of the Governor the Nevada Air Service Development Commission, which consists 2 of the Executive Director of the Office of Economic Development and certain 3 members who are appointed by the Governor. (NRS 231.680) Existing law also 4 creates the Nevada Air Service Development Fund and requires the Commission to 5 develop a program to make grants of money from the Fund to an air carrier or any 6 governmental entity for the purpose of establishing air service or providing 7 enhanced air service routes that service certain airports. (NRS 231.690, 231.710) 8 Section 1 of this bill provides that money remaining in the Nevada Air Service 9 Development Fund does not revert to the State General Fund at the end of a fiscal 10 year and must be carried forward to the next fiscal year. Section 2 of this bill makes 11 an appropriation from the State General Fund to the Nevada Air Service 12 Development Fund in the amount of $10,000,000 for the purpose of conducting a 13 study of the development of intrastate air service in this State and for the purpose of 14 making grants of money to an air carrier or any governmental entity that will 15 service or provide enhanced air service routes to certain airports. 16 Existing law creates the Fund for Aviation in the State Treasury and requires 17 the Director of the Department of Transportation to administer the Fund for 18 Aviation. Existing law authorizes the Director to award grants to counties, cities 19 – 2 – - *AB100* and other local governments, except for facilities owned or controlled by the Reno-20 Tahoe Airport Authority or a county whose population is 700,000 or more 21 (currently only Clark County) for the planning, establishment, development, 22 construction, enlargement, improvement or maintenance of any airport, landing 23 area or air navigation facility owned or controlled by the county, city or other local 24 government. (NRS 494.048) Section 3 of this bill makes an appropriation from the 25 State General Fund to the Fund for Aviation in the amount of $1,000,000 for Fiscal 26 Year 2025-2026 and $1,000,000 for Fiscal Year 2026-2027 to match money that is 27 available from the Federal Aviation Administration for these purposes. 28 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 231.690 is hereby amended to read as follows: 1 231.690 1. There is hereby created as a special revenue fund 2 in the State Treasury the Nevada Air Service Development Fund. 3 Any money in the Fund remaining at the end of a fiscal year does 4 not revert to the State General Fund, and the balance in the Fund 5 must be carried forward to the next fiscal year. 6 2. The Commission may accept gifts, bequests, grants, 7 appropriations and donations from any source for deposit in the 8 Fund. 9 3. The money in the Fund must be invested as other state funds 10 are invested. All interest earned on the deposit or investment of the 11 money in the Fund, after deducting any applicable charges, must be 12 credited to the Fund. Claims against the Fund must be paid as other 13 claims against the State are paid. 14 4. The Commission may make grants of money from the Fund 15 to air carriers that satisfy the criteria set forth in NRS 231.710. 16 Sec. 2. 1. There is hereby appropriated from the State 17 General Fund to the Nevada Air Service Development Fund created 18 by NRS 231.690 the sum of $10,000,000. 19 2. The amount appropriated by subsection 1 must be used for 20 the purpose of conducting a study of the development of intrastate 21 air service in this State and for the purpose of making grants of 22 money pursuant to NRS 231.710. 23 Sec. 3. 1. There is hereby appropriated from the State 24 General Fund to the Fund for Aviation created by NRS 494.048 the 25 following sums: 26 For the Fiscal Year 2025-2026 ............................... $1,000,000 27 For the Fiscal Year 2026-2027 ............................... $1,000,000 28 2. The money appropriated by subsection 1 must be used by 29 rural airports to match money that is available from the Federal 30 Aviation Administration. 31 – 3 – - *AB100* Sec. 4. This act becomes effective on July 1, 2025. 1 H
