AN ACT relating to state buildings; authorizing the Administrator
of the State Public Works Division of the Department of
Administration to offer rooms in the Capitol Building for
rent or lease for the purpose of holding an event; and
providing other matters properly relating thereto.
Legislative Counsel’s Digest:
Existing law: (1) provides that, at all times, the maintenance of the Capitol 1
Building is under the supervision of the Administrator of the State Public Works 2
Division of the Department of Administration; and (2) requires the Administrator to 3
assign certain rooms in the Capitol Building for use in such manner as the public 4
service may require. Further, existing law places the former Assembly, Senate and 5
Supreme Court chambers on the second floor of the Capitol Building under the 6
management of the Museum Director of the Nevada State Museum for the purpose 7
of establishing and maintaining a Government Museum. (NRS 331.120, 331.130) 8
Section 1 of this bill authorizes the Administrator, in coordination with the 9
Museum Director, to rent or lease rooms in the Capitol Building for the purpose of 10
holding an event. 11
Existing law makes it a misdemeanor for any person to sell, barter, give, or in 12
any way dispose of any spirituous or malt liquors, wines or cider, of any description 13
whatever, within the Capitol Building. (NRS 331.190) Section 3 of this bill creates 14
an exception to this provision of law for an event that is held in the Capitol 15
Building pursuant to section 1. 16
Section 2 of this bill applies the definitions in existing law governing the 17
administration and control of state buildings, grounds and properties to the 18
provisions of section 1. 19

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 331 of NRS is hereby amended by adding 1
thereto a new section to read as follows: 2
1. The Administrator, in coordination with the Museum 3
Director of the Nevada State Museum, may rent or lease rooms in 4
the Capitol Building for the purpose of holding an event. 5
2. The Administrator shall charge a fee for the rental or lease 6
of a room pursuant to subsection 1. 7
3. Any money the Administrator receives pursuant to 8
subsection 2: 9
(a) Must be deposited in the State Treasury and accounted for 10
separately in the State General Fund; 11
(b) May be used by the Administrator only for maintenance of 12
the Capitol Building; and 13
(c) Does not revert to the State General Fund at the end of 14
each fiscal year. 15
4. Any interest or income earned on the money in the 16
account, after deducting any applicable charges, must be credited 17
to the account. Any claims against the account must be paid as 18
other claims against the State are paid. 19
5. The Administrator shall adopt regulations necessary to 20
carry out the provisions of this section. 21
Sec. 2. NRS 331.010 is hereby amended to read as follows: 22
331.010 As used in NRS 331.010 to 331.145, inclusive, and 23
section 1 of this act, unless the context otherwise requires: 24
1. “Administrator” means the Administrator of the Division. 25
2. “Buildings and Grounds Section” means the Buildings and 26
Grounds Section of the Division. 27
3. “Department” means the Department of Administration. 28
4. “Director” means the Director of the Department. 29
5. “Division” means the State Public Works Division of the 30
Department. 31
Sec. 3. NRS 331.190 is hereby amended to read as follows: 32
331.190 [Any] 33
1. Except as otherwise provided in subsection 2, any person 34
who sells, barters, gives, or in any way disposes of any spirituous or 35
malt liquors, wines or cider, of any description whatever, within the 36
Capitol Building of this state, shall be guilty of a misdemeanor. 37
2. The provisions of subsection 1 do not apply to an event that 38
is held in the Capitol Building pursuant to section 1 of this act. 39
