AN ACT relating to the Department of Motor Vehicles; authorizing the imprinting of individualized symbols or codes for different medical conditions on driver’s licenses or identification cards; revising the manner in which the Department communicates certain information concerning liability insurance; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes the Department of Motor Vehicles to adopt regulations 1 establishing a program for the imprinting of a symbol indicating a medical 2 condition on a driver’s license or identification card. If such a program is adopted, 3 existing law: (1) requires the Department to adopt a single symbol to indicate that a 4 person has a medical condition; and (2) prohibits the Department from adopting 5 individualized symbols for different medical conditions. (NRS 483.3485, 483.863) 6 Sections 1 and 2 of this bill authorize the Department to adopt individualized 7 symbols or codes for different medical conditions in addition to adopting the 8 required single symbol to indicate that a person has a medical condition. 9 Existing law requires the Department to mail to the registered owner of a motor 10 vehicle a request for information regarding the liability insurance covering the 11 motor vehicle, if the Department is unable to verify that the motor vehicle is 12 covered by a policy of liability insurance. If the Department does not receive the 13 requested information, existing law requires the Department to suspend the 14 registration of the motor vehicle after sending a notice of suspension of registration 15 by certified mail. (NRS 485.317) Section 3 of this bill requires the Department to 16 send a request for information regarding liability insurance coverage by electronic 17 notification, if the registered owner has elected to receive information from the 18 – 2 – - *AB20_R1* Department by electronic notification. Section 3 also requires the Department to 19 send a notice of suspension of registration by electronic notification, if the 20 registered owner has elected to receive information from the Department by 21 electronic notification, in addition to sending the notice by certified mail or a mail 22 service that requires the signature of the recipient and confirmation of delivery. 23 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 483.3485 is hereby amended to read as 1 follows: 2 483.3485 1. The Department may adopt regulations 3 establishing a program for the imprinting of a symbol indicating a 4 medical condition on a driver’s license issued by the Department. 5 2. If the Department establishes a program pursuant to 6 subsection 1: 7 (a) [Except as otherwise provided in this title, the] The 8 Department shall adopt a single symbol for imprinting on a driver’s 9 license to indicate a medical condition and [shall not] may also 10 adopt individualized symbols or codes for different medical 11 conditions. 12 (b) The regulations adopted by the Department must provide 13 that a person is eligible to have the symbol indicating a medical 14 condition imprinted on his or her driver’s license if the person is: 15 (1) On anticoagulants; or 16 (2) A person with: 17 (I) Diabetes; 18 (II) Epilepsy; 19 (III) Blindness and low vision; 20 (IV) Deafness; 21 (V) Coronary atherosclerosis; 22 (VI) Chronic obstructive pulmonary disease; 23 (VII) A food allergy; 24 (VIII) Malignant hyperthermia; 25 (IX) Sickle cell disease; 26 (X) Systemic lupus erythematosus; 27 (XI) Heart disease; 28 (XII) Hemophilia; 29 (XIII) Schizophrenia; 30 (XIV) Depression; or 31 (XV) A mental illness. 32 (c) The Department shall maintain a record of the medical 33 condition for which the symbol indicating a medical condition was 34 imprinted on the driver’s license of an eligible person. The record 35 must be maintained in the same location and manner as all other 36 – 3 – - *AB20_R1* records relating to the driver’s license of the person, including, 1 without limitation, the records relating to the driver’s license of the 2 person that are made available to law enforcement agencies. If 3 the Department maintains such information in the form of a code, 4 the code used must conform with the International Classification of 5 Diseases, Ninth Revision, Clinical Modification, or the most current 6 revision, adopted by the National Center for Health Statistics and 7 the Centers for Medicare and Medicaid Services. 8 (d) The Department shall maintain on the Internet website of the 9 Department information about the program established pursuant to 10 subsection 1, including, without limitation, the manner in which a 11 person may obtain a driver’s license which has been imprinted with 12 a symbol indicating a medical condition. 13 (e) The regulations adopted by the Department may provide that 14 a person is eligible to have the symbol indicating a medical 15 condition imprinted on his or her driver’s license to indicate such 16 other medical conditions not listed in paragraph (b) as the 17 Department deems appropriate. The Department shall provide a 18 means for members of the public to suggest additional medical 19 conditions for inclusion in the regulations adopted by the 20 Department. 21 3. The Department may apply for and accept any gift, grant, 22 appropriation or other donation to assist in carrying out a program 23 established pursuant to the provisions of this section. 24 Sec. 2. NRS 483.863 is hereby amended to read as follows: 25 483.863 1. The Department may adopt regulations 26 establishing a program for the imprinting of a symbol indicating a 27 medical condition on an identification card issued by the 28 Department. 29 2. The record 14 must be maintained in the same location and manner as all other 15 records relating to the identification card of the person, including, 16 without limitation, the records relating to the identification card of 17 the person that are available to law enforcement agencies. If the 18 Department maintains such information in the form of a code, the 19 code used must conform with the International Classification of 20 Diseases, Ninth Revision, Clinical Modification, or the most current 21 revision, adopted by the National Center for Health Statistics and 22 the Centers for Medicare and Medicaid Services. 23 (d) The Department shall, at the time of the issuance or renewal 24 of an identification card, give the holder the opportunity to have 25 imprinted on his or her identification card a symbol indicating a 26 medical condition. 27 (e) The Department shall maintain on the Internet website of the 28 Department information about the program established pursuant to 29 subsection 1, including, without limitation, the manner in which a 30 person may obtain an identification card which has been imprinted 31 with a symbol indicating a medical condition. 32 (f) The regulations adopted by the Department may provide that 33 a person is eligible to have the symbol indicating a medical 34 condition imprinted on his or her identification card to indicate such 35 other medical conditions not listed in paragraph (b) as the 36 Department deems appropriate. The Department shall provide a 37 means for members of the public to suggest additional medical 38 conditions for inclusion in the regulations adopted by the 39 Department. 40 3. The Department may apply for and accept any gift, grant, 41 appropriation or other donation to assist in carrying out a program 42 established pursuant to the provisions of this section. 43 – 5 – - *AB20_R1* Sec. 3. NRS 485.317 is hereby amended to read as follows: 1 485.317 1. The Department shall verify that each motor 2 vehicle which is registered in this State is covered by a policy of 3 liability insurance as required by NRS 485.185. 4 2. Except as otherwise provided in this subsection, the 5 Department may use any information to verify whether a motor 6 vehicle is covered by a policy of liability insurance as required by 7 NRS 485.185. The Department may not use the name of the owner 8 of a motor vehicle as the primary means of verifying that a motor 9 vehicle is covered by a policy of liability insurance. 10 3. If the Department is unable to verify that a motor vehicle is 11 covered by a policy of liability insurance as required by NRS 12 485.185, the Department shall send a request for information by 13 [first-class] mail or, if the registered owner of the motor vehicle 14 has elected to receive information from the Department by 15 electronic notification, by electronic notification, to the registered 16 owner of the motor vehicle. The owner shall submit all the 17 information which is requested to the Department within 15 days 18 after the date on which the request for information was [mailed] sent 19 by the Department. If the Department does not receive the requested 20 information within 15 days after it [mailed] sent the request to the 21 owner, the Department shall send to the owner a notice of 22 suspension of registration by certified mail [.] or a mail service that 23 requires the signature of the recipient and confirmation of 24 delivery and, if the owner has elected to receive information from 25 the Department by electronic notification, by electronic 26 notification. The notice must inform the owner that unless the 27 Department is able to verify that the motor vehicle is covered by a 28 policy of liability insurance as required by NRS 485.185 within 10 29 days after the date on which the notice was sent by the Department, 30 the owner’s registration will be suspended pursuant to subsection 4. 31 4. The Department shall suspend the registration and require 32 the return to the Department of the license plates of any vehicle for 33 which the Department cannot verify the coverage of liability 34 insurance required by NRS 485.185. 35 5. Except as otherwise provided in subsection 6, the 36 Department shall reinstate the registration of the vehicle and reissue 37 the license plates only upon verification of current insurance and 38 compliance with the requirements for reinstatement of registration 39 prescribed in paragraph (a) of subsection 7 of NRS 482.480. 40 6. If the Department suspends the registration of a motor 41 vehicle pursuant to subsection 4 because the registered owner of the 42 motor vehicle failed to have insurance on the date specified in the 43 form for verification, and if the registered owner, in accordance with 44 regulations adopted by the Department, proves to the satisfaction of 45 – 6 – - *AB20_R1* the Department that the owner was unable to comply with the 1 provisions of NRS 485.185 on that date because of extenuating 2 circumstances or that the motor vehicle was a dormant vehicle and 3 the owner failed to cancel the registration in accordance with 4 subsection 3 of NRS 485.320, the Department may: 5 (a) Reinstate the registration of the motor vehicle and reissue the 6 license plates upon payment by the registered owner of a fee of $50, 7 which must be deposited in the Account for Verification of 8 Insurance created by subsection 7 of NRS 482.480; or 9 (b) Remove the suspension of the registration without the 10 payment of a fee or administrative fine. 11 The Department shall adopt regulations to carry out the 12 provisions of this subsection. 13 Sec. 4. 1. This section becomes effective upon passage and 14 approval. 15 2. Sections 1 and 2 of this act become effective: 16 (a) Upon passage and approval for the purpose of adopting any 17 regulations and performing any other preparatory administrative 18 tasks that are necessary to carry out the provisions of this act; and 19 (b) On October 1, 2025, for all other purposes. 20 3. Section 3 of this act becomes effective on October 1, 2025. 21 H
