AN ACT relating to identification cards; authorizing the Department 
of Health and Human Services to establish a program to 
issue identification cards to Nevada residents who are 
experiencing homelessness; requiring an applicant for an 
identification card to attest to certain facts and provide 
certain information providing for the change of the full 
legal name on an identification card under certain 
circumstances; providing for the expiration of an 
identification card issued by the Department; prohibiting 
certain conduct related to an identification card; 
authorizing certain local governments to accept an 
identification card issued by the Department for certain 
purposes; providing penalties; and providing other matters 
properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law requires the Director of the Department of Motor Vehicles to issue 1 
identification cards to: (1) qualified residents of this State who are 10 years of age 2 
or older and do not hold a valid driver’s license or identification card from any state 3 
or jurisdiction; and (2) qualified seasonal residents who do not hold a valid Nevada 4 
driver’s license. (NRS 483.820, 483.830) Existing law requires the Department of 5 
Health and Human Services to establish the Nevada Housing Crisis Response 6 
System and requires the System to collaborate with the Department of Motor 7 
Vehicles to facilitate assistance to persons experiencing homelessness who wish to 8

apply for an identification card issued by the Department of Motor Vehicles.  9 
(NRS 422A.680) 10 
 Section 7 of this bill authorizes the Department of Health and Human Services 11 
to establish and administer a program to issue identification cards to residents of 12 
this State who are experiencing homelessness. Section 7 limits the issuance of such 13 
cards to residents of this State who are 10 years of age or older and do not hold a 14 
valid driver’s license or identification card from any state or jurisdiction. Section 7: 15 
(1) prohibits the Department from charging a fee for the issuance, renewal or 16 
replacement of an identification card; and (2) authorizes the Department to accept 17 
gifts, grants and donations of money to fund the program to provide identification 18 
cards to residents of this State who are experiencing homelessness. Sections 7 and 19 
19 of this bill make confidential personal information contained in any file or 20 
record of the Department relating to an identification card or an application for an 21 
identification card. 22 
 Section 8 of this bill prescribes the form of identification cards issued by the 23 
Department and requires the Department to adopt regulations prescribing the 24 
information that must be contained on such identification cards. 25 
 Section 9 of this bill requires an application for an identification card issued by 26 
the Department to include a statement from the applicant attesting that the applicant 27 
is a person who: (1) is experiencing homelessness; and (2) does not hold a valid 28 
driver’s license or identification card from any state or jurisdiction. 29 
 Section 10 of this bill requires an applicant to furnish proof of his or her full 30 
legal name and age to the Department by presenting an original or certified copy of 31 
the documents required by the Department of Motor Vehicles as proof of the full 32 
legal name and age of an applicant for an identification card issued by the 33 
Department of Motor Vehicles. Section 10 prohibits the Department of Health and 34 
Human Services from issuing an identification card to an applicant who does not 35 
furnish such proof unless the identification card clearly indicates on the face of the 36 
card that the Department has not verified the full legal name and age of the card 37 
holder. 38 
 Section 11 of this bill requires a person to request that the Department change 39 
his or her full legal name on an identification card issued by the Department after a 40 
legal name change as indicated on certain documents and authorizes a person to 41 
request that the Department change his or her full legal name on an identification 42 
card upon the occurrence of certain life events. Section 11 prohibits the Department 43 
from charging or collecting a fee for making a change to an identification card. 44 
 Section 12 of this bill applies to the Department the prohibition of existing law 45 
against the issuance of an identification card to or renewal of the identification card 46 
of a sex offender or an offender convicted of a crime against a child until the 47 
Department receives information submitted by the Central Repository for Nevada 48 
Records of Criminal History or other satisfactory evidence that the offender is in 49 
compliance with the provisions of law governing the registration of sex offenders 50 
and offenders convicted of a crime against a child. (NRS 179D.570) Section 12 51 
provides that an identification card issued to such offenders expires on the first 52 
anniversary date of the offender’s birthday, measured from the birthday nearest to 53 
the date of issuance or renewal of the card. Section 17 of this bill authorizes the 54 
Central Repository to share information concerning sex offenders and offenders 55 
convicted of a crime against a child with the Department to carry out the provisions 56 
of section 12. 57 
 Section 13 of this bill provides that an identification card issued by the 58 
Department generally remains valid until expiration unless the holder becomes 59 
licensed in any state or jurisdiction to drive a motor vehicle or obtains an 60 
identification card from any state or jurisdiction. Section 13 requires an 61 
identification card issued by the Department to be surrendered upon the issuance of 62 
a driver’s license from any state or jurisdiction, an identification card from another 63

state or jurisdiction or an identification card issued by the Department of Motor 64 
Vehicles. 65 
 Section 14 of this bill requires the Department to adopt regulations prescribing 66 
when an identification card expires and requires the date of expiration adopted by 67 
the Department to be not later than the eighth anniversary of the birthday of the 68 
holder of the identification card measured from the birthday nearest to the date of 69 
issuance or renewal of the card. 70 
 Section 15 of this bill authorizes a person whose identification card is lost or 71 
destroyed to obtain a duplicate card. 72 
 Section 16 of this bill provides that a person who commits certain acts relating 73 
to an identification card is guilty of a misdemeanor. 74 
 Section 18 of this bill authorizes certain local governments to accept an 75 
identification card issued by the Department of Health and Human Services for 76 
certain purposes. 77 
 Sections 2-6 of this bill define certain terms for the purposes of sections 2-16. 78 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 422A of NRS is hereby amended by 1 
adding thereto the provisions set forth as sections 2 to 16, inclusive, 2 
of this act. 3 
 Sec. 2.  As used in sections 2 to 16, inclusive, of this act, 4 
unless the context otherwise requires, the words and terms defined 5 
in sections 3 to 6, inclusive, of this act have the meanings ascribed 6 
to them in those sections. 7 
 Sec. 3.  “Full legal name” means a natural person’s first 8 
name or given name, middle name and family name or last name, 9 
without the use of initials or a nickname. The term includes a full 10 
legal name that has been changed pursuant to the provisions of 11 
section 11 of this act. 12 
 Sec. 4.  “Identification card” means an identification card 13 
issued by the Department pursuant to sections 2 to 16, inclusive, of 14 
this act. 15 
 Sec. 5.  “Person experiencing homelessness” means a person 16 
who is transient, at imminent risk of homelessness or homeless. 17 
 Sec. 6.  “Resident” means a person who has actually resided 18 
in this State for at least 6 months. 19 
 Sec. 7.  1. To the extent that money is available for that 20 
purpose, the Department, through a division of the Department 21 
designated by the Director, may establish and administer a 22 
program to issue photo identification cards to residents of this 23 
State who are persons experiencing homelessness. If the 24 
Department establishes such a program, the Department shall: 25 
 (a) Prepare suitable identification cards. 26 
 (b) Prepare and furnish application forms for those cards. 27

 (c) Receive applications, grant or deny the applications and 1 
maintain files of applications. 2 
 (d) Issue identification cards, recall and cancel identification 3 
cards when necessary and maintain records adequate to preserve 4 
the integrity of the system for identification cards. 5 
 2. A person who applies for an identification card in 6 
accordance with the provisions of sections 2 to 16, inclusive, of 7 
this act and who is not ineligible to receive an identification card 8 
pursuant to section 12 of this act is entitled to receive an 9 
identification card if the person: 10 
 (a) Is a resident of this State; 11 
 (b) Is 10 years of age or older; and 12 
 (c) Does not hold a valid driver’s license or identification card 13 
from any state or jurisdiction. 14 
 3. The Department shall not charge a fee for the issuance, 15 
renewal or replacement of an identification card. 16 
 4. The Department may accept gifts, grants and donations of 17 
money to fund the program to issue identification cards to 18 
residents of this State who are experiencing homelessness. Money 19 
received by the Department pursuant to this subsection does not 20 
revert to the State General Fund at the end of any fiscal year and 21 
must be carried forward to the next fiscal year. 22 
 5. The personal information contained in any file or record 23 
of the Department relating to an identification card or an 24 
application for an identification card is confidential and is not a 25 
public record for the purposes of chapter 239 of NRS. The 26 
Department may only disclose information made confidential 27 
pursuant to this subsection if such disclosure is necessary for the 28 
Department to carry out its duties or upon the lawful order of a 29 
court of competent jurisdiction. 30 
 Sec. 8.  1. The form of identification cards issued by the 31 
Department must be similar to that of identification cards issued 32 
by the Department of Motor Vehicles pursuant to NRS 483.810 to 33 
483.890, inclusive, but distinguishable in color or otherwise.  34 
 2. Identification cards issued by the Department must comply 35 
with the requirements of section 202(d)(11) of the Real ID Act of 36 
2005, Public Law 109-13, Division B, Title II, 119 Stat. 302, 312-37 
15, 49 U.S.C. § 30301 note. 38 
 3. Identification cards issued by the Department do not 39 
authorize the operation of any motor vehicle. 40 
 4. If the Department establishes the program described in 41 
section 7 of this act, the Department shall adopt regulations 42 
prescribing the information that must be contained on the 43 
identification card. 44

 Sec. 9.  1. Every application for an identification card must 1 
be made upon a form prescribed by the Department and include, 2 
without limitation, a statement from the applicant attesting that 3 
the applicant: 4 
 (a) Does not hold a valid driver’s license or identification card 5 
from any state or jurisdiction. 6 
 (b) Is a person experiencing homelessness. 7 
 2. When the form is completed, the applicant must sign the 8 
form and verify the contents before a person authorized to 9 
administer oaths. Officers and employees of the Department may 10 
administer those oaths without charge. 11 
 Sec. 10.  1. Except as otherwise provided in subsection 2, 12 
every applicant for an identification card pursuant to sections 2 to 13 
16, inclusive, of this act must furnish proof of his or her full legal 14 
name and age by presenting an original or certified copy of the 15 
documents required by the Department of Motor Vehicles 16 
pursuant to NRS 483.860 as proof of the full legal name and age 17 
of an applicant for the issuance of an identification card by the 18 
Department of Motor Vehicles. 19 
 2. If an applicant for an identification card does not furnish 20 
the proof of his or her full legal name and age as required by 21 
subsection 1, the Department must not issue to the applicant an 22 
identification card, unless the identification card clearly indicates 23 
on the face of the card that the Department has not verified the 24 
full legal name and age of the card holder pursuant to  25 
subsection 1. 26 
 Sec. 11.  1. A person must request that the Department 27 
change his or her full legal name on an identification card after a 28 
legal change of the person’s name indicated on: 29 
 (a) An order of a court of competent jurisdiction changing the 30 
name of the person; 31 
 (b) A decree of adoption; 32 
 (c) A certificate of marriage; or 33 
 (d) A decree of divorce. 34 
 2. A request required pursuant to subsection 1 must: 35 
 (a) Be made on a form prescribed by the Department; and 36 
 (b) Include an original or certified copy of the order, decree or 37 
certificate. 38 
 3. A person may request that the Department change his or 39 
her full legal name on an identification card upon adoption, 40 
marriage, divorce or the death of a spouse. Such a request must be 41 
made on a form prescribed by the Department and must include: 42 
 (a) Upon adoption, an original or certified copy of a decree of 43 
adoption and an affidavit on a form prescribed by the Department 44 
indicating the person’s choice to: 45

  (1) Change his or her last name to the last name of one of 1 
his or her adoptive parents; 2 
  (2) Use his or her last name hyphenated with the last name 3 
of one of his or her adoptive parents; or 4 
  (3) Replace his or her middle name with his or her last 5 
name and use as his or her last name the last name of one of his 6 
or her adoptive parents. 7 
 (b) Upon marriage, an original or certified copy of a certificate 8 
of marriage and an affidavit on a form prescribed by the 9 
Department indicating the person’s choice to: 10 
  (1) Change his or her last name to the last name of his or 11 
her spouse; 12 
  (2) Use his or her last name hyphenated with the last name 13 
of his or her spouse; or 14 
  (3) Replace his or her middle name with his or her last 15 
name and use as his or her last name the last name of his or her 16 
spouse. 17 
 (c) Upon divorce, an original or certified copy of a decree of 18 
divorce and an affidavit on a form prescribed by the Department 19 
indicating the person’s choice to: 20 
  (1) Change his or her last name back to a last name he or 21 
she used before marriage; or 22 
  (2) If he or she changed his or her name pursuant to 23 
subparagraph (3) of paragraph (b), change his or her middle 24 
name and last name back to the middle name and last name he or 25 
she used before the marriage; or 26 
 (d) Upon the death of a spouse, an original or certified copy of 27 
a certificate of marriage and an original or certified copy of a 28 
death certificate and an affidavit on a form prescribed by the 29 
Department indicating the person’s choice to: 30 
  (1) Change his or her last name back to a name he or she 31 
used before the marriage; or 32 
  (2) If he or she changed his or her name pursuant to 33 
subparagraph (3) of paragraph (b), change his or her middle 34 
name and last name back to the middle name and last name he or 35 
she used before marriage. 36 
 4. Upon receipt of a request that meets the requirements of 37 
subsection 2 or 3, the Department shall: 38 
 (a) Change the full legal name of a person on the 39 
identification card issued to the person by the Department; and 40 
 (b) Provide to the person who requested the change a 41 
document which evidences that such a change was made pursuant 42 
to this section. 43 
 5. The Department shall not charge or collect a fee for a 44 
change to an identification card pursuant to this section. 45

 Sec. 12.  1. The Department shall not issue an identification 1 
card to an offender or renew the identification card of an offender 2 
until the Department has received information submitted by the 3 
Central Repository pursuant to NRS 179D.570 or other 4 
satisfactory evidence indicating that the offender is in compliance 5 
with the provisions of chapter 179D of NRS. 6 
 2. If an offender is not in compliance with the provisions of 7 
chapter 179D of NRS, the Department: 8 
 (a) Shall not issue an identification card to the offender or 9 
renew the identification card of the offender; and 10 
 (b) Shall advise the offender to contact the Central Repository 11 
to determine the actions that the offender must take to be in 12 
compliance with the provisions of chapter 179D of NRS. 13 
 3. An identification card issued to an offender expires on the 14 
first anniversary date of the offender’s birthday, measured in the 15 
case of an original identification card, a renewal identification 16 
card and a renewal of an expired identification card, from the 17 
birthday nearest the date of issuance or renewal. 18 
 4. The Department may adopt regulations to carry out the 19 
provisions of this section. 20 
 5. As used in this section: 21 
 (a) “Central Repository” means the Central Repository for 22 
Nevada Records of Criminal History. 23 
 (b) “Offender” includes, without limitation, an “offender 24 
convicted of a crime against a child” as defined in NRS 25 
179D.0559 and a “sex offender” as defined in NRS 179D.095. 26 
 Sec. 13.  Except as otherwise provided in section 14 of this 27 
act, an identification card that is issued pursuant to sections 2 to 28 
16, inclusive, of this act remains valid until its expiration date so 29 
long as the facts and circumstances declared in the application 30 
and stated on the card do not change and the person does not 31 
become licensed in any state or jurisdiction to drive a motor 32 
vehicle or obtain an identification card from any state or 33 
jurisdiction. An identification card that is issued pursuant to 34 
sections 2 to 16, inclusive, of this act does not become invalid 35 
because the person ceases to be a person experiencing 36 
homelessness. An identification card issued pursuant to sections 2 37 
to 16, inclusive, of this act must be surrendered upon the issuance 38 
of: 39 
 1.  A driver’s license from any state or jurisdiction; 40 
 2.  An identification card from another state or jurisdiction; 41 
or 42 
 3.  An identification card issued by the Department of Motor 43 
Vehicles pursuant to NRS 483.810 to 483.890, inclusive. 44

 Sec. 14.  1. Except as otherwise provided in sections 12 and 1 
13 of this act, an identification card and a renewal of an 2 
identification card issued pursuant to sections 2 to 16, inclusive, of 3 
this act expires as prescribed by the regulations adopted pursuant 4 
to subsection 2. 5 
 2. The Department shall adopt regulations prescribing when 6 
an identification card expires. The regulations adopted by the 7 
Department pursuant to this section must not establish an 8 
expiration date which is later than the eighth anniversary of the 9 
birthday of the holder of the identification card measured, in the 10 
case of an original identification card, a renewal identification 11 
card and a renewal of an expired identification card, from the 12 
birthday nearest the date of issuance or renewal. 13 
 3. An identification card is renewable at any time before its 14 
expiration upon application. 15 
 Sec. 15.  1. Upon furnishing information that his or her 16 
identification card is lost or destroyed, the person to whom the 17 
original was issued may obtain a duplicate. 18 
 2. If the original of a duplicated identification card is 19 
subsequently recovered or a lost identification card is found, the 20 
person having possession shall return it immediately to the 21 
Department. 22 
 Sec. 16.  A person who: 23 
 1.  Forges or alters an identification card or knowingly 24 
possesses an altered or forged identification card; 25 
 2.  Refuses to surrender an identification card for 26 
cancellation when so directed by the Department; 27 
 3.  Lends his or her identification card to another person for 28 
the other’s use or uses an identification card issued to another 29 
person; or 30 
 4.  Willfully fails to surrender to the Department within 10 31 
days after another’s identification card comes into his or her 32 
possession or to return it to the proper holder, 33 
 is guilty of a misdemeanor. 34 
 Sec. 17.  NRS 179D.570 is hereby amended to read as follows: 35 
 179D.570 1.  The Central Repository shall, in accordance 36 
with the requirements of this section, share information concerning 37 
sex offenders and offenders convicted of a crime against a child 38 
with: 39 
 (a) The Nevada Gaming Control Board to carry out the 40 
provisions of NRS 463.335 pertaining to the registration of a 41 
gaming employee who is a sex offender or an offender convicted of 42 
a crime against a child. The Central Repository shall, at least once 43 
each calendar month, provide the Nevada Gaming Control Board 44 
with the name and other identifying information of each offender 45

who is not in compliance with the provisions of this chapter, in the 1 
manner and form agreed upon by the Central Repository and the 2 
Nevada Gaming Control Board. 3 
 (b) The Department of Motor Vehicles to carry out the 4 
provisions of NRS 483.283, 483.861 and 483.929. 5 
 (c) The Department of Health and Human Services to carry 6 
out the provisions of section 12 of this act. 7 
 2.  The information shared by the Central Repository pursuant 8 
to this section must indicate whether a sex offender or an offender 9 
convicted of a crime against a child is in compliance with the 10 
provisions of this chapter. 11 
 3.  The Central Repository shall share information pursuant to 12 
this section as expeditiously as possible under the circumstances. 13 
 4.  The Central Repository may adopt regulations to carry out 14 
the provisions of this section. 15 
 Sec. 18.  NRS 237.200 is hereby amended to read as follows: 16 
 237.200  1.  Except as otherwise provided in subsection 2, 17 
with respect to any activity or transaction in which a local 18 
government accepts an identification card issued by the Department 19 
of Motor Vehicles to identify a person, the local government may 20 
also accept an identification card issued by the Department of 21 
Health and Human Services pursuant to sections 2 to 16, 22 
inclusive, of this this act, a consular identification card, permanent 23 
resident card or tribal identification card to identify a person. 24 
 2.  The provisions of subsection 1 apply only to the presentation 25 
of an identification card issued by the Department of Health and 26 
Human Services, a consular identification card, permanent resident 27 
card or tribal identification card for purposes of identification and 28 
do not convey an independent right to receive benefits of any type. 29 
 3.  To be accepted pursuant to subsection 1 to identify a person, 30 
an identification card issued by a tribal government must contain: 31 
 (a) The full legal name of the holder of the card; 32 
 (b) The date of birth of the holder of the card; 33 
 (c) A unique number assigned to the holder of the card; 34 
 (d) A digital photograph of the full face of the holder of the 35 
card; 36 
 (e) The address of the principal residence of the holder of the 37 
card; 38 
 (f) A physical description of the holder of the card, including, 39 
without limitation, the height, weight, hair color and eye color of the 40 
holder of the card; 41 
 (g) The usual signature of the holder of the card; 42 
 (h) The date on which the card is issued; and 43 
 (i) A reference to the tribal government which issued the card. 44 
 4.  As used in this section: 45

 (a) “Consular identification card” means an identification card 1 
issued by a consulate of a foreign government, which consulate is 2 
located within the State of Nevada. 3 
 (b) “Identification card issued by the Department of Motor 4 
Vehicles” means an identification card of the type described in NRS 5 
483.810 to 483.890, inclusive. 6 
 (c) “Local government” has the meaning ascribed to it in  7 
NRS 237.050. 8 
 (d) “Permanent resident card” means a Permanent Resident Card 9 
issued by the United States Citizenship and Immigration Services of 10 
the Department of Homeland Security. 11 
 (e) “Tribal government” has the meaning ascribed to it in  12 
NRS 239C.105. 13 
 (f) “Tribal identification card” means an identification card 14 
issued by a tribal government which satisfies the requirements of 15 
subsection 3. 16

confidential, all public books and public records of a governmental 21 
entity must be open at all times during office hours to inspection by 22 
any person, and may be fully copied or an abstract or memorandum 23 
may be prepared from those public books and public records. Any 24 
such copies, abstracts or memoranda may be used to supply the 25 
general public with copies, abstracts or memoranda of the records or 26 
may be used in any other way to the advantage of the governmental 27 
entity or of the general public. This section does not supersede or in 28 
any manner affect the federal laws governing copyrights or enlarge, 29 
diminish or affect in any other manner the rights of a person in any 30 
written book or record which is copyrighted pursuant to federal law. 31 
 2.  A governmental entity may not reject a book or record 32 
which is copyrighted solely because it is copyrighted. 33 
 3.  A governmental entity that has legal custody or control of a 34 
public book or record shall not deny a request made pursuant to 35 
subsection 1 to inspect or copy or receive a copy of a public book or 36 
record on the basis that the requested public book or record contains 37 
information that is confidential if the governmental entity can 38 
redact, delete, conceal or separate, including, without limitation, 39 
electronically, the confidential information from the information 40 
included in the public book or record that is not otherwise 41 
confidential. 42 
 4.  If requested, a governmental entity shall provide a copy of a 43 
public record in an electronic format by means of an electronic 44 
medium. Nothing in this subsection requires a governmental entity 45

to provide a copy of a public record in an electronic format or by 1 
means of an electronic medium if: 2 
 (a) The public record: 3 
  (1) Was not created or prepared in an electronic format; and 4 
  (2) Is not available in an electronic format; or 5 
 (b) Providing the public record in an electronic format or by 6 
means of an electronic medium would: 7 
  (1) Give access to proprietary software; or 8 
  (2) Require the production of information that is confidential 9 
and that cannot be redacted, deleted, concealed or separated from 10 
information that is not otherwise confidential. 11 
 5. An officer, employee or agent of a governmental entity who 12 
has legal custody or control of a public record: 13 
 (a) Shall not refuse to provide a copy of that public record in the 14 
medium that is requested because the officer, employee or agent has 15 
already prepared or would prefer to provide the copy in a different 16 
medium. 17 
 (b) Except as otherwise provided in NRS 239.030, shall, upon 18 
request, prepare the copy of the public record and shall not require 19 
the person who has requested the copy to prepare the copy himself 20 
or herself. 21 
 Sec. 20.  This act becomes effective: 22 
 1. Upon passage and approval for the purpose of adopting any 23 
regulations and performing any other preparatory administrative 24 
tasks that are necessary to carry out the provisions of this act; and 25 
 2. On January 1, 2026, for all other purposes. 26
