AN ACT relating to homelessness; requiring the board of county commissioners of certain counties to notify the Department of Transportation before conducting a clean- up of an encampment of homeless persons near certain rights-of-way; authorizing the Department to consult with a homeless outreach team and participate in the clean-up of an encampment of homeless persons conducted by the homeless outreach team; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Section 1 of this bill requires the board of county commissioners of each 1 county whose population is 700,000 or more (currently only Clark County) to 2 notify the Department of Transportation before conducting a clean-up of an 3 encampment of homeless persons near a right-of-way that is controlled by the 4 Department. Section 3 of this bill authorizes the Department to: (1) consult with a 5 homeless outreach team; and (2) approve and otherwise participate in the clean-up 6 of an encampment of homeless persons that is conducted by the homeless outreach 7 team in a right-of-way. 8 – 2 – - *AB263_R1* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 244 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. The board of county commissioners of each county whose 3 population is 700,000 or more shall notify the Department of 4 Transportation before conducting a clean-up of an encampment 5 of homeless persons near a right-of-way that is controlled by the 6 Department of Transportation. 7 2. As used in this section, “right-of-way” has the meaning 8 ascribed to it in NRS 408.55014. 9 Sec. 2. (Deleted by amendment.) 10 Sec. 3. Chapter 408 of NRS is hereby amended by adding 11 thereto a new section to read as follows: 12 1. The Department may: 13 (a) Consult with a homeless outreach team; and 14 (b) Approve and otherwise participate in the clean-up of an 15 encampment of homeless persons that is conducted by the 16 homeless outreach team in a right-of-way, as defined in 17 NRS 408.55014. 18 2. As used in this section, “homeless outreach team” means a 19 homeless outreach team established or designated by a board of 20 county commissioners for the purposes of providing outreach and 21 clean-ups related to homeless persons. 22 H
