AN ACT relating to public works; requiring certain projects for the 
development or improvement of broadband, 
telecommunication or fiber optic services to comply with 
provisions governing public works; requiring a contractor 
or subcontractor engaged on such a project to submit 
certain records to the Board of Directors of the Nevada 
State Infrastructure Bank; and providing other matters 
properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law sets forth various requirements for public works, including, 1 
without limitation, requirements for: (1) procedures for the awarding of contracts 2 
by a public body; (2) the prevailing wage to be paid to certain workers employed in 3 
connection with the public work; (3) the retention of records relating to workers 4 
employed in connection with the public work and the wages and benefits paid to 5 
such workers; and (4) a contractor on a public work to establish certain fair 6 
employment practices. (Chapter 338 of NRS) 7 
 This bill provides that the provisions of existing law governing public works 8 
apply to any project for the development or improvement of broadband, 9 
telecommunication or fiber optic services for which public money has been 10 
provided and that is sponsored, financed, overseen or administered by a public 11 
body in the same manner as if the public body awarded a contract for the project, 12 
even if the project does not qualify as a public work.  13 
 Existing law requires a contractor or subcontractor engaged on a public work to 14 
maintain certain records concerning workers employed by the contractor or 15 
subcontractor in connection with the public work and the wages and benefits paid 16 
to such workers. Existing law requires a contractor or subcontractor to ensure that a 17 
copy of each such record for each calendar month is received by the public body 18 
awarding the contract not later than 15 days after the end of each month. (NRS 19 
338.070) This bill requires a contractor or subcontractor engaged on a project 20

described above who submits to a public body a copy of such a record to 21 
simultaneously submit a copy of the record to the Board of Directors of the Nevada 22 
State Infrastructure Bank.  23 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 338 of NRS is hereby amended by adding 1 
thereto a new section to read as follows: 2 
 1. In addition to any other requirements imposed by federal 3 
or state law, the provisions of this chapter apply to any project for 4 
the development or improvement of b roadband, 5 
telecommunication or fiber optic services for which public money 6 
has been provided and that is sponsored, financed, overseen or 7 
administered by a public body, including, without limitation, 8 
through the disbursement of money by the public body or the 9 
issuance by the public body of a request for procurement, in the 10 
same manner as if the public body awarded a contract for  11 
the project, even if the project does not qualify as a public work.  12 
 2. A contractor or subcontractor engaged on a project 13 
described in subsection 1 that submits to a public body a copy of a 14 
record required pursuant to subsection 5 of NRS 338.070 shall 15 
simultaneously submit a copy of the record to the Board of 16 
Directors of the Nevada State Infrastructure Bank. 17 
 3. As used in this section, “public body” has the meaning 18 
ascribed to it in NRS 338.010 and includes, without limitation, the 19 
Office of Science, Innovation and Technology in the Office of the 20 
Governor.  21
