AN ACT relating to professions; revising requirements to obtain a license as a marriage and family therapist or clinical professional counselor by endorsement; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law provides for the licensure and regulation of marriage and family 1 therapists and clinical professional counselors by the Board of Examiners for 2 Marriage and Family Therapists and Clinical Professional Counselors. (Chapter 3 641A of NRS) Existing law sets forth procedures by which a marriage and family 4 therapist or clinical professional counselor who is licensed in the District of 5 Columbia or any state or territory of the United States may obtain a license by 6 endorsement to practice in this State. Under existing law, the Board is authorized to 7 issue such a license by endorsement to an applicant who submits to the Board, 8 among other things: (1) proof satisfactory to the Board that the applicant has not 9 been disciplined or investigated by the corresponding regulatory authority of the 10 District of Columbia or the state or territory in which the applicant holds a license 11 as a marriage and family therapist or clinical professional counselor, as applicable; 12 and (2) any other information required by the Board. (NRS 641A.242) This bill 13 instead requires, rather than authorizes, the Board to issue such a license by 14 endorsement to an applicant who meets the applicable requirements and eliminates 15 the requirements that an applicant submit: (1) proof to the Board that the applicant 16 has not been investigated by the corresponding regulatory authority, thereby 17 making a person who has been investigated by the corresponding regulatory 18 authority, but who has not been disciplined by the authority, eligible to obtain a 19 license by endorsement; and (2) any other information required by the Board. 20 – 2 – - *AB450_R1* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 641A.242 is hereby amended to read as 1 follows: 2 641A.242 1. The Board [may] shall issue a license by 3 endorsement to practice as a marriage and family therapist or 4 clinical professional counselor to an applicant who meets the 5 requirements set forth in this section. An applicant may submit to 6 the Board an application for such a license if the applicant holds a 7 corresponding valid and unrestricted license as a marriage and 8 family therapist or clinical professional counselor, as applicable, in 9 the District of Columbia or any state or territory of the United 10 States. 11 2. An applicant for a license by endorsement pursuant to this 12 section must submit to the Board with his or her application: 13 (a) Proof satisfactory to the Board that the applicant: 14 (1) Satisfies the requirements of subsection 1; 15 (2) Has not been disciplined [or investigated] by the 16 corresponding regulatory authority of the District of Columbia or 17 the state or territory in which the applicant holds a license as a 18 marriage and family therapist or clinical professional counselor, as 19 applicable; and 20 (3) Has not been held civilly or criminally liable for 21 malpractice in the District of Columbia or any state or territory of 22 the United States; 23 (b) A complete set of fingerprints and written permission 24 authorizing the Board to forward the fingerprints to the Central 25 Repository for Nevada Records of Criminal History for submission 26 to the Federal Bureau of Investigation for a report on the applicant’s 27 background, and to such other law enforcement agencies as the 28 Board deems necessary for a report on the applicant’s background; 29 (c) An affidavit stating that the information contained in the 30 application and any accompanying material is true and correct; and 31 (d) The fees prescribed by the Board pursuant to NRS 641A.290 32 for the application for an initial license and for the initial issuance of 33 a license . [; and 34 (e) Any other information required by the Board.] 35 3. Not later than 15 business days after receiving an application 36 for a license by endorsement to practice as a marriage and family 37 therapist or clinical professional counselor pursuant to this section, 38 the Board shall provide written notice to the applicant of any 39 additional information required by the Board to consider the 40 application. Unless the Board denies the application for good cause, 41 the Board shall approve the application and issue a license by 42 – 3 – - *AB450_R1* endorsement to practice as a marriage and family therapist or 1 clinical professional counselor, as applicable, to the applicant not 2 later than 45 days after receiving all the additional information 3 required by the Board to complete the application. 4 4. A license by endorsement to practice as a marriage and 5 family therapist or clinical professional counselor may be issued at a 6 meeting of the Board or between its meetings by the President of the 7 Board. Such an action shall be deemed to be an action of the Board. 8 5. At any time before making a final decision on an application 9 for a license by endorsement pursuant to this section, the Board 10 may, for any reason, grant a provisional license authorizing an 11 applicant to practice as a marriage and family therapist or clinical 12 professional counselor, as applicable, in accordance with regulations 13 adopted by the Board. 14 H
