AN ACT relating to professions; revising requirements to obtain a 
license as a marriage and family therapist or clinical 
professional counselor by endorsement; and providing 
other matters properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law provides for the licensure and regulation of marriage and family 1 
therapists and clinical professional counselors by the Board of Examiners for 2 
Marriage and Family Therapists and Clinical Professional Counselors. (Chapter 3 
641A of NRS) Existing law sets forth procedures by which a marriage and family 4 
therapist or clinical professional counselor who is licensed in the District of 5 
Columbia or any state or territory of the United States may obtain a license by 6 
endorsement to practice in this State. Under existing law, to obtain such a license 7 
by endorsement, an applicant must submit to the Board, among other things, proof 8 
satisfactory to the Board that the applicant has not been disciplined or investigated 9 
by the corresponding regulatory authority of the District of Columbia or the state or 10 
territory in which the applicant holds a license as a marriage and family therapist or 11 
clinical professional counselor, as applicable. (NRS 641A.242) This bill eliminates 12 
the requirement that an applicant submit proof to the Board that the applicant has 13 
not been investigated by the corresponding regulatory authority, thereby making a 14 
person who has been investigated by the corresponding regulatory authority, but 15 
who has not been disciplined by the authority, eligible to obtain a license by 16 
endorsement.  17

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 641A.242 is hereby amended to read as 1 
follows: 2 
 641A.242 1.  The Board may issue a license by endorsement 3 
to practice as a marriage and family therapist or clinical professional 4 
counselor to an applicant who meets the requirements set forth in 5 
this section. An applicant may submit to the Board an application 6 
for such a license if the applicant holds a corresponding valid and 7 
unrestricted license as a marriage and family therapist or clinical 8 
professional counselor, as applicable, in the District of Columbia or 9 
any state or territory of the United States. 10 
 2.  An applicant for a license by endorsement pursuant to this 11 
section must submit to the Board with his or her application: 12 
 (a) Proof satisfactory to the Board that the applicant: 13 
  (1) Satisfies the requirements of subsection 1; 14 
  (2) Has not been disciplined [or investigated] by the 15 
corresponding regulatory authority of the District of Columbia or 16 
the state or territory in which the applicant holds a license as a 17 
marriage and family therapist or clinical professional counselor, as 18 
applicable; and 19 
  (3) Has not been held civilly or criminally liable for 20 
malpractice in the District of Columbia or any state or territory of 21 
the United States; 22 
 (b) A complete set of fingerprints and written permission 23 
authorizing the Board to forward the fingerprints to the Central 24 
Repository for Nevada Records of Criminal History for submission 25 
to the Federal Bureau of Investigation for a report on the applicant’s 26 
background, and to such other law enforcement agencies as the 27 
Board deems necessary for a report on the applicant’s background; 28 
 (c) An affidavit stating that the information contained in the 29 
application and any accompanying material is true and correct; 30 
 (d) The fees prescribed by the Board pursuant to NRS 641A.290 31 
for the application for an initial license and for the initial issuance of 32 
a license; and 33 
 (e) Any other information required by the Board. 34 
 3.  Not later than 15 business days after receiving an application 35 
for a license by endorsement to practice as a marriage and family 36 
therapist or clinical professional counselor pursuant to this section, 37 
the Board shall provide written notice to the applicant of any 38 
additional information required by the Board to consider the 39 
application. Unless the Board denies the application for good cause, 40 
the Board shall approve the application and issue a license by 41 
endorsement to practice as a marriage and family therapist or 42

clinical professional counselor, as applicable, to the applicant not 1 
later than 45 days after receiving all the additional information 2 
required by the Board to complete the application. 3 
 4.  A license by endorsement to practice as a marriage and 4 
family therapist or clinical professional counselor may be issued at a 5 
meeting of the Board or between its meetings by the President of the 6 
Board. Such an action shall be deemed to be an action of the Board. 7 
 5.  At any time before making a final decision on an application 8 
for a license by endorsement pursuant to this section, the Board 9 
may, for any reason, grant a provisional license authorizing an 10 
applicant to practice as a marriage and family therapist or clinical 11 
professional counselor, as applicable, in accordance with regulations 12 
adopted by the Board. 13
