AN ACT relating to insurance; including certain insurance that 
provides for certain payments for certain legal services 
and certain expenses in the definition of “casualty 
insurance”; and providing other matters properly relating 
thereto. 
Legislative Counsel’s Digest: 
 Existing law provides for the regulation of insurance and insurers in this State 1 
by the Commissioner of Insurance. (Title 57 of NRS) Existing law establishes 2 
various kinds of insurance and prohibits the Commissioner from authorizing an 3 
insurer to transact in this State any kind of insurance other than the kinds of 4 
insurance established under existing law. (NRS 680A.080, 681A.010-681A.080) 5 
Among the various kinds of insurance established under existing law is casualty 6 
insurance, which existing law defines to include vehicle insurance, liability 7 
insurance, workers’ compensation and employer’s liability insurance and various 8 
other particular types of casualty insurance. (NRS 681A.020) This bill expands the 9 
definition of casualty insurance to include legal expenses insurance, which, under 10 
this bill, means insurance against any liability to pay or reimburse the costs of any 11 
specific legal services or specific legal expenses, other than the cost of any fee paid 12 
to an attorney for the overhead and administrative costs of the attorney. As such, 13 
under this bill, legal expenses insurance is included among the various types of 14 
insurance that a casualty insurer may be authorized to transact and subject to any 15 
applicable provision of existing law governing casualty insurance.  16

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 681A.020 is hereby amended to read as 1 
follows: 2 
 681A.020 1.  “Casualty insurance” includes: 3 
 (a) Vehicle insurance. Insurance against loss of or damage to 4 
any land vehicle or aircraft or any draft or riding animal or to 5 
property while contained therein or thereon or being loaded or 6 
unloaded therein or therefrom, from any hazard or cause, and 7 
against any loss, liability or expense resulting from or incidental to 8 
ownership, maintenance or use of any such vehicle, aircraft or 9 
animal, together with insurance against accidental injury to natural 10 
persons, irrespective of legal liability of the insured, including the 11 
named insured, while in, entering, alighting from, adjusting, 12 
repairing, cranking, or caused by being struck by a vehicle, aircraft 13 
or draft or riding animal, if such insurance is issued as an incidental 14 
part of insurance on the vehicle, aircraft or draft or riding animal. 15 
 (b) Liability insurance. Insurance against legal liability for the 16 
death, injury or disability of any human being, or for damage to 17 
property, including liability resulting from negligence in rendering 18 
expert, fiduciary or professional services, and provisions of medical, 19 
hospital, surgical, disability benefits to injured persons and funeral 20 
and death benefits to dependents, beneficiaries or personal 21 
representatives of persons killed, irrespective of legal liability of the 22 
insured, when issued as an incidental coverage with or supplemental 23 
to liability insurance. 24 
 (c) Workers’ compensation and employer’s liability. Insurance 25 
of the obligations accepted by, imposed upon or assumed by 26 
employers under law for death, disablement or injury of employees. 27 
 (d) Burglary and theft. Insurance against loss or damage by 28 
burglary, theft, larceny, robbery, forgery, fraud, vandalism, 29 
malicious mischief, confiscation, or wrongful conversion, disposal 30 
or concealment, or from any attempt at any of the foregoing, 31 
including supplemental coverage for medical, hospital, surgical and 32 
funeral expense incurred by the named insured or any other person 33 
as a result of bodily injury during the commission of a burglary, 34 
robbery or theft by another, and, also, insurance against loss of or 35 
damage to moneys, coins, bullion, securities, notes, drafts, 36 
acceptances or any other valuable papers and documents, resulting 37 
from any cause. 38 
 (e) Personal property floater. Insurance upon personal effects 39 
against loss or damage from any cause. 40 
 (f) Glass. Insurance against loss or damage to glass, including its 41 
lettering, ornamentation and fittings. 42

 (g) Boiler and machinery. Insurance against any liability and 1 
loss or damage to property or interest resulting from accidents to or 2 
explosions of boilers, pipes, pressure containers, machinery or 3 
apparatus, and to make inspection of and issue certificates of 4 
inspection upon boilers, machinery and apparatus of any kind, 5 
whether or not insured. 6 
 (h) Leakage and fire extinguishing equipment. Insurance against 7 
loss or damage to any property or interest caused by the breakage or 8 
leakage of sprinklers, hoses, pumps and other fire-extinguishing 9 
equipment or apparatus, water pipes or containers, or by water 10 
entering through leaks or openings in buildings, and insurance 11 
against loss or damage to such sprinklers, hoses, pumps and other 12 
fire-extinguishing equipment or apparatus. 13 
 (i) Credit and mortgage guaranty. Insurance against loss or 14 
damage resulting from failure of debtors to pay their obligations to 15 
the insured, and insurance of real property mortgage lenders against 16 
loss by reason of nonpayment of the mortgage indebtedness. 17 
 (j) Elevator. Insurance against loss of or damage to any property 18 
of the insured, resulting from the ownership, maintenance or use of 19 
elevators, except loss or damage by fire, and to make inspection of 20 
and issue certificates of inspection upon, elevators. 21 
 (k) Congenital defects. Insurance against congenital defects in 22 
human beings. 23 
 (l) Livestock. Insurance against loss or damage to livestock, and 24 
services of a veterinary for such animals. 25 
 (m) Entertainments. Insurance indemnifying the producer of any 26 
motion picture, television, radio, theatrical, sport, spectacle, 27 
entertainment, or similar production, event or exhibition against loss 28 
from interruption, postponement or cancellation thereof due to 29 
death, accidental injury or sickness of performers, participants, 30 
directors or other principals. 31 
 (n) Legal expenses. Insurance against any liability to pay or 32 
reimburse the costs of any specific legal services or specific legal 33 
expenses, other than the cost of any fee paid to an attorney for the 34 
overhead and administrative costs of the attorney. 35 
 (o) Miscellaneous. Insurance against any other kind of loss, 36 
damage or liability properly a subject of insurance and not within 37 
any other kind of insurance as defined in this chapter, if such 38 
insurance is not disapproved by the Commissioner as being contrary 39 
to law or public policy, including insurance for home protection 40 
issued pursuant to NRS 690B.100 to 690B.180, inclusive. 41 
 2.  Provision of medical, hospital, surgical and funeral benefits, 42 
and of coverage against accidental death or injury, as incidental to 43 
and part of other insurance as stated under paragraphs (a) (vehicle), 44 
(b) (liability), (d) (burglary), (g) (boiler and machinery) and (j) 45

(elevator) of subsection 1 shall for all purposes be deemed to be the 1 
same kind of insurance to which it is so incidental, and is not subject 2 
to provisions of this Code applicable to life and health insurances. 3
