AN ACT relating to juvenile justice; revising the term length and membership of the Juvenile Justice Oversight Commission; and providing other matters properly relating thereto. Legislative Counsel’s Digest: The federal Juvenile Justice and Delinquency Prevention Act of 1974 provides 1 federal funding to states to develop programs in the area of juvenile delinquency 2 and to improve the juvenile justice system. To be eligible for certain federal grants 3 under the Act, a state must submit to the Administrator of the Office of Juvenile 4 Justice and Delinquency Prevention within the United States Department of Justice 5 a plan that provides for an advisory group which consists of certain members 6 appointed by the chief executive officer of the state. (34 U.S.C. § 11133) To 7 comply with this eligibility requirement, existing state law establishes the Juvenile 8 Justice Oversight Commission and prescribes specific qualifications for 9 membership on the Commission. (NRS 62B.600) Section 1 of this bill replaces 10 certain requirements concerning the number of members of the Commission and 11 the qualifications for membership on the Commission with a requirement that the 12 membership of the Commission must comply with the requirements of the Act. 13 Section 1 also increases the term of members of the Commission from 2 years to 4 14 years. Section 2 of this bill: (1) provides that the term of each existing member of 15 the Commission expires on October 1, 2025; and (2) requires the Governor to 16 appoint new members to the Commission. 17 – 2 – - *AB7* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 62B.600 is hereby amended to read as 1 follows: 2 62B.600 1. The Juvenile Justice Oversight Commission is 3 hereby established. 4 2. The Commission consists of the Governor or his or her 5 designee and [25] members appointed by the Governor. The 6 [Governor shall appoint to] membership of the Commission [: 7 (a) Two members nominated by the Senate, who are not 8 members of the Senate or public officers. 9 (b) Two members nominated by the Assembly, who are not 10 members of the Assembly or public officers. 11 (c) Two members nominated by the Supreme Court, who are not 12 judges, justices or public officers. 13 (d) The Administrator of the Division of Child and Family 14 Services or his or her designee. 15 (e) The Deputy Administrator of Juvenile Services of the 16 Division of Child and Family Services or his or her designee. 17 (f) Three members who are directors of juvenile services, one 18 each of whom must represent a county whose population: 19 (1) Is less than 100,000. 20 (2) Is 100,000 or more but less than 700,000. 21 (3) Is 700,000 or more. 22 (g) Two members who are district attorneys. 23 (h) Two members who are public defenders. 24 (i) One member who is a representative of a law enforcement 25 agency. 26 (j) Two members who are representatives of a nonprofit 27 organization which provides programs to prevent juvenile 28 delinquency. 29 (k) One member who is a volunteer who works with children 30 who have been adjudicated delinquent. 31 (l) Six members who are under the age of 24 years at the time of 32 appointment.] must comply with the requirements prescribed by 34 33 U.S.C. § 11133(a)(3)(A). 34 3. [At least three of the persons appointed to the Commission 35 pursuant to subsection 2 must be persons who are currently or were 36 formerly subject to the jurisdiction of the juvenile court. 37 4.] Each appointed member serves a term of [2] 4 years. 38 Members may be reappointed for additional terms of [2] 4 years in 39 the same manner as the original appointments. Any vacancy 40 occurring in the membership of the Commission must be filled in 41 the same manner as the original appointment not later than 30 days 42 – 3 – - *AB7* after the vacancy occurs. [Nine of the initial members of the 1 Commission who are appointed pursuant to subsection 2 must be 2 appointed to an initial term of 1 year.] Each member of the 3 Commission continues in office until his or her successor is 4 appointed. 5 [5.] 4. The members of the Commission serve without 6 compensation but are entitled to receive the per diem allowance and 7 travel expenses provided for state officers and employees generally. 8 [6.] 5. A majority of the members of the Commission 9 constitutes a quorum for the transaction of business, and a majority 10 of a quorum present at any meeting is sufficient for any official 11 action taken by the Commission. 12 [7.] 6. A member of the Commission who is an officer or 13 employee of this State or a political subdivision of this State must be 14 relieved from his or her duties without loss of regular compensation 15 to prepare for and attend meetings of the Commission and perform 16 any work necessary to carry out the duties of the Commission in the 17 most timely manner practicable. A state agency or political 18 subdivision of this State shall not require an officer or employee 19 who is a member of the Commission to: 20 (a) Make up the time he or she is absent from work to carry out 21 his or her duties as a member of the Commission; or 22 (b) Take annual leave or compensatory time for the absence. 23 [8.] 7. At the first meeting of the Commission and annually 24 thereafter: 25 (a) The Governor shall appoint a Chair of the Commission; 26 (b) The Commission shall elect a Secretary from among its 27 members; and 28 (c) The Commission shall adopt rules for its own management 29 and government. 30 [9.] 8. The Commission shall [: 31 (a) Hold its first meeting within 60 days after all the initial 32 appointments to the Commission are made pursuant to subsection 2; 33 and 34 (b) Meet] meet at least once every 4 months and may meet at 35 such further times as deemed necessary by the Chair. 36 [10. As used in this section, “public officer” has the meaning 37 ascribed to it in NRS 205.4627.] 38 Sec. 2. 1. The terms of the members of the Juvenile Justice 39 Oversight Commission appointed pursuant to NRS 62B.600 who are 40 incumbent on October 1, 2025, expire on that date. 41 – 4 – - *AB7* 2.
