AN ACT relating to energy; requiring the Director of the Office of Energy within the Office of the Governor to consider certain written comments of a board of county commissioners upon receipt of an application for a partial abatement of certain taxes by certain renewable energy facilities; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes certain renewable energy facilities to apply to the 1 Director of the Office of Energy within the Office of the Governor for a partial 2 abatement of certain sales and use taxes and property taxes. As soon as practicable 3 after the Director receives such an application, existing law requires the Director to 4 forward a copy of the application to certain persons and entities, including the 5 board of county commissioners. (NRS 701A.360) 6 Section 1 of this bill requires that, in addition to any other requirement set forth 7 in existing law, the Director: (1) provide the board of county commissioners of the 8 county in which the facility will be located an opportunity to submit written 9 comments on the application; and (2) consider any written comments received from 10 the board of county commissioners when determining whether to approve or deny 11 the application. 12 Section 2 of this bill applies the definitions in existing law relating to the 13 partial abatement of certain taxes for certain renewable energy projects to the 14 provisions of section 1. 15 – 2 – - *AB70* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 701A of NRS is hereby amended by 1 adding thereto a new section to read as follows: 2 In addition to any other requirement set forth in NRS 701A.300 3 to 701A.390, inclusive, the Director shall: 4 1. Provide the board of county commissioners of the county 5 in which the facility will be located an opportunity to submit 6 written comments on an application; and 7 2. Consider any written comments received from the board of 8 county commissioners when determining whether to approve or 9 deny an application for a partial abatement. 10 Sec. 2. NRS 701A.300 is hereby amended to read as follows: 11 701A.300 As used in NRS 701A.300 to 701A.390, inclusive, 12 and section 1 of this act, unless the context otherwise requires, the 13 words and terms defined in NRS 701A.305 to 701A.345, inclusive, 14 have the meanings ascribed to them in those sections. 15 Sec. 3.
