ASSEMBLY JOINT RESOLUTION—Urging Congress to extend 
the Social Security Fairness Act. 
 WHEREAS, The Social Security Fairness Act was signed into law 1 
on January 5, 2025, thereby repealing the Government Pension 2 
Offset and the Windfall Elimination Provision; and 3 
 WHEREAS, The Social Security Fairness Act applies to monthly 4 
Social Security benefits affected by the Government Pension Offset 5 
and Windfall Elimination Provision from December 2023 forward; 6 
and 7 
 WHEREAS, The repeal of the Government Pension Offset 8 
restored benefits to an estimated 9 out of 10 public employees who 9 
lost their entire spousal benefit under the Government Pension 10 
Offset formula, regardless of whether such employee’s spouse paid 11 
Social Security taxes; and 12 
 WHEREAS, The repeal of the Windfall Elimination Provision 13 
stopped the reduction of Social Security benefits for employees who 14 
have earned a federal, state or local government pension and who 15 
have, at some point, been employed in jobs where the employees 16 
were required to pay Social Security taxes and paid said taxes for 17 
the period required to qualify for such benefits; and 18 
 WHEREAS, More than 2 million government employees and 19 
retirees across the United States of America now benefit from the 20 
repeal of the Government Pension Offset or the Windfall 21 
Elimination Provision; and 22

 WHEREAS, Up to 11.8 percent of Social Security beneficiaries in 1 
Nevada affected by the Windfall Elimination Provision are expected 2 
to receive an estimated increase to their duly earned Social Security 3 
benefits of up to $558 per month; and 4 
 WHEREAS, Social Security benefit recipients affected by the 5 
Government Pension Offset will receive an estimated increase to 6 
their monthly Social Security benefits of between $700 and $1,190; 7 
and 8 
 WHEREAS, Social Security benefit recipients are expected to 9 
receive an estimated $4,320 in backdated payments of benefits for 10 
the months of January 2024 to December 2024 alone; now, 11 
therefore, be it 12 
 RESOLVED BY THE ASSEMBLY AND SENATE OF THE STATE OF 13 
NEVADA, JOINTLY, That the Nevada Legislature hereby urges 14 
Congress to enact legislation to extend the Social Security Fairness 15 
Act to apply from the month of December 2013 forward and for the 16 
President of the United States to sign that legislation into law; and 17 
be it further 18 
 RESOLVED, That the Chief Clerk of the Assembly prepare and 19 
transmit a copy of this resolution to the President of the United 20 
States, the Vice President of the United States as the presiding 21 
officer of the Senate, the Speaker of the House of Representatives 22 
and each member of the Nevada Congressional Delegation; and be it 23 
further 24 
 RESOLVED, That this resolution becomes effective upon 25 
passage. 26
