AN ACT relating to water; revising provisions governing the Account for the Channel Clearance, Maintenance, Restoration, Surveying and Monumenting Program; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law: (1) creates the Account for the Channel Clearance, Maintenance, 1 Restoration, Surveying and Monumenting Program in the State General Fund; and (2) 2 requires that the money in this Account be used to award grants under the Program to 3 cities, counties and other political subdivisions of this State and tribal governments in 4 this State as equivalent matching money for projects for the clearance, maintenance, 5 restoration, surveying and monumenting of navigable rivers. Under existing law, the 6 State Engineer is required to administer the Account and the Program. (NRS 532.220, 7 532.230) Existing law also creates the Contingency Account in the State General 8 Fund and prescribes a procedure for allocation of money in that Account by the 9 Interim Finance Committee, upon the recommendation of the State Board of 10 Examiners, for prescribed purposes, including as provided in specific statute. (NRS 11 353.266, 353.268, 353.269) Under existing law, the State Engineer is required to 12 request an allocation from the Contingency Account if the balance in the Account for 13 the Channel Clearance, Maintenance, Restoration, Surveying and Monumenting 14 Program is not sufficient to provide a grant under the Program. In addition, the State 15 Engineer is authorized to request an allocation from the Contingency Account if the 16 balance in the Account for the Channel Clearance, Maintenance, Restoration, 17 Surveying and Monumenting Program is below $250,000. (NRS 532.230) This bill: 18 (1) increases this balance for triggering discretionary requests from the Contingency 19 Account to $500,000; and (2) provides that only money in the Account for the 20 Channel Clearance, Maintenance, Restoration, Surveying and Monumenting Program 21 that is not committed for expenditure is included in the calculation of that balance. 22 – 2 – - *SB108* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 532.230 is hereby amended to read as follows: 1 532.230 1. The Account for the Channel Clearance, 2 Maintenance, Restoration, Surveying and Monumenting Program is 3 hereby created in the State General Fund. 4 2. The money in the Account must be administered by the State 5 Engineer and must be expended only to aid local governments or 6 tribal governments in the manner provided in NRS 532.220. 7 3. If the balance in the Account that is not committed for 8 expenditure is below [$250,000,] $500,000, the State Engineer may 9 request an allocation from the Contingency Account pursuant to 10 NRS 353.266, 353.268 and 353.269. 11 4. If the balance in the Account is not sufficient to provide a 12 grant of money to an incorporated city, a county, a political 13 subdivision of this State or a tribal government in this State, the 14 State Engineer shall request an allocation from the Contingency 15 Account pursuant to NRS 353.266, 353.268 and 353.269. 16 Sec. 2.
